SUBJECT:
Accept a Consent Request with Md7 related to ownership transfer of cellular towers located at the Sunset Reservoir site, and determine that this action is exempt from environmental review pursuant to Section 15061(b)(3) of the State's guidelines implementing the California Environmental Quality Act (Municipal Utilities and Engineering Director Harris)
MOTION(S):

If the City Council determines that staff’s recommendation is appropriate, the following motions are provided:
  1. I move that the City Council determine acceptance of a Consent Request related to ownership transfer of cellular towers located at the Sunset Reservoir site is exempt from environmental review under Section 15061(b)(3) of the State's guidelines implementing the California Environmental Quality Act; and
     
  2. I move that the City Council accept a Consent Request with Md7 related to ownership transfer of cellular towers located at the Sunset Reservoir site.
RECOMMENDATION:

Staff recommends City Council determine acceptance of a Consent Request with Md7 related to ownership transfer of cellular towers located at the Sunset Reservoir site is exempt from environmental review under Section 15061(b)(3) of the State's guidelines implementing the California Environmental Quality Act and accept the Consent Request.
DISCUSSION:

In September 2001, the City of Redlands entered into an Agreement with Cox PCS Assets, LLC to lease approximately 667 square feet of the Sunset Reservoir site to construct cellular communication infrastructure. This infrastructure includes towers, a base station, antenna poles, and associated wires and cables. The initial term of this Agreement is twenty (20) years. Cox PCS Assets, LLC later changed its name to Sprint PCS Assets, LLC, and transferred ownership to T-Mobile USA, Inc (T-Mobile). 

T-Mobile recently notified City staff of a pending transaction with Vertical Bridge NTCF, Inc. whereby Vertical Bridge will manage and operate a portion of T-Mobile's tower portfolio, including infrastructure located at the Sunset Reservoir site. Md7 is the authorized T-Mobile representative for this transaction. Acceptance of the Consent Request acknowledges and consents to the ownership transfer. Section 5 - Assignment/Subletting of the current Agreement states the following: 

"Cox shall not assign or transfer this Agreement or sublet all or any portion of the Site without the prior written consent of Owner, which consent will not be unreasonably withheld."

The existing tower does not interfere with water operations at the Sunset Reservoir site, and the ownership transfer does not propose any new construction of cellular communication infrastructure.

Acceptance of this Consent Request is exempt from environmental review under section 15061(b)(3) of the State's guidelines implementing the California Environmental Quality Act as it can be seen with certainty it will not have a significant effect on the environment.
ALTERNATIVES:

City Council may elect to decline the Consent Request with Md7.
