SUBJECT:
Approve a Cooperative Agreement with the City of Yucaipa delineating responsibilities for rehabilitating 16th Street, 18th Street, and Florida Street during the Pavement Management Program 2021 Street Resurfacing Project, and determine that approval of the Cooperative Agreement is exempt from environmental review pursuant to Section 15061(b)(3) of the State's guidelines implementing the California Environmental Quality Act (Municipal Utilities and Engineering Director Harris)
MOTION(S):

If the City Council determines staff’s recommendation is appropriate, the following motions are provided:
  1. I move that the City Council determine that approval of the Cooperative Agreement with the City of Yucaipa is exempt from environmental review pursuant to Section 15061(b)(3) of the State's guidelines implementing the California Environmental Quality Act; and
     
  2. I move that the City Council approve the Cooperative Agreement with the City of Yucaipa delineating responsibilities for rehabilitating 16th Street, 18th Street, and Florida Street paving during the Pavement Management Program 2021 Street Resurfacing Project.
RECOMMENDATION:

Staff recommends approval of a Cooperative Agreement with the City of Yucaipa delineating responsibilities for rehabilitating16th Street, 18th Street, and Florida Street during the Pavement Management Program 2021 Street Resurfacing Project, and determination that this action is exempt from environmental review pursuant to Section 15061(b)(3) of the State's guidelines implementing the California Environmental Quality Act.
 
DISCUSSION:

Currently, the full width of 16th Street, 18th Street, and Florida Street is scheduled to be reconstructed during the Pavement Management Plan (PMP) 2021 Street Resurfacing Project. Each of these streets straddle the Redlands and Yucaipa City limits line. Each City is responsible for maintaining the portions of each street within its jurisdiction.

Recently, Redlands staff contacted City of Yucaipa staff to discuss the concept of a potential Cooperative Agreement that will allow resurfacing the entire width of these streets. In the spirit of cooperation, staff representatives from both cities agreed that Redlands would act as the "lead agency" and negotiated Agreement language to delineate the roles, responsibilities, and financial participation of each City. The Agreement requires the City of Yucaipa to reimburse Redlands for actual pavement rehabilitation costs, estimated to be $58,290, for the portions of each street within the Yucaipa City limits. Redlands recently procured construction services, will manage the project, and will pay all other project costs.

Approval of the Cooperative Agreement with the City of Yucaipa is exempt from environmental review pursuant to Section 15061(b)(3) of the State’s guidelines implementing the California Environmental Quality Act because it will not result in a direct or reasonably foreseeable indirect physical change in the environment. 
ALTERNATIVES:

Council may elect to decline approval of the Cooperative Agreement with the City of Yucaipa.

Discussion:
Sufficient funds for the construction of this project, including contingencies, are included in the PMP 2021 Resurfacing Project, which was included in the Council-adopted FY 21/22 budget. Additionally, City of Yucaipa will reimburse the construction cost for their portion of the roadway under this agreement.
