PLEDGE OF ALLEGIANCE
 
CALL TO THE PUBLIC: Call to the Public is held for public benefit to allow individuals to address issue(s) within the Board's jurisdiction. Board members may not discuss items that are not specifically identified on the agenda. Therefore, pursuant to Arizona Revised Statute §38-431.01(H), action taken as a result of public comment will be limited to directing staff to study the matter, responding to criticism, or scheduling the matter for further discussion and decision at a future date.
 
PRESENTATIONS, PROCLAMATIONS & APPOINTMENTS: Note: During this segment of the agenda, board members may discuss the presentations and proclamations, and may announce appointments to the Yuma County Planning and Zoning Commission and the Yuma County Board of Adjustment. No legal actions will be taken.
 
1.   Presentation of "The County Line" by Yuma 77, the Yuma County Government Channel. No Action
 
2.   Recognition of Gloria Mallek upon her retirement from Yuma County. No Action
 
3.   Development Services: Public Presentation by the 2020 Yuma County Complete Count Committee kicking off the 2020 Census outreach effort. No Action
 
CONSENT CALENDAR:  The following items listed under the Consent Agenda will be considered as a group and acted upon by one motion with no separate discussion, unless a Board Member so requests. In that event, the item will be removed from the Consent Calendar for separate discussion and action. 
 
1.   Assessor: Approve Tax Roll Corrections as listed in batch dated February 20, 2019, pursuant to ARS Title 42, Chapter 16, Article VI.  (A full listing of all corrections is available from the Clerk of the Board of Supervisors.) Approved as presented
 
2.   Finance: Approve the Accounts Payable Demands disbursed in the amount of $2,155,847.34 and Payroll in the amount of $1,628,369.25 during the period of January 10, 2019 through January 24, 2019. (A detailed listing is available for review in the Office of the Clerk of the Board of Supervisors.) Approved as presented
 
3.   Clerk of the Board:  Approve the minutes for the following meetings: a) January 23, 2019 Regular Session; b) February 4, 2019 Regular Session; and c) February 4, 2019 Executive Session. Approved as presented
 
4.   County Administration/Election Services: Adopt Budget Amendment Resolution No. 19-69 re-establishing budget authority in the amount of $148,784 for Capital Improvement Project No. 6.1703, Election Equipment and Appropriating Capital Improvement Fund balance. Approved as presented
 
5.   Yuma County Elections/Recorder: Authorize the Chairman to sign an Intergovernmental Agreement between Yuma County, the County Recorder and the City of San Luis to provide election services to the City of San Luis for five years, effective the date of recordation and terminating on February 20, 2024. Approved as presented
 
6.   County Administration:  Action to: a) Declare miscellaneous County Property as surplus to County needs as listed in Exhibit A for County Administration, Adult Probation, Grants Division, Juvenile Court, Library District, and Public Works; b) Authorize auction items to be publicly auctioned online between March 15, 2019 and March 29, 2019, and; c) Authorize the disposal of any items that are not sold at auction pursuant to the Yuma County Purchasing Policy.  (Exhibit A is available for review from the Office of the Clerk of the Board of Supervisors.) Approved as presented
 
7.   Public Works: Authorize the expenditure of an additional $345,106, using existing budget authority, for additional slurry seal projects in Fiscal Year 2019. Approved as presented
 
8.   Sheriff's Office: a) Adopt Budget Amendment Resolution No. 19-65 establishing $83,000 capital outlay budget authority in the Boat Patrol Fund and transferring funds from current capital outlay savings in the General Fund/Patrol in the amount of $52,100, and; b) Authorize the Sheriff to purchase a new patrol boat from Rogue Jet Boatworks with Boat Patrol funds in an amount not to exceed $83,000. 9.   Sheriff's Office: Authorize the Sheriff to sign an intergovernmental agreement with Arizona Western College and the City of Yuma through the Yuma Police Department to participate in a local Law Enforcement Training Academy. Approved as presented
 
10.   Adult Probation: Adopt Budget Amendment Resolution No. 19-70, increasing budget authority in the AmeriCorps Grant fund by $5,589. Approved as presented

Facilities Management: Reject all bids for the Administration Building Renovation Project (CIP No. 21703) (old Elections area on the first floor of 198 S. Main Street), and authorize the Facilities Management Director to send rejection notifications and re-solicit for proposals.

