Receive, consider and act upon an Interlocal Construction Access Agreement with the San Jacinto River Authority (C-2019-0006);
There is no fiscal impact to The Woodlands Township related to the Interlocal Construction Access Agreement;
In January of this year, the Board of Directors received a presentation from San Jacinto River Authority (SJRA) Woodlands Division regarding the rehabilitation of the Bear Branch Gravity Main (BBGM), (Attachment A).  SJRA regularly rehabilitates water and waste water infrastructure to avoid system failures, sewage overflows and permit violations. Specific gravity sewer lines have been identified for rehabilitation throughout the community including a segment(s) of sewer line BBGM. 

The Board was apprised at that time that the project requires a temporary staging area in the parking lot of Bear Branch Sports Fields.  SJRA has rights to a utility easement through the sports fields and parking lot (location of the sewer line), but will need a temporary construction access agreement to stage the equipment necessary for the rehabilitation work and that such agreement would be presented to the Township Board of Directors for consideration at a future meeting.  The agreement has been prepared and is presented for consideration (Attachment B).

The project to rehabilitate BBGM is extensive and may take over a year to complete.  While the sewer line is located entirely in the flood plain of Bear Branch and major construction activity will occur along the sewer line, access to the sewer line will be along and through residential areas and behind homes. The project extends from Kuykendhal Road close to Bear Branch Reservoir to the Bear Branch Sports Fields ending at the SJRA Waste Water Treatment Plant off Research Forest Dr.
SJRA is highly sensitive to public safety, resident impact, sport fields schedules, construction noise, odor and traffic. SJRA staff has provided Township staff the opportunity to review the preliminary project plans and schedule for comments and have hosted meetings for project updates. SJRA intends to provide a  public information campaign and notifications prior to any construction activity.
Approve the Interlocal Construction Access Agreement with San Jacinto River Authority and authorize the President/General Manager to execute the agreement as approved to final form by the Township Attorney.
