CALL TO ORDER -- REGULAR SESSION
 
EXECUTIVE SESSION ITEMS:
 
Action to authorize an Executive Session of the Board of Supervisors pursuant to Arizona Revised Statute §38-431.03. 
 
Motion to recess the Regular Session portion of the agenda, convene in Executive Session pursuant to Arizona Revised Statute §38-431.03 to address the item(s) listed in the Executive Session portion of the agenda, and reconvene in Regular Session immediately after the Executive Session concludes.
 
1.   County Attorney: Discussion or consultation for legal advice in order to consider its position and instruct its representatives regarding pending litigation in the case of Tourtillott et al., v. Yuma County, No. CV2015-091608. This matter is brought in executive session pursuant to A.R.S. § 38-431 (A.)(3) and (4). No Action
 
REGULAR SESSION ITEMS:
 
PLEDGE OF ALLEGIANCE
 
CALL TO THE PUBLIC: Call to the Public is held for public benefit to allow individuals to address issue(s) within the Board's jurisdiction. Board members may not discuss items that are not specifically identified on the agenda. Therefore, pursuant to Arizona Revised Statute §38-431.01(H), action taken as a result of public comment will be limited to directing staff to study the matter, responding to criticism, or scheduling the matter for further discussion and decision at a future date.
 
PRESENTATIONS, PROCLAMATIONS & APPOINTMENTS: Note: During this segment of the agenda, board members may discuss the presentations and proclamations, and may announce appointments to the Yuma County Planning and Zoning Commission and the Yuma County Board of Adjustment. No legal actions will be taken.
 
1.   Presentation of "The County Line" by Yuma 77, the Yuma County Government Channel. No Action
 
2.   Financial Services: Presentation of the Yuma County and Jail District's Comprehensive Annual Financial Reports (CAFR); and presentation on the Audit results for the fiscal year ended June 30, 2018. No Action
 
CONSENT CALENDAR:  The following items listed under the Consent Agenda will be considered as a group and acted upon by one motion with no separate discussion, unless a Board Member so requests. In that event, the item will be removed from the Consent Calendar for separate discussion and action. 
 
1.   Assessor: Approve Tax Roll Corrections as listed in batch dated February 04, 2019, pursuant to ARS Title 42, Chapter 16, Article VI.  (A full listing of all corrections is available from the Office of the Clerk of the Board of Supervisors.) Approved as presented
 
2.   Finance: Approve the Accounts Payable Demands disbursed in the amount of $1,322,039.97 and Payroll in the amount of $1,720,823.04 during the period of December 26, 2018 through January 11, 2019. (A detailed listing is available for review in the Office of the Clerk of the Board of Supervisors.) Approved as presented
 
3.   County Administration/Elections: As requested by the Yuma County Republican Party, approve the following Republican Precinct Committeemen appointments for terms that will expire on October 1, 2020: Edward C. Thomas and Nadia Hanif,  Precinct 4; Douglas L. Holbert, Precinct 5; Lorraine April Arney, Precinct 15; Ema Lea Shoop, Precinct 16; Carla Rae Schmidt  and Gilbert D. Hernandez, Precinct 24; Sharon White, Precinct 38; Allyson Sprague, Richard Sprague, and William J. Regenhardt, Precinct 39. Approved as presented
 
4.   County Administrator/Election Services:  Board of Supervisors approval of an Addendum to the November 6, 2018 General Election Canvass. Approved as presented
 
5.   County Administration:  Adopt Resolution No. 2019-05 amending the Yuma County Tax Deeded Property Auction Policy.  Approved as presented
 
6.   Human Resources: Approve appointments to the Merit Award System Board as follows: Reappoint Diane Umphress, District No. 2; Nancy Tucker, District No. 3; Gary Black, District No. 4; and Bobbi Firebush, District No. 5; and Appoint Judith "Judy" Gill, District No. 1 for terms which will sunset on December 31, 2019. 7.   Justice Court Precinct One: Approve the appointment of Nohemy Echavarria as Justice of the Peace Pro Tempore to serve in Yuma County Justice Courts from February 4, 2019 through June 30, 2019. Approved as presented

Housing: Reappoint Daniela Vega Esparza to the Yuma County Housing Board for a term that will sunset on February 1, 2020.

Chairman recesses the Yuma County Board of Supervisors and convenes as the Yuma County Housing Governing Board.
 
HOUSING GOVERNING BOARD - DISCUSSION CALENDAR: The Board will open each of the following items separately for discussion and action, as appropriate.
 