12.   Facilities Management: Adopt Budget Amendment Resolution No. 19-41, increasing budget authority for the Jail District CIP Fund No. 04403 in the amount of $412,138 ($213,938 for CIP Project No. 5.1301 and $198,200 for CIP Project No. 5.1602), increasing appropriation of fund balance and construction in progress line items. Approved as presented

Development Services/Engineering: Approve the following for the Chip Seal Program, Spring 2019 Yuma and Mohawk District Chip Seal Project (CIP No. 1.1801):  a) Award the construction contract to Cholla Pavement Maintenance Inc. in the amount of $1,333,726.80 and authorize the County Engineer to sign the construction contract, and; b) Adopt Budget Amendment Resolution No. 19-71 transferring $400,000 from CIP No. 1.1802 County 17th Street W. Main Canal Replacement and $100,000 from DDS/HURF contingency to Construction in Progress.

14.   Development Services/Engineering: Approve the following for the 8th Street Improvement Project, Avenue D to Avenue C. (CIP No. 1.0003):  a) Award the construction contract to DPE Construction Inc. in the amount of $3,639,163.50 and authorize the County Engineer to sign the construction contract, and;  b) Adopt Budget Amendment Resolution No. 19-72 transferring $450,000 from Construction in Progress (45510) to CIP No. 1.0003. Approved as presented
 
DISCUSSION AND ACTION ITEMS: The Board will open each of the following items separately for discussion and action, as appropriate.
 
1.   Development Services: In accordance with A.R.S. 11-251 (9) & 948), conduct an auction at 9:00 a.m., or as schedule permits, of 12107 S. Sandra Avenue (Assessor's Parcel No. 728-03-028), a county-owned excess parcel, and authorize the County Engineer to execute the documents transferring the property to the highest bidder at or above the minimum bid.  If there are no successful bids, continue this item and authorize the County Engineer to return this item to the Board when there is sufficient interest to conduct an auction.

2.   Development Services/Building Safety Division: Set a public hearing for March 18, 2019 at 9:00 a.m. to accept public comment on Ordinance No. 2019-01, proposed amendments to the Yuma County Comprehensive Building Safety Code to conform to the City of Yuma building codes, and authorize staff to publish the hearing date. Approved as presented
 
3.   County Administration: Authorize the Chairman to sign the intergovernmental agreement between Yuma County and the cities and towns within the County for 4FrontED, for the promotion of bi-national economic development in the megaregion that includes Yuma County; San Luis, Rio Colorado, Sonora; Imperial County, California; and Mexicali, Baja California.  Approved as presented
 
4.   County Administrator:  Authorize the execution of an Intergovernmental Agreement between the Yuma County Board of Supervisors and the Yuma County Recorder transferring administrative oversight of the Election Services Division to the Yuma County Recorder's Office. Approved as Amended
 
5.   Development Services: Discussion and possible action concerning the Dark Sky Ordinance (Outdoor Lighting Regulations). No Action
 
6.   County Administration: Discussion and possible action regarding the following legislative items: a) A report to the Board of Supervisors regarding proposed bills in the Arizona State Legislature with impact to Yuma County, and; b) An update on the development of a federal Talking Points memorandum for the upcoming trip to Washington, D.C. to meet with our Congressional delegation. No Action
 
PLANNING & ZONING AGENDA: Full legal descriptions of property sites for all Rezoning Cases are available for public review at the Yuma County Board of Supervisors' Office.
 
REZONING -- REVERSION HEARINGS: In accordance with Section 404.01(I)(7) of the Yuma County Zoning Ordinance, the Board will conduct a hearing to grant an extension of time to comply with the Schedule for Development, determine compliance with the Schedule for Development, or cause the property to revert to its former zoning classification in the following cases:
 
1.   Development Services/Planning & Zoning Division: Rezoning Case No. 17-07: In accordance with Section 404.01(I)(7) of the Yuma County Zoning Ordinance, action to grant an extension of time to comply with the Schedule for Development or cause the property to its former RA-10 zoning classification, Assessor's Parcel Nos. 755-33-001, -002 -004 and -005, located on the southeast corner of Avenue A and County 17th Street, Yuma, Arizona. 
*Scrivener's Error: The Assessor’s Parcel Number is -004 not -002.

EVENTS CALENDAR/CURRENT EVENTS:
 
1.   Board members and County Administrator will report on and may discuss events attended or to be attended on behalf of the County, may present a brief summary of current events and may update the schedule for future Board of Supervisors meetings, as appropriate. No legal action will be taken, pursuant to A.R.S. §38-431.02(K). No Action

The Board may vote to hold an Executive Session for the purpose of obtaining legal advice from the Board's attorney on any matter listed on the agenda, pursuant to Arizona Revised Statute §38-431.03(A)(3).
