BE IT REMEMBERED THAT, notice had been duly filed and posted by the County Clerk on the 24thday of February 2022 at 4:04 P.M. For a Regular meeting of the Commissioners' Court on MONDAY, FEBRUARY 28, 2022 at 9:00 A. M. in the San Patricio County Courthouse Commissioners Courtroom # 230 second Floor, Sinton, Texas. At which time the following subjects were discussed, concerned, passed, or adopted. 

The following members were present, to-wit:

The following proceedings were had, to-wit:
             
   1. CALL TO ORDER, PLEDGES AND PUBLIC INVOLVEMENT
             
   1. Call meeting to order
  Meeting was called to order at 9:00 a.m.
             
   2. Pledge of allegiance
  The Court opened the regular meeting with the Pledges of Allegiance to the flag of the United States and to the flag of the State of Texas.
             
   3. Citizens to be heard
  Christie Prine, Sinton Chamber of Commerce Director informed the court that their chamber banquet will be on March 11, 2022
             
   4. Report from Judge, Commissioner or Department concerning an item/report of community interest.
  Judge Krebs gave the weekly COVID-19 report. He stated that cases were going down nationwide and locally. He mentioned that there were 14 fatalities in February in San Patricio County. Influenza numbers are low at this time. 
Commissioner Gillespie reported that he had attended a meeting at the Port of Corpus Christi to talk about the Carbon Capture Project.
Commissioner WIlkinson reported that tomorrow March 1, 2022, the grant project at Rancho Chico would be starting. They will start with the drainage and eventually do the pavement. J. Caroll Weaver will be the one working on this project.
Commissioner Lopez asked John Hernandez for a report on the progress of her new building. John reported that last week they had poured the concrete slab. They are starting to erect the steel for framing and working with AEP for electricity.
Commissioner Moore reported that the Green Lake project was still on schedule and is expected to be completed by the summer.
Judge Krebs reminded everyone that tomorrow was election day, so please go out and vote.

  Motion made by Commissioner, Precinct 2 Gary W. Moore, Sr., seconded by Commissioner, Precinct 1 Sonia Lopez to approve minutes for February 21, 2022 as submitted by County Clerk 

  Vote: 5 - 0 Carried
             
   2. Financial Agenda:
             
   a. Examination, consideration, and action on approval of all claims against San Patricio County Pursuant to section 113.064, Texas Local Government Code.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to approve list of all claims against San Patricio County Pursuant to section 113.064, Texas Local Government Code.

  Vote: 5 - 0 Carried
             
   b. Consideration and action on Budget Line Items, Transfers, and Amendments.
  None today
             
   c. Consideration and action on accepting bank reconciliation, investment reports, and related matters by County Treasurer.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to accept and record all reports submitted by County Treasurer

   3. Consent Agenda: All Consent Agenda items listed are considered to be routine by the Commissioners Court. Members of the Commissioners Court have been furnished documentation on each item, and all such items may be acted upon by one vote without being discussed separately unless requested by County Judge or a Commissioner:
             
   a. Consideration and action on Environmental Health Department request to transfer 2013 Ford F150 Truck, white, VIN#1FTEX1CM5DFB76924, License #114-1630 from Animal Control Department (010-742) to Environmental Health Department (010-737).
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve the Environmental Health Department request to transfer the 2013 Ford F150 Truck, white, VIN#1FTEX1CM5DFB76924, License #114-1630 from the Animal Control Department (010-742) to the Environmental Health Department (010-737).

  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to approve Order Continuing Declaration of Local State of Disaster for San Patricio County due to Novel Coronavirus (COVID-19). Effective 12:01 AM February 28, 2022 and continuing for 30 days with consent of Commissioners Court.


  Vote: 5 - 0 Carried
             
   b. Consideration and action on Order Continuing Declaration of Local State of Disaster Due to Unlawful Texas-Mexico Border Crossings by Illegal Aliens. Effective 12:01 AM February 28, 2022, and continuing for 30 days with consent fo Commissioners Court. 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to approve Order Continuing Declaration of Local State of Disaster Due to Unlawful Texas-Mexico Border Crossings by Illegal Aliens. Effective 12:01 AM February 28, 2022, and continuing for 30 days with the consent of the Commissioners Court. 


  Vote: 5 - 0 Carried
             
   c. Consideration and action on ordering Special Election for adopting or rejecting two (2) Constitutional Amendments for the State of Texas to be held on Saturday, May 7, 2022.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to approve the order of Special Election for adopting or rejecting two (2) Constitutional Amendments for the State of Texas to be held on Saturday, May 7, 2022.


