SUBJECT MATTER:
Receive, consider and act upon conveyance of open space reserves in the Village of Creekside Park West for parks, ponds and pathways and  pathway easements in the Villages of Creekside Park and Indian Springs (Pathway Easement VOIS 26 P-2019-0284; Pathway Easement - Creekside Forest Dr P-2019-0284; Pathway Easement Kuykendahl Road P-2019-0283);
FISCAL IMPACT:
Base annual maintenance cost for the parks, ponds and reserves submitted for conveyance is estimated to be $19,000 ($13,000 for mowing and $6,072 for lake and pond maintenance).  Several of these areas are already included in the base maintenance plan prior to their conveyance as they were included in the 2018 rebid of the park and pathway maintenance contracts. These areas, upon acceptance, will be added to the existing Park Maintenance Services Agreement with Yellowstone, the Pathway Maintenance Services Agreement with All Service Striping and to the Lake and Pond Maintenance Agreement with Lake Pro Services.
BACKGROUND:
The Woodlands Land Development Company (TWLDC) has submitted the following Restricted Open Space Reserves (ROSR) for conveyance: The Woodlands Creekside Park West,  Section 3, Reserve "A";  Section 24 Reserve "B;  Section 27, Restricted Open Space Reserve "B";  Section 28, Reserves "A", "B", "C", and "D";  Section 29, Restricted Open Space Reserves "A","B","C", and "D"; Section 34, Restricted Open Space Reserves  "A", "B", "C", "D", and "E"; Section 38, Reserve "E";  and pathway easements along Kuykendahl and Creekside Forest Drive. Included within these sections are three parks: Smooth Stream Park, a neighborhood park; Shumard Oaks Park, Sooki Pond Park and Mariposa Pond Park, each amenity/pond parks; and an additional pond at Camellia Park (Attachment A - Special Warranty Deed; Attachment B - Pathway Easements; Attachment C - Map of Creekside Park West Reserves and Pathways; Attachment D - ILUD for ROSR & Parks Multi TWA-HC; Attachment E -  Annexation of Lands Subject to TWA Covenants).  
 
The ROSR’s,  parks and pathways have been inspected and a pre-conveyance report has been provided to TWLDC. There were no matters of concern identified in the pre-conveyance report. The pathway segments along Kuykendahl are those the Township funded jointly with TWLDC after the Kuykendahl bridge was expanded.  A total of 44.88 acres of land and 7,016 linear feet of pathway will be added to the Township's parks, open space and pathway inventory upon this conveyance.
RECOMMENDATION:
Accept the conveyance by Special Warranty Deed and Pathway Easements from The Woodlands Land Development Company, L.P. for The Woodlands Creekside Park West:  Section 3, Reserve "A";  Section 24 Reserve "B;  Section 27, Restricted Open Space Reserve "B";  Section 28, Reserves "A", "B", "C", and "D";  Section 29, Restricted Open Space Reserves "A","B","C", and "D"; Section 34, Restricted Open Space Reserves  "A", "B", "C", "D", and "E"; Section 38, Reserve "E"; and pathway easements along Kuykendahl and Creekside Forest Drive as approved to final form by the Township Attorney.
