BE IT REMEMBERED THAT, notice had been duly filed and posted by the County Clerk on the 17th day of February 2022 at 3:56 P.M. For a Regular meeting of the Commissioners' Court on MONDAY, FEBRUARY 21, 2022 at 9:00 A. M. in the San Patricio County Courthouse Commissioners Courtroom # 230 second Floor, Sinton, Texas. At which time the following subjects were discussed, concerned, passed, or adopted. 

The following members were present, to-wit:

The following proceedings were had, to-wit:
             
   1. CALL TO ORDER, PLEDGES AND PUBLIC INVOLVEMENT
             
   1. Call meeting to order
  Meeting called at 9:00 a.m. 
             
   2. Pledge of allegiance
  The Court opened the regular meeting with the Pledges of Allegiance to the flag of the United States and to the flag of the State of Texas.
             
   3. Citizens to be heard
  None today
             
   4. Report from Judge, Commissioner or Department concerning an item/report of community interest.
  Judge Krebs gave the weekly COVID-19 report. He stated that cases and hospitalizations were down all around. He did mention that, sadly, we have had seven (7) fatalities in February so far. 
Commissioner Lopez expressed that she was unhappy with the service provided by AGCM, the project managers working on her new precinct yard. 
Judge Krebs mentioned that he had received a check from Farm Bureau for the tire recycling project.

  Motion made by Commissioner, Precinct 1 Sonia Lopez, seconded by Commissioner, Precinct 4 Howard J. Gillespie to approve minutes for February 14, 2022 as submitted by County Clerk

   2. Financial Agenda:
             
   a. Examination, consideration, and action on approval of all claims against San Patricio County Pursuant to section 113.064, Texas Local Government Code.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve list of all claims against San Patricio County Pursuant to section 113.064, Texas Local Government Code.

   b. Consideration and action on Budget Line Items, Transfers, and Amendments.

   c. Consideration and action on accepting bank reconciliation, investment reports, and related matters by County Treasurer.

   a. Consideration and action on adopting a resolution authorizing a tax resale in the following:

   c. Consideration and action on request by Judge Krebs to create a full time regular Emergency Management Specialist position. If created, there will be no change to Emergency Management Department's Budget.  
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by County Judge David R. Krebs to approve a request by Judge Krebs to create a full-time regular Emergency Management Specialist position. If created, there will be no change to the Emergency Management Department's budget.

   d. Presentation, consideration and possible action on Fire Marshal's recommendation regarding whether to authorize an Outdoor Burn Ban in San Patricio County for 90 Days.
             
  Motion made by Commissioner, Precinct 2 Gary W. Moore, Sr., seconded by Commissioner, Precinct 4 Howard J. Gillespie to approve the Fire Marshal's recommendation regarding whether to authorize an Outdoor Burn Ban in San Patricio County for 90 Days.


  Vote: 5 - 0 Carried
             
   e. Consideration and action on request by Judge Krebs to create a full time regular Secretary position in the Veteran's Service Department. If created, salary for the position will be paid out of the Contingency Fund.  
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to approve a request by Judge Krebs to create a full-time regular secretary position in the Veteran's Service Department. If created, the salary for the position will be paid out of the Contingency Fund.

   f. Consideration and action on request to refund $975.00 to Sky Park Aviation due to unavailability of their lease hangar space at the Alfred C. "Bubba" Thomas Airport during the months of October to December 2021. 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to approve a request to refund $975.00 to Sky Park Aviation due to unavailability of their lease hangar space at the Alfred C. "Bubba" Thomas Airport during the months of October to December 2021.

   g. Consideration and action on Ardurra change order request for the Plymouth Annex. Change order is for an additional $2,090.00 in order to fabricate, install, and paint doors, trimming, etc.

