BE IT REMEMBERED THAT, notice had been duly filed and posted by the County Clerk on the 3rd day of February 2022 at 1:55 P.M. For a Regular meeting of the Commissioners' Court on MONDAY, FEBRUARY 8, 2022 at 9:00 A. M. in the San Patricio County Courthouse Commissioners Courtroom # 230 second Floor, Sinton, Texas. At which time the following subjects were discussed, concerned, passed, or adopted. 

The following members were present, to-wit:
Present: David R. Krebs, County Judge  
  Sonia Lopez, Commissioner, Precinct 1  
  Gary W. Moore, Sr., Commissioner, Precinct 2  
  Lilly Wilkinson, Commissioner, Precinct 3  
  Howard J. Gillespie, Commissioner, Precinct 4  
Staff Present: Gracie Alaniz-Gonzales, County Clerk
Homer Roblez, County Auditor Chief Assistant
The following proceedings were had, to-wit:
             
   1. CALL TO ORDER, PLEDGES AND PUBLIC INVOLVEMENT
             
   1. Call meeting to order
  Meeting was called to order at 9:00 a.m. 
             
   2. Pledge of allegiance
  The Court opened the regular meeting with the Pledges of Allegiance to the flag of the United States and to the flag of the State of Texas.
             
   3. Citizens to be heard
  None today
             
   4. Report from Judge, Commissioner or Department concerning an item/report of community interest.
  Dr. James Mobley, SPC Health Authority, gave his weekly Covid-19 report. He stated that cases in the US, Texas and the County were going down. There are still lots of cases in the County but, slightly. He stated that most are experiencing very mild symptoms. The fatality rate is  peaking. There was one (1) fatality in the County on February 1. 
Pam Hill, Elections Administrator, reminded everyone that early voting starts next Monday, February 14. She mentioned that due to new legislation, more hours and Sunday voting are now required during early voting. They will offer Monday-Sunday. Saturday hours will be 7 a.m.-7 p.m. Sunday hours will be 10:00 a.m. - 6:00 p.m.  The last day of early voting will be February 25. Also, on Monday February 21 there will be no early voting since it is a Federal Holiday (President's Day).
             
   2. DELIBERATE AND CONSIDER ACTION ON THE FOLLOWING ITEMS:
             
   1. Approval of minutes
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to approve minutes for January 31, 2022 as submitted by County Clerk 

  Vote: 5 - 0 Carried
             
   2. Financial Agenda:
             
   a. Examination, consideration, and action on approval of all claims against San Patricio County Pursuant to section 113.064, Texas Local Government Code.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve list of all claims against San Patricio County Pursuant to section 113.064, Texas Local Government Code.

  Vote: 5 - 0 Carried
             
   b. Consideration and action on Budget Line Items, Transfers, and Amendments.
  None today
             
   c. Consideration and action on accepting bank reconciliation, investment reports, and related matters by County Treasurer.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to accept all reports submitted by County Treasurer




  Vote: 5 - 0 Carried
             
   3. Consent Agenda: All Consent Agenda items listed are considered to be routine by the Commissioners Court. Members of the Commissioners Court have been furnished documentation on each item, and all such items may be acted upon by one vote without being discussed separately unless requested by County Judge or a Commissioner:
             
   a. Accept and record previously approved professional services agreement between the County and engineering firm AG3 for the purpose of performing infrastructure GIS database setup for $25,000. 
             
   b. Accept and record Family Counseling Services report on Utilization of the Family Protection Fees provided by San Patricio County. 
             
   c. Accept and record Deputation of Allison Dominguez, District Clerk's office
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to approve Consent Agenda Items 2.3 (a) through 2.3 (c) 


  Vote: 5 - 0 Carried
             
   4. Individual Action Agenda:
             
   a. Consideration and action on Election Office's purchase of Vista software and licensing for the purpose of processing election applications. The agreement is a 3-year term for total sum of $9,493.75 to be paid from HAVA Security Grant funds. 
             
  Motion made by Commissioner, Precinct 1 Sonia Lopez, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve Election Office's purchase of Vista software and licensing for the purpose of processing election applications. The agreement is a 3-year term for total sum of $9,493.75 to be paid from HAVA Security Grant funds. 


  Vote: 5 - 0 Carried
             
   b. Consideration and action on requested from Election Administrator Pamela Hill to set pay rate for Election Judges at $12.00/hour and continue Election Clerks pay rate at $11.00/hour for County Vote Centers.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve a request from Election Administrator Pamela Hill to set the pay rate for Election Judges at $12.00/hour and continue Election Clerks pay rate at $11.00/hour for County Vote Centers.