1.  
Housing: Adopt Resolution No. 2019-07, adopting the Yuma County Housing Department’s Public Housing Agency Annual Plan for Fiscal Year 2019, Public Housing Residential Lease Agreement, Capital Fund Five (5) Year Action Plan, and the 2018 Capital Fund and related certifications and agreements with the U.S. Department of  Housing and Urban Development (HUD).

Housing: Adopt and authorize Chairman to sign Resolution No. 2019-06, adopting the amended Low Rent Public Housing Program Admissions and Continued Occupancy Policy (ACOP) according to the most recent federal regulations for the three Yuma County Housing Department’s developments:  Valley Vista Apartments, 8450 West Highway 95, Somerton, Arizona; Moctezuma Apartments, 345 East Juan Sanchez Boulevard, San Luis, Arizona; and Pecan Shadows Apartments, 2650 West 3rd Street, Yuma, Arizona.

Housing: Adopt Resolution No. 2019-08, approving the Yuma County Housing Department’s Family Self-Sufficiency Program Action Plan.

4.   Housing: Adopt Resolution No. 2019-09, approving the amended Section 8 Administrative Plan for the Yuma County Housing Department’s Housing Choice Voucher program. Approved as presented
 
5.  
Housing: Authorize the Chairman to sign the Utility Easement for the Valley Vista Sewer Lift Station which grants, conveys and assigns, to ARIZONA PUBLIC SERVICE (APS), an Arizona corporation, and to its successors, a non-exclusive right, privilege, and easement to enter upon, construct, reconstruct, replace, repair, operate and maintain electrical lines together with appurtenant facilities and fixtures for use in connection therewith, for the transmission and distribution of electricity to, through, across, and beyond a strip of land situated in the County of Yuma described in the Attached A and B.

Chairman adjourns the Yuma County Housing Governing Board and reconvenes the Yuma County Board of Supervisors in Regular Session.
 
DISCUSSION AND ACTION ITEMS: The Board will open each of the following items separately for discussion and action, as appropriate.
 
1.   Development Services: Action to authorize the Development Services Director to execute a contract with Central Square to provide Permit Management Software to Yuma County. Approved as presented
 
2.   Development Services/Engineering: In accordance with A.R.S. §11-251 (9) & 948), conduct an auction at 9:00 a.m., or as schedule permits, of Assessor's Parcel No. 728-03-029, a county-owned excess parcel, and authorize the County Engineer to execute the documents transferring the property to the highest bidder at or above the minimum bid.  If there are no successful bids, continue this item and authorize the county engineer to return this item to the Board when there is sufficient interest to conduct an auction. 3.   County Administrator/Election Services:  Post-election report for the 2018 Midterm Primary and General elections. No Action
 
4.   County Administration: Discussion and possible action regarding the following legislative items: a) A report to the Board of Supervisors regarding proposed bills in the Arizona State Legislature with impact to Yuma County, and; b) An update on the development of a federal Talking Points memorandum for the upcoming trip to Washington, D.C. to meet with our Congressional delegation. No Action
 
PLANNING & ZONING AGENDA: Full legal descriptions of property sites for all Rezoning Cases are available for public review at the Yuma County Board of Supervisors' Office.
 
REZONING -- REGULAR PUBLIC HEARING ITEMS: Staff will make a full presentation on each of the following items, followed by separate discussion, public hearing, and action by the Board of Supervisors.
 
1.   Development Services/Planning & Zoning Division:  Special Use Permit Case No. 18-09: John Mahon, agent for Michael B. Bean, requests a Special Use Permit per Section 601.03(Y) of the Yuma County Zoning Ordinance to allow a wireless communication facility on a parcel 5.00 gross acres in size zoned Rural Area-5 acre minimum (RA-5), Assessor’s Parcel No. 724-52-004, located at 13686 South Avenue 5E, Yuma, Arizona.  Denied
 
EVENTS CALENDAR/CURRENT EVENTS:
 
1.   Board members and County Administrator will report on and may discuss events attended or to be attended on behalf of the County, may present a brief summary of current events and may update the schedule for future Board of Supervisors meetings, as appropriate. No legal action will be taken, pursuant to A.R.S. §38-431.02(K). No Action
 
WORK SESSION DISCUSSION AND ACTION ITEM: The Board will discuss and may take action on the following item(s) as appropriate:
 
 
1.   Human Resources: Discussion and possible direction to staff regarding potential changes to the Pay for Performance Program including Personnel Rule 304 and related matters.  No Action
