SUBJECT MATTER:
Receive, consider and act upon changes to the Special Events Permitting Policy to address commercial fireworks displays;

BACKGROUND:
In 2006, The Woodlands Association, Inc. (TWA)  and The Woodlands Commercial Owner's Association (WCOA) adopted policies and procedures to define the procedures by which an entity may obtain the authority to use fireworks within the boundaries of the particular Association which are otherwise prohibited, as outlined in their respective Covenants (Attachment A). 

No policy or procedures was put in place by the Woodlands Community Association, Inc. (WCA) because the WCA Covenants prohibit the sale and use of fireworks, of any kind whatsoever on properties encumbered with WCA Covenants.

As the Township assumed the obligations, responsibilities and authorities of the Associations, the Township's Covenant Administration Department and The Woodlands Fire Department has continued to abide by the Associations' policies on fireworks in addition to compliance with other local, state and federal regulations governing the display of fireworks. 

In 2013, the Township Board of Directors adopted a Special Event Policy and Procedures.  While the related administrative procedures have processed fireworks requests for special events per the Associations' procedures and State and County regulations, the Policy and Procedures does not specifically address fireworks.  

It is recommended for the Township Board of Directors to  include a policy and procedures into the Township's Special Event Policy and Procedures addressing the display of commercial fireworks.  A Fireworks Display Approval Policy and Procedure has been prepared for consideration along with related administrative applications (Attachment B). 

The policy provides that only certain types of  fireworks (1.3G, 1.4G, Flame Effects) will be considered and approved based on Approval Criteria and providing required documentation.   Examples of the types of displays that have been approved and that are anticipated to be subject to the policy in the future are those displays associated with the Township's events such as Red, Hot and Blue Festival, Lighting of the Doves, Memorial Day and Labor Day festivals, and special events produced by others such as the Light the Night Walk and those occurring at the Cynthia Woods Mitchell Pavilion and private events such as holiday fireworks displays at the Carlton Woods golf course. 
RECOMMENDATION:
Approve the addition of the Fireworks Display Approval Policy and Procedures to the Special Event Policy and Procedures as presented.
