SUBJECT MATTER:
Receive, consider and act upon a request to assemble in Town Hall Parking Lot for a public prayer rally;
FISCAL IMPACT:

BACKGROUND:
The Township received a request to conduct a prayer rally in the parking lot of Town Hall in the afternoons of October 21, 28 and November 4 (Attachment A).  The rally is part of a series of nation-wide rallies leading up to the general elections in November.

As the request includes the use of a Public Address system ( PA) which is amplied sound, and Township Orders do not cover issuing Special Event Permits for the use of Town Hall, staff does not have authority to consider approval of the use of  the parking lot Town Hall for an assembly that includes amplied sound.

The requestor was advised that the right to assemble in the parking lot is permitted, but the use of amplifed sound must be approved by the Board of Directors.  The request included a rally on October 21, which occurs prior to the October 25 meeting of the Board. Therefore, the requestor was advised that while the rally could occur, the use of amplied sound could not.   The requestor was also advised that Montgomery County provides a public assembly location in the parking lot of the Ed Chance Annex on Lake Front Circle. 
RECOMMENDATION:
Board to determine course of action.
