SUBJECT:
Consideration of the Planning Commission's Report on its finding of conformance with the City of Redlands General Plan, acceptance of the donation of property identified as Assessor’s Parcel No. 0169-053-11-0000, authorization for the City Manager to execute the associated property transfer and ownership documentation, and determination that acceptance of the property donation is exempt from further environmental review pursuant to Section 15061(b)(3) of the state’s guidelines implementing the California Environmental Quality Act (Facilities & Community Services Director Boatman)
MOTION(S):

If the City Council determines that staff’s recommendation is appropriate, the following motions are provided:
  1. I move to accept the donation of the property identified as County of San Bernardino Assessor Parcel Number 0169-053-11-0000 and determine that the project is exempt from further environmental review pursuant to Section 15061(b)(3) of the state’s guidelines implementing the California Environmental Quality Act; and
  2. I move to authorize the City Manager to execute the associated property transfer and ownership documentation related to the donation of the subject property."
RECOMMENDATION:

Staff recommends that the City Council determine that the acceptance of the donation of Assessor’s Parcel No. 0169-053-11-0000 is in conformance with the City of Redlands General Plan; determine that the acceptance of the donation is exempt from further environmental review pursuant to Section 15061(b)(3) of the state’s guidelines implementing the California Environmental Quality Act; accept the donation of the property identified as Assessor’s Parcel No. 0169-053-11-0000, and authorize the City Manager to execute the associated property transfer and ownership documentation.
 
DISCUSSION:

On June 24, 2021, staff received an offer to donate the subject property from the owner. The property is 0.03 acres and is located on the corner of Tennessee Street and West Redlands Boulevard. The property is within the existing 100’ Redlands Blvd. street right-of-way (ROW).

California Government Code Section 65402 states that no real property shall be acquired until the Planning Commission has made a determination on the conformity with the adopted General Plan. In order to address this requirement, the Planning Commission considered the proposed acquisition on September 14, 2021, and determined the use of the property to be in conformity with the adopted General Plan. The attached resolution details the Planning Commission determination.

In order to expedite the transfer of the parcel, staff is requesting City Council authorize the City Manager to execute the associated property transfer and ownership documentation related to the donation of the subject property.

Acceptance of the donation is exempt from review under the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines Section 15061(b)(3) which provides that CEQA applies only to projects which have the potential for causing a significant effect on the environment. There is no possibility that the acceptance of the donation will have a significant effect on the environment. This action is merely a transfer ownership of the subject property.
ALTERNATIVES:

The City Council may decline to accept the donation of the property and direct staff accordingly.

Discussion:
There will be minimal fiscal impact related to the filing of the property transfer and ownership documentation. Sufficient funding for any filing fees is included in the Facilities and Community Services Administrative Division's (101300) budget for Fiscal Year 2021-22 as approved by City Council.
