BE IT REMEMBERED THAT, notice had been duly filed and posted by the County Clerk on the 28th day of April 2022 at 3:4 P.M. For a Regular meeting of the Commissioners' Court on MONDAY, MAY 2, 2022 at 9:00 A. M. in the San Patricio County Courthouse Commissioners Courtroom # 230 second Floor, Sinton, Texas. At which time the following subjects were discussed, concerned, passed, or adopted. 

The following members were present, to-wit:

   1. CALL TO ORDER, PLEDGES AND PUBLIC INVOLVEMENT
             
   1. Call meeting to order
  Meeting was called to order at 9:00 a.m.
             
   2. Pledge of allegiance
  The Court opened the regular meeting with the Pledges of Allegiance to the flag of the United States and to the flag of the State of Texas.
             
   3. Citizens to be heard
  None today
             
   4. Report from Judge, Commissioner or Department concerning an item/report of community interest.
  Judge Krebs gave the weekly COVID-19 report. He stated that the positivity was going up. It is now at 6.2%. He mentioned that, nationally, the hospitalizations and deaths were down. However, the Truama unit U hospitalizations were still high.
Commissioner Wilkinson reported that her precinct was working on mowing grass on CR 234.
Adrian Rodriguez, Chief Deputy Sheriff's Office, reported that as of this morning there were 236 inmates. Forty (40) are waiting to be transferred to state facilities.

   a. Examination, consideration, and action on approval of all claims against San Patricio County Pursuant to section 113.064, Texas Local Government Code.

   3. Consent Agenda: All Consent Agenda items listed are considered to be routine by the Commissioners Court. Members of the Commissioners Court have been furnished documentation on each item, and all such items may be acted upon by one vote without being discussed separately unless requested by County Judge or a Commissioner:
             
   a. Consideration and action to approve Airport hangar lease at McCampbell-Porter airport between San Patricio County and the following person:
C14- Tim Horton, effective May 9, 2022
             
   b. Consideration and action to approve Assignment of Ground Lease between Jeremy Hintz DBA SkyeFBO (assignor) and Kelly Davis Puerta, DBA Aero Puerto, LLC (assignee), hangar B-8 between San Patricio County effective April 6, 2022.
             
   c. Accept and record Denise Janak's continuing education hours for successful completion of 50th Annual County Treasurers' Continuing Education Seminar (24 hours).

   a. Consideration and action on declaring May 2022 as Children's Mental Health Acceptance Month.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to approve Proclamation declaring May 2022 as Children's Mental Health Acceptance Month

   b. Consideration and action on whether the Commissioners Court should consider request for reclassification and/or proposed pay grade changes that are inconsistent with the Pay Grade, Position Classification, and Implementation Plan approved by the Commissioners Court on April 28, 2022.
             
  Motion made by Commissioner, Precinct 1 Sonia Lopez, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to NOT consider the request for reclassification and/or proposed pay grade changes that are inconsistent with the Pay Grade, Position Classification and Implementation Plan approved by the Commissioners' Court on April 28, 2022.

   c. Consideration and action on the Salary Committee's request to add two (2) additional classifications - Maintenance 
Assistant III (pay grade 107) and Maintenance Assistant Lead (pay grade 108) for Building and Yards Department. If approved, the effective date would be May 1, 2022. 
             
  Motion made by County Judge David R. Krebs, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve the Salary Committee's request to add two (2) additional classifications - Maintenance

   e. Consideration and action on approving the Order of the Special Election to be held on June 14, 2022 to elect United States Representative, District 34.

   f. Consideration and action on contract with R&R Gonzalez Properties, LLC, to provide brush disposal services via the County's use of a burn pit located near Mathis at a flat rate fee of $800/month.

  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to approve the Amendment to the Administrative Service Agreement between San Patricio County and Asserta Health, Inc to include negotiating outstanding balance bills from 2017-2020.

   h. Consideration and action to approve the Change order # 2 for Thomas Airport Maintenance between San Patricio County and Rodcon (J. Schwartz and Associates, Inc). The change will include adding structural repairs to primary steel, in-place column repair and demolition of concrete slab between hangers. The total cost of the change order is $33,795.00 and an additional 175 days. The revised contract including this change order is $231,095.00 and completion date 355 days.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by County Judge David R.    j. Consideration and action on Commissioner's County road mileage, and related matters. 
  Laura Adame, Ron Elroy, Irma Adame and Wolly Bronx all came in and expressed their concerns about issues on or around CR 1432. They expressed that they were looking forward to having a new Commissioner work on their CR and then they felt that they wanted to work with Commissioner Lopez, since she was now the new Commissioner in that area. They felt that they did not want Commissioner Gillespie working on their CR since he was not the Commissioner they were now voting for. They asked the Court to reverse their course of action as a result of the new redistricting. 
             
  Motion made by Commissioner, Precinct 2 Gary W. Moore, Sr.,  to go back to the 2021 road mine chart ( Motion DIED for lack of second)

   4. EXECUTIVE SESSION

PUBLIC NOTICE
is given that the San Patricio Commissioners Court may elect to go into Executive Session anytime during the meeting to discuss matters listed on the Agenda, when authorized by the provisions of the Open Meetings Act, Chapter 551 of the Texas Government Code. In the event the Commissioners Court elects to go into Executive Session regarding an agenda item the section or sections of the Open Meetings Act authorizing the Executive Session will be publicly announced by the presiding officer. In accordance with the authority of the Government Code, Sections 551.071, 551.072, 551.073, 551.074, 551.0745, 551.076, 551.086 the Commissioners Court will hold an Executive Session to consult with attorney(s) including matters related to litigation; deliberate regarding real property; prospective gifts(s); personnel matter, including termination; security devices, and/or economic development negotiations and other matters that may be discussed in an Executive Session. Upon completion of the Executive Session, the Commissioners' Court may in an open session take such action as appropriate on items discussed in Executive Session.
