SUBJECT MATTER:
Receive, consider and act upon the Conveyance by Special Warrant Deed Village of Sterling Ridge Section 89 , Restricted Open Space Reserves A & D (P-2018-0542) and a Pathway Easement Agreement with The Woodlands Development Company (P-2018-0543) and an  Easement for Park and Outdoor Recreation Facilities with Municipal Utility District No. 46 for Spindle Tree Park and Trail Extension (P-2018-0544);
FISCAL IMPACT:
The estimated annual cost to maintain the walking/jogging track and trail,pathway and parking lot is $13,260 and will be included in the Parks Operations Budget. 
BACKGROUND:
The Woodlands Development Company (TWDC) has presented a Conveyance by Special Warranty Deed for the Village of Sterling Ridge Section  89, Restricted Open Space Reserves (ROSR) A & D (Attachment A) and a Pathway Easement (Attachment B)  and an Easement for Park and Outdoor Recreation Facilities with Municipal Utility District No. 46 (MUD) (Attachment C) that collectively make up Spindle Tree Park and the Spindle Tree Trail Extension (Attachment D).   

The park consists of approximately 5,360 linear feet of twelve (12) foot wide decomposed granite walking and jogging trail, 1,450 linear feet of fifteen (15) foot wide access road, 150 linear feet of eight (8) foot wide concrete pathway, benches, a drinking fountain and trail head parking for eight (8) vehicles.  The ROSRs contain the concrete pathways that provide a connection to the park and to the trail around MUD's detention pond to the community pathway system.  

This conveyance and Easement Agreement are similar to the Conveyance and Easement for Park and Outdoor Recreation Facilities between TWDC and The Woodlands Association for the 14.39 acres around the detention pond known as Windvale "X" Park  in the Village of Alden Bridge that has  4,920 linear feet of ten (10) foot wide asphalt walking and jogging track accepted in July, 2003.
RECOMMENDATION:
Accept the Conveyance by Special Warranty Deed the Village of Sterling Ridge Section  89, Restricted Open Space Reserves A & D and the Pathway Easement with The Woodlands Development Company; and the Easement for Park and Outdoor Recreation Facilities with Municipal Utility District 46 which collectively make up Spindle Tree Park and the Spindle Tree Trail Extension as presented herein and authorize the President/General Manager to execute the documents as approved to final form by the Township Attorney.