  Vote: 5 - 0 Carried
             
   c. Consideration and action on a 3-year contract with Fifth Asset, Inc., d/b/a DebtBook to provide consolidated debt and lease software for the auditor's department at an annual cost of $7,500.00 plus a one time implementation cost of $2,250.00. 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W.    d. Consideration and action on Juvenile Probation's request to enter into contract for Juvenile Detention Services between Gillespie County and San Patricio County. 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to approve Juvenile Probation's request to enter into contract for Juvenile Detention Services between Gillespie County and San Patricio County.


  Vote: 5 - 0 Carried
             
   e. Consideration and action on corrected contract between San Patricio County and Mathis Library for January 1st through December 31st, 2022.  The contract amount should have been $2,500.00 as was approved for in the FY 2022 budget.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to approve corrected contract between San Patricio County and Mathis Library for January 1st through December 31st, 2022.  The contract amount should have been $2,500.00 as was approved for in the FY 2022 budget.


  Vote: 5 - 0 Carried
             
   f. Consideration and action on recommendation from I.S. Department Director, Steven Gonzalez, to amend the County's agreement with Tyler Technologies for Courts and Justice Solutions services wherein the amendment would change the due date of County's payment to align with the actual delivery of the services.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve recommendation from I.S. Department Director, Steven Gonzalez, to amend the County's agreement with Tyler Technologies for Courts and Justice Solutions services wherein the amendment would change the due date of County's payment to align with the actual delivery of the services.


  Vote: 5 - 0 Carried
             
   g. Consideration and action on Commissioner Lopez's request to approve two Change Orders related to the construction of her new precinct office and are for (1) increasing the concrete strength of the foundation from 3000psi to 4000psi ($1,026.00) and for (2) interior electrical items ($901.74) and authorize the Auditor's Office to issue payment today less the appropriate retainage. 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 4 Howard J. Gillespie to approve Commissioner Lopez's request to approve two Change Orders related to the construction of her new precinct office and are for (1) increasing the concrete strength of the foundation from 3000psi to 4000psi ($1,026.00) and for (2) interior electrical items ($901.74) and authorize the Auditor's Office to issue payment when work is completed less the appropriate retainage.

   h. Consideration and action on an Environmental Survey Professional Services Agreement for the proposed Courthouse Annex property.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to award the Environmental Survey Professional Services Agreement to HALFF for the proposed Courthouse Annex property.



  Vote: 5 - 0 Carried
             
   3. PERSONNEL-Employment and current employee status changes in accordance with the current personnel policies, County Budget, and State law with notification of such changes to the payroll division of the Treasurer's office.

   4. EXECUTIVE SESSION

PUBLIC NOTICE
is given that the San Patricio Commissioners Court may elect to go into Executive Session anytime during the meeting to discuss matters listed on the Agenda, when authorized by the provisions of the Open Meetings Act, Chapter 551 of the Texas Government Code. In the event the Commissioners Court elects to go into Executive Session regarding an agenda item the section or sections of the Open Meetings Act authorizing the Executive Session will be publicly announced by the presiding officer. In accordance with the authority of the Government Code, Sections 551.071, 551.072, 551.073, 551.074, 551.0745, 551.076, 551.086 the Commissioners Court will hold an Executive Session to consult with attorney(s) including matters related to litigation; deliberate regarding real property; prospective gifts(s); personnel matter, including termination; security devices, and/or economic development negotiations and other matters that may be discussed in an Executive Session. Upon completion of the Executive Session, the Commissioners' Court may in an open session take such action as appropriate on items discussed in Executive Session.
  At 9:22 a.m. Judge Krebs recessed the regular session to go into executive session.
At 9:24 a.m. The Court with its attorney went into executive session.
 
             
   1. Pursuant to Section 551.072 (Deliberation Regarding Real Property), Texas Gov't Code, the Court will conduct a closed session to discuss or deliberate whether to pursue negotiations to purchase real property.
             
   2. Consideration and possible action on closed session deliberation whether to pursue negotiations to purchase real property pursuant to Section 551.072, Deliberation Regarding Real Property, Texas Gov't Code. 
  At 10:03 a.m. Judge Krebs closed the executive session to reconvene into regular session.
At 10:04 a.m. the Court reconvened into regular session
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to direct staff to pursue the purchase of property discussed in executive session.

  Vote: 5 - 0 Carried
             
   5. ADJOURN
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to adjourn meeting with no further business before the court. The meeting was adjourned at 10:05 a.m.