  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to approve entering into a contract with Kofile for Archival Imaging & QuickLinkl Indexing of Deed of Trust Records for the San Patricio County Clerk's Office. For a cost of $427,244.89 to be paid from the Records Management and Records Archive/Preservation Budgets.

   i. Consideration and action on Amendment to the Administrative Services Agreement between San Patricio County and Asserta Health, Inc.  to do the maintenance of direct provider contracts, effective February 1, 2022.  (Proposal was approved on January 24, 2022, agenda)

Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to approve  Amendment to the Administrative Services Agreement between San Patricio County and Asserta Health, Inc.  to do the maintenance of direct provider contracts, effective February 1, 2022.  (Proposal was approved on January 24, 2022, agenda)

   j. Consideration and action on purchasing a laptop computer for Bailiff David Tyler for a cost of $1,636.62 to be paid out of Courthouse Security.

   k. Consideration and action to enter into a Professional Services Agreement with Maldonado-Burkett, LLP for engineering services to generate plans, specifications and estimate package to be submitted to TxDOT for the Highway Safety Improvement Program (HSIP).  Specifically, Maldonado-Burkett will prepare plans consisting of roadway signing, pavement markings, and roadway flashers for Safety Improvements at the intersections of CR 2249 at CR 798, CR 2349 at CR 798, and CR 1876 at CR 2095. The professional services agreement will be for $19,402.06 and Fund 25 will be utilized for these services
             
  Motion made by Commissioner, Precinct 4 Howard J.   Motion made by Commissioner, Precinct 3 Lilly Wilkinson, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve contract change order #2 in the amount of $29,303.47 for a heavy-duty concrete driveway with drainage improvements on County Road 2269.  This contract change order will be included as part of the County's Road Bond 19-2 program.

   3. PERSONNEL-Employment and current employee status changes in accordance with the current personnel policies, County Budget, and State law with notification of such changes to the payroll division of the Treasurer's office.

   a. Charlie Campbell - Retirement - Heavy Equipment Operator/Road and Bridge #4 full time regular at $3,550.65 per month effective February 28, 2022.
             
   b. Jesus Santos - Retirement - Assistant County Attorney/County Attorney full time regular at $7,909.82 per month effective February 28, 2022.
             
   c. Geneva Gil - Withdraw - Juvenile Supervision Officer/Juvenile Detention full time temporary at $14.42 per hour with a $50.00 per month phone allowance effective February 16, 2022.
             
   d. Joseph Denton - Name Correction - Crewman/Road and Bridge #1 full time regular at base salary $1,906.67 per month ($11.00 hr.) effective February 16, 2022.
             
   e. Susan Boutwell - Title Change - Permit Specialist $3,354.98 month ($19.36 hr) to Permit Specialist/Flood Plain Manager $3,354.98 month (19.36 hr) continue $50.00 per month phone allowance, effective March 1, 2022.
             
   f. Patrick McGinn - Title Change - Flood Plain Manager $3,955.79 per month ($22.28 hr) to Emergency Management Specialist $3,955.79 per month ($22.82 hr) continue $50.00 per month phone allowance, effective March 1, 2022.

   4. EXECUTIVE SESSION

PUBLIC NOTICE
is given that the San Patricio Commissioners Court may elect to go into Executive Session anytime during the meeting to discuss matters listed on the Agenda, when authorized by the provisions of the Open Meetings Act, Chapter 551 of the Texas Government Code. In the event the Commissioners Court elects to go into Executive Session regarding an agenda item the section or sections of the Open Meetings Act authorizing the Executive Session will be publicly announced by the presiding officer. In accordance with the authority of the Government Code, Sections 551.071, 551.072, 551.073, 551.074, 551.0745, 551.076, 551.086 the Commissioners Court will hold an Executive Session to consult with attorney(s) including matters related to litigation; deliberate regarding real property; prospective gifts(s); personnel matter, including termination; security devices, and/or economic development negotiations and other matters that may be discussed in an Executive Session. Upon completion of the Executive Session, the Commissioners' Court may in an open session take such action as appropriate on items discussed in Executive Session.
  At 9:48 a.m. Judge Krebs recessed the regular session to go into executive session.
At 9:52 a.m. the court with its attorney went into executive session.
At 10:09 a.m. Judge Krebs closed the executive session.
At 10:10 a.m. Judge Krebs reconvened the regular session.
