SUBJECT:
Approve a grant of easement to Southern California Edison for a portion of Community Park and determination that approval of the easement is exempt from environmental review pursuant to Section 15061(b)(3) of the State's guidelines implementing the California Environmental Quality Act (Facilities and Community Services Director Boatman)
MOTION(S):

If the City Council determines that staff’s recommendation is appropriate, the following motions are provided:
  1. I move City Council determine that granting of the proposed easement is exempt from environmental review pursuant to Section 15061(b)(3) of the State's guidelines implementing the California Environmental Quality Act; and
     
  2. I move City Council approve the grant of easement to Southern California Edison.
RECOMMENDATION:

Staff recommends City Council determine that the granting of an easement is exempt from environmental review pursuant to Section 15061 (b)(3) of the State's Guidelines implementing the California Environmental Quality Act. Further, staff recommends that the City Council approve a Grant of Easement for electrical facilities to Southern California Edison over a portion of Community Park in order to allow for the installation of an electrical meter related to a cellular tower within Community Park.
DISCUSSION:

On December 5, 2017, the City Council entered into a Lease with New Cingular Wireless for the installation of a wireless facility within Community Park (Project).  The tower is located on the mid-west side of the property and south of San Bernardino Avenue. The project included the installation of wireless telecommunications equipment attached to a ball field light pole, new light fixtures, and an equipment shelter approximately 120 square feet in size. To finalize the project, Southern California Edison (SCE) is requesting a utility easement within the Park which will be used to provide electricity and install a meter pedestal to provided dedicated power to the Project.  Should the Lease be canceled, the City has the option to cancel the easement. 

The granting of the proposed easement is exempt from environmental review pursuant to Section 15061(b)(3) of the State's guidelines implementing the California Environmental Quality Act. This section, commonly referred to as the "general rule," establishes that CEQA applies only to projects which have the potential of causing a significant effect on the environment. This approval only grants SCE the right to install an electrical meter within City property and will not cause a significant effect on the environment. 
ALTERNATIVES:

City Council may deny the request to grant the easement to Southern California Edison. This would result in the need for a redesign of Southern California Edison facilities necessary to serve the wireless facility.
