BE IT REMEMBERED THAT, notice had been duly filed and posted by the County Clerk on the 23rd day of December 2021 at 9:20 A.M. For a Regular meeting of the Commissioners' Court on TUESDAY, DECEMBER 28, 2021 at 9:00 A. M. in the San Patricio County Courthouse Commissioners Courtroom # 230 second Floor, Sinton, Texas. At which time the following subjects were discussed, concerned, passed, or adopted. 

The following members were present, to-wit:

The following proceedings were had, to-wit:
             
   1. CALL TO ORDER, PLEDGES AND PUBLIC INVOLVEMENT
  Judge Krebs asked for a moment of silence for 2 former employees that passed away over the weekend. David Martinez and Dennis Cluiss. He also asked for prayers for Commissioner Moore who was rushed unresponsive to the hospital this morning. 
             
   1. Call meeting to order
  Meeting called to order at 9:00 a.m. 
             
   2. Pledge of allegiance
  The Court opened the regular meeting with the Pledges of Allegiance to the flag of the United States and to the flag of the State of Texas.
             
   3. Citizens to be heard
  None today
             
   4. Report from Judge, Commissioner or Department concerning an item/report of community interest.
  Dr. James Mobley, SPC Health Authority gave his weekly COVID-19 report. He stated that cases are rising both in the US and Texas. Fatalities and hospitalizations are declining at the moment. He stated that although there were more cases they are not more severe than the past. SPC had 5 new cases last week, but he expects the number to rise since the reporting agency have been closed for the holiday. There was 1 new fatality on November 30 and 1 legacy death reported.  He stated that the isolation period has now changed to 5 days quarantine and 6 days wearing mask. He stated that a person is most contagious 2 days before and 3 days after testing positive.

  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to approve list of all claims against San Patricio County Pursuant to section 113.064, Texas Local Government Code.

   3. Consent Agenda: All Consent Agenda items listed are considered to be routine by the Commissioners Court. Members of the Commissioners Court have been furnished documentation on each item, and all such items may be acted upon by one vote without being discussed separately unless requested by County Judge or a Commissioner:
             
   a. Accept and record Leticia Chapa's Deputation (District Clerk's Office).
             
   b. Accept and record 2022 salary supplements from Pretrial Diversion Fund for the San Patricio County Attorney's staff.  
             
   c. Consideration and Action to approve Airport Hangar leases at McCampbell-Porter Airport between San Patricio County and
Hangar C6-James Beck (for December 2021)

   d. Accept and record Commissioner Gillespie's Statutory Continuing Education of twenty-two hours earned:

   4. Individual Action Agenda:
             
   a. Beginning at 9:30 a.m. Centivo's Senior Vice President of Operations, Paul Wann, will review employee healthcare plan decisions along with the decision dates that the Commissioners Court must make due to the new regulations beginning January 1, 2022.

Following this review the Commissioners Court will consider and possibly act on one or more of the following decisions:
1. Authorize Non-quantitative Treatment Limitations (NQTL) analyses by The Phia Group through Centivo at an estimated expense of $6,000.
2. Network decisions to include Commissioners Court's direction relating to Directories, Qualified Payment Amount for No Surprises Act claims, and determining the Percentage of Medicare that the Plan will pay, and related matters.
  Centivo's Senior Vice President of Operations, Paul Wann reviewed some new health care decisions that the County was needing to make to be incompliant with the new regulations taking effect January 1, 2022. 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson 1. Authorize Non-quantitative Treatment Limitations (NQTL) analyses by The Phia Group through Centivo at an estimated expense of $6,000.

Consideration and action on request from Judge Leslie DeAses, Justice of the Peace, Precinct #1 to amend Part time temporary clerk position from 20 hours weekly to Full time temporary at 40 hours weekly, to be paid from the vacant Chief Deputy Clerk position salary in 2022 budget, effective January 1, 2022-December 31, 2022.

Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to approve request from Judge Leslie DeAses, Justice of the Peace, Precinct #1 to amend Part time temporary clerk position from 20 hours weekly to Full time temporary at 40 hours weekly, to be paid from the vacant Chief Deputy Clerk position salary in 2022 budget, effective January 1, 2022-December 31, 2022.

If above approved, consideration and action on request from JP #6 FY 2022 Budget be amended to reflect the increase.  (Judge Price asks that funds be paid for out of contingency)

   4. EXECUTIVE SESSION

PUBLIC NOTICE
is given that the San Patricio Commissioners Court may elect to go into Executive Session anytime during the meeting to discuss matters listed on the Agenda, when authorized by the provisions of the Open Meetings Act, Chapter 551 of the Texas Government Code. In the event the Commissioners Court elects to go into Executive Session regarding an agenda item the section or sections of the Open Meetings Act authorizing the Executive Session will be publicly announced by the presiding officer. In accordance with the authority of the Government Code, Sections 551.071, 551.072, 551.073, 551.074, 551.0745, 551.076, 551.086 the Commissioners Court will hold an Executive Session to consult with attorney(s) including matters related to litigation; deliberate regarding real property; prospective gifts(s); personnel matter, including termination; security devices, and/or economic development negotiations and other matters that may be discussed in an Executive Session. Upon completion of the Executive Session, the Commissioners' Court may in an open session take such action as appropriate on items discussed in Executive Session.
  At 10:20 a.m. Judge Krebs recessed the regular meeting to go into executive session
At 10:22 a.m. the Court with its attorney went into executive session
At 10:34 a.m. Judge Krebs closed the executive session
At 10:35 a.m. Judge Krebs reconvened the regular session
             
   1. Pursuant to Section 551.074, Personnel Matters, Texas Gov't Code, the Court will conduct a closed session to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of an employee; or to hear a complaint or charge against an employee, and related matters.
 
  No Action was taken.

 
             
   5. ADJOURN
  Judge Krebs reported that he received a text from Mr. Moore's wife Beverly. She reported that Commissioner Moore was now responsive and doing a bit better.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to adjourn meeting with no further business before the Court. Meeting was adjourned at 10:44 a.m.
