CALL TO ORDER -- REGULAR SESSION
 
EXECUTIVE SESSION ITEMS:
 
Action to authorize an Executive Session of the Board of Supervisors pursuant to Arizona Revised Statute §38-431.03. 
 
Motion to recess the Regular Session portion of the agenda, convene in Executive Session pursuant to Arizona Revised Statute §38-431.03 to address the item(s) listed in the Executive Session portion of the agenda, and reconvene in Regular Session immediately after the Executive Session concludes.
 
1.   County Attorney: Discussion or consultation with the County Attorney to consider its position and instruct its attorneys regarding pending opioid litigation. This matter is brought in executive session pursuant to A.R.S. § 38-431.01 (A)(3) and (4). No Action

CALL TO THE PUBLIC: Call to the Public is held for public benefit to allow individuals to address issue(s) within the Board's jurisdiction. Board members may not discuss items that are not specifically identified on the agenda. Therefore, pursuant to Arizona Revised Statute §38-431.01(H), action taken as a result of public comment will be limited to directing staff to study the matter, responding to criticism, or scheduling the matter for further discussion and decision at a future date.
 
PRESENTATIONS, PROCLAMATIONS & APPOINTMENTS: Note: During this segment of the agenda, board members may discuss the presentations and proclamations, and may announce appointments to the Yuma County Planning and Zoning Commission and the Yuma County Board of Adjustment. No legal actions will be taken.
 
1.   Presentation of the Yuma County Quarterly Safety Excellence Award by County Administrator Susan Thorpe. No Action
 
2.   Presentation of "The County Line" by Yuma 77, the Yuma County Government Channel. No Action
 
3.   County Administration: Chairman proclaims the week of May 6 - 12, 2019 as "Yuma County Nurses Week". No Action

Yuma County Health District recognized with the Daniel T. Cloud Award for leadership and dedication in the field of immunizations.

CONSENT CALENDAR:  The following items listed under the Consent Agenda will be considered as a group and acted upon by one motion with no separate discussion, unless a Board Member so requests. In that event, the item will be removed from the Consent Calendar for separate discussion and action. 
 
1.   Assessor: Approve Tax Roll Corrections as listed in batch dated May 06, 2019, pursuant to ARS Title 42, Chapter 16, Article VI.  (A full listing of all corrections is available from the Office of the Clerk of the Board of Supervisors.) Approved as presented
 
2.   Finance: Approve the Accounts Payable Demands disbursed in the amount of $3,097,560.37 and Payroll in the amount of $3,212,887.06 during the period of March 26, 2019 through April 11, 2019. (A detailed listing is available for review in the Office of the Clerk of the Board of Supervisors.) Approved as presented
 
3.   Clerk of the Board: Approve the following minutes: a) April 1, 2019 Regular Session; b) April 10, 2019 Special Joint Session; c) April 15, 2019 Regular Session; and; d) April 15, 2019 Executive Session. Approved as presented
 
4.   Clerk of the Board:  Recommend State approval of a Regular Liquor License Application Series No. 6, submitted by Jose Luis Garcia Jr., dba Tarros Chicali Sports Bar & Nightclub LLC, 2526 E 16th Street, Yuma, Arizona 85365, State License No. 06140032. BOS recommended approval

Facilities Management: Authorize the Facilities Management Director to negotiate with Pilkington Commercial Company for the Administration Annex Renovation (197 S. Main), Phase II (CIP No. 2.1704) and award contract if an agreement is made.

6.   Superior Court/Juvenile Court: Adopt Budget Amendment Resolution No. 19-98 increasing budget by $2,000 in the Juvenile Drug Court Fund and increasing contingency by $950. Approved as presented
 
7.   Arizona@Work:  The Yuma County Workforce Development Board, operated by Arizona@Work requests that the Yuma County Board of Supervisors appoint Wayne Rooks to fill a vacancy representing the Business sector on the Yuma County Workforce Development Board, for a term that will expire on June 13, 2022. Approved as presented
 
8.   Arizona@Work:  The Yuma County Workforce Development Board, operated by Arizona@Work requests that the Yuma County Board of Supervisors appoint Douglas A. Pancrazi to fill a vacancy representing the Business Sector on the Yuma County Workforce Development Board, for a term that will expire on June 13, 2022. Approved as presented
 
