SUBJECT MATTER:
Receive, consider and act upon approval of payment for the purchase of law enforcement vehicles in FY 2019 and FY 2020 for the Montgomery County Sheriff’s Office – The Woodlands District 6 in accordance with the Interlocal Agreements with Montgomery County (C-2016-0444A, C-2017-0224A);
FISCAL IMPACT:
$592,736.12 in Fiscal Year 2019 (FY 2019) and $1,278,560 in Fiscal Year 2020 (FY 2020)
BACKGROUND:
The Township has two Interlocal Agreements (ILAs) with Montgomery County that relate to vehicles purchased for use by the Sheriff’s Deputies that the Township contracts for enhanced patrol in the Montgomery County Sheriff’s Office (MCSO) – The Woodlands District 6 (see attached).
 
The Interlocal Agreement for contracted law enforcement services (C-2017-0224A) relates to the enhanced law enforcement services funded by the Township, including the vehicles and equipment purchased for use by the contracted deputies. This agreement defines the process for annually updating the budget amounts, which may include funding for future vehicle purchases, by letter. The full agreement and the budget letters for FY 2019 and FY 2020 are attached for reference. Based on the Board’s approval of funding for the purchase of vehicles, MCSO ordered 11 vehicles and related equipment in late 2018 and has now received and invoiced the Township for these fully equipped vehicles in a total amount of $592,736.12. The order for vehicles funded in FY 2020 will likely be placed prior to year-end 2019. The FY 2020 budget includes the funding for 22 vehicles and related equipment (see attached).
 
In May 2019, the Board and the County approved an Amended ILA for Acquisition of the Law Enforcement Facility on Grogan’s Mill (C-2016-0444A) in order to include the law enforcement vehicles and equipment previously acquired by Montgomery County through Township funding (vehicles acquired prior to incorporation) in the agreement.
 
The November 2019 invoice sent to the Township for 11 fully equipped vehicles is the first invoice for vehicles received since the May 2019 Amended ILA was approved.
 
Based on the Interlocal Agreements and funding budgeted in FY 2019 and FY 2020, it is recommended that the Board approve the payment of invoices for MCSO vehicles upon receipt.
RECOMMENDATION:
Authorize payment upon receipt in 2019 and 2020 for Montgomery County Sheriff's Office vehicles that are subject of the Montgomery County Interlocal Agreements (C-2017-0224A and C-2016-0444A), provided that the funding requested does not exceed the amount approved in the Township Adopted Budget for the respective year.
