SUBJECT:
Resolution No. 8102 overruling objections and proceeding with the abatement of subject properties (Fire Chief Topoleski)

(Mayor to declare meeting open as a public hearing)
PROCEDURE FOR PUBLIC HEARING:
  1. Mayor declares the meeting open as a public hearing.
  2. Mayor calls upon Department Director for report.
  3. Mayor calls for questions/comments from members of the City Council.
  4. Mayor calls upon City Clerk to note any written comments received from the public.
  5. Mayor closes the public hearing.
  6. City Council considers the motion and votes.
MOTION(S):

If the City Council determines that staff's recommendation is appropriate, the following motion is provided:

I move to adopt Resolution No. 8102.
RECOMMENDATION:

Staff recommends the City Council adopt Resolution No. 8102 overruling objections and proceeding with the abatement of subject properties.
 
DISCUSSION:

Beginning in March 2020, Community Risk Reduction staff performed inspections on parcels throughout the city to identify fire hazards.  Staff identified approximately 700 parcels that required abatement. At the regular Council Meeting of May 19, 2020, the City Council adopted Resolution No. 8083 to declare weeds a public nuisance.  A notice was then sent to each property owner to provide 30 days to abate the nuisance, or incur the cost of having the City abate their property and having the cost assessed upon their land as a lien until paid.

With the adoption of Resolution No. 8083, a public hearing date was set for June 16, 2020, as the date to hear any objections to the proposed weed abatement proceedings.

The adoption of Resolution No. 8102 will allow the City to proceed with the abatement of the identified parcels found in violation.  The abatement of parcels will continue to mitigate the threat of wildland fires that can overwhelm firefighting forces and Contribute to the deflagration of homes and property.
ALTERNATIVES:

Not adopt Resolution No. 8102 and stop abatement proceedings.