9.   Public Health Services District: Adopt Budget Amendment Resolution No. 19-97 increasing budget authority by $4,000 for the Be Active Yuma Award issued through Blue Cross Blue Shield. Approved as presented
 
10.   Public Health Services District: a) Approve and authorize Director to sign Contract No. ADHS CTR042317 between the Arizona Department of Health Services and Yuma County Public Health Services District, and; b) Adopt Budget Amendment Resolution No. 19-96 increasing budget authority by $50,000 for the Overdose Fatality Review Team Grant No. ADHS CTR042317. Approved as presented
 
11.   Justice Court Precinct One: a) Authorize the Chairman to sign an Addendum to an Intergovernmental Agreement (IGA) between the City of Somerton and Yuma County to provide mandated weekend and holiday court services as defined in Arizona Rules of Criminal Procedure 4.1(d), effective July 1, 2019 through June 30, 2020, and; b) Approve an invoice in the amount of $473.00 for the provision of said services. 12.   Justice Court Precinct One: a) Authorize the Chairman to sign an Addendum to an Intergovernmental Agreement (IGA) between the City of San Luis and Yuma County to provide mandated weekend and holiday court services as defined in Arizona Rules of Criminal Procedure 4.1(d), effective July 1, 2019 through June 30, 2020; and b) Approve an invoice in the amount of $945.00 for the provision of said services. DISCUSSION AND ACTION ITEMS: The Board will open each of the following items separately for discussion and action, as appropriate.
 
1.   Development Services: Request the County Attorney to file an abatement action in Superior Court to enforce Zoning Violation Case No. 18-H-0171 for the property located at 9429 E. Pinto Drive. Approved as presented
 
2.   County Administrator: Discussion on ways Yuma County may assist the City of Yuma and/or local nongovernmental organizations that are helping to address community conditions resulting from U.S. Customs and Border Protection release of migrants into the Yuma region, and possible action to direct a budget amendment to appropriate funds from General Fund contingency to one or more organizations as deemed necessary. 3.   County Administration: Discussion and possible action regarding the following legislative items: a) A report to the Board of Supervisors regarding proposed bills in the Arizona State Legislature with impact to Yuma County, and; b) Update regarding strategies relating to federal legislative priorities. No Action
 
4.   County Attorney: Approve and authorize the Chairman to execute the Outside Counsel Services Opioid Investigation and Litigation Contract with the law firm of Keller Rohrback L.L.P., a law firm with offices in several states including Arizona at 3101 N. Central Avenue, Suite 1400, Phoenix, Arizona 85012, to represent the interests of Yuma County in the pending opioid litigation. Approved as presented
 
PLANNING & ZONING AGENDA: Full legal descriptions of property sites for all Rezoning Cases are available for public review at the Yuma County Board of Supervisors' Office.
 
EXPEDITED REZONING and PUBLIC HEARINGS:  These items will be opened as a group for public hearings and acted upon by one motion to adopt the recommendation of the Planning & Zoning Commission, except for any item that is removed by a Board member for separate consideration. That item will be discussed and acted upon separately following action on expedited items.
 
1.   Development Services/Planning & Zoning Division: Special Use Permit Case No. 19-01:  The Ann & Jimmie Stewart Trust 04-19-1995 requests a Special Use Permit per Section 601.03(X) of the Yuma County Zoning Ordinance to allow an Accessory Dwelling Unit on a parcel 5.0 gross acres in size zoned Rural Area-5 acre minimum (RA-5), Assessor's Parcel Number 748-59-005, located at 4626 East County 16th Street, Yuma, Arizona. Approved PZ Com Rec'n - APPROVED
 
2.   Development Services/Planning & Zoning Division: Special Use Permit Case No. 19-02: Carter Vickers, agent for Arizona Public Service (APS), requests a Special Use Permit per Section 601.03(T) of the Yuma County Zoning Ordinance to allow an electrical substation on a parcel 20.0 gross acres in size zoned Rural Area-10 acre minimum size (RA-10), Assessor’s Parcel Number 197-20-008, located on the northeast corner of Avenue 5½ E and County 14th Street, Yuma, Arizona. 1.   County Administrator/Office of Management & Budget: Presentation will be given summarizing the Recommended Fiscal Year 2019-20 Budget for Yuma County. No Action

1.   Board members and County Administrator will report on and may discuss events attended or to be attended on behalf of the County, may present a brief summary of current events and may update the schedule for future Board of Supervisors meetings, as appropriate.