  Vote: 5 - 0 Carried
             
   d. Consideration and action on Constable-Precinct 1, Joe Gaitan's request that the County participate in the Senior Community Service Employment Program (SCSEP) which is community service and work-based job training program for older Americans authorized under the Older Americans Act. SCSEP will pay the highest of federal, state or local minimum wage to the senior citizen while they receive training from the County.
  Joe Gaitan, Constable Precinct 1, introduced  Lavern Suarez, Project Director Senior Community Service Employment Program, who gave the court a brief overview of the program. It is a work-based training program for older Americans that is Authorized under the Older American Act. This program will pay the participants and they will receive training from the County.  

 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to TABLE the following: Langford's request to amend the Financial Policy related to the San Patricio County Channel Outfall Drainage Improvement Project. Tabled from February 14, 2022 Commissioners Court.

  Motion made by Commissioner, Precinct 1 Sonia Lopez, seconded by Commissioner, Precinct 4 Howard J. Gillespie to approve request from Right-of-Way Engineer to Advertise for Bids for Taft Southwest GLO CDBG-DR Drainage and Taft Southwest Road Bond 19-4 projects.

   h. Consideration and action on professional services agreement with Ardurra Group, Inc. for design for new records warehouse addition and re-roofing Juvenile Center in the amount of $117,500.00.
             
  Motion made by Commissioner, Precinct 3 Lilly Wilkinson, seconded by Commissioner, Precinct 4 Howard J. Gillespie to approve professional services agreement with Ardurra Group, Inc. for design for new records warehouse addition and re-roofing Juvenile Center in the amount of $117,500.00.

   3. PERSONNEL-Employment and current employee status changes in accordance with the current personnel policies, County Budget, and State law with notification of such changes to the payroll division of the Treasurer's office.
             
   1. Deliberate and consider action employee salary:
             
   a. Ryder Putnam - Withdraw - Juvenile Supervision Officer/Juvenile Detention full time regular at $2,500.00 per month with a $50.00 per month phone allowance effective February 16, 2022.
             
   b. Hector Baez - Termination - Juvenile Supervision Officer/Juvenile Detention full time regular at $2,500.00 per month with a $50.00 per month phone allowance effective February 21, 2022.
             
   c. Elisa Esparza - Resignation - Medical Assistant/Clerk/Health-Immunizations part time regular at $12.97 per hour effective March 4, 2022.
             
   d. Consuelo Benavides-Martinez - Resignation - Community Health Worker/Health-Community Based Programs full time regular at $2,426.66 per month effective February 28, 2022.
             
   e. Allison Dominguez - Transfer - Deputy Clerk/District Clerk full time regular at $2,166.67 per month ($12.50 hr.) to Executive Secretary/District Attorney full time regular base salary $2,500.00 per month ($14.43 hr.). Request by Elected Official is $2,833.34 per month ($16.35 hr.) effective March 1, 2022.
             
   f. Joshua Jimenez - Employment - IT Support Specialist/Information Services full time regular at base salary $3,166.67 per month ($18.27 hr.) with a $50.00 per month phone allowance effective March 1, 2022.
             
   g. James Gardner - Salary/Position - Assistant County Attorney/County Attorney full time regular at $7,818.83 per month ($45.11 hr.) to 1st Assistant County Attorney full time regular. Request by Elected Official is $7,909.82 per month ($45.63 hr.) with a $50.00 per month phone allowance effective March 1, 2022.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to approve Personnel Items 3.1 (a) through 3.1 (g)

   2. Accept and record employee status changes:

   4. EXECUTIVE SESSION

PUBLIC NOTICE
is given that the San Patricio Commissioners Court may elect to go into Executive Session anytime during the meeting to discuss matters listed on the Agenda, when authorized by the provisions of the Open Meetings Act, Chapter 551 of the Texas Government Code. In the event the Commissioners Court elects to go into Executive Session regarding an agenda item the section or sections of the Open Meetings Act authorizing the Executive Session will be publicly announced by the presiding officer. In accordance with the authority of the Government Code, Sections 551.071, 551.072, 551.073, 551.074, 551.0745, 551.076, 551.086 the Commissioners Court will hold an Executive Session to consult with attorney(s) including matters related to litigation; deliberate regarding real property; prospective gifts(s); personnel matter, including termination; security devices, and/or economic development negotiations and other matters that may be discussed in an Executive Session. Upon completion of the Executive Session, the Commissioners' Court may in an open session take such action as appropriate on items discussed in Executive Session.
  At 9:40 a.m. Judge Krebs recessed the regular meeting to go into the executive session.
At 9:43 a.m., the court with its attorney went into executive session.
At 9:50 a.m. Judge Krebs closed the executive session.
At 9:52 a.m. Judge Krebs reconvened the regular session. 
             
   1. Pursuant to Section 551.072, Deliberation Regarding Real Property, Texas Gov't Code, the Court will conduct a closed session to discuss or deliberate whether to pursue negotiations related to one or more real property transactions, and related matters.

  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to adjourn the meeting with no further business before the court. The meeting was adjourned at 9:54 a.m.
