BE IT REMEMBERED THAT, notice had been duly filed and posted by the County Clerk on the 15th day of December 2021 at 3:47 P.M. For a Regular meeting of the Commissioners' Court on MONDAY, DECEMBER 16, 2021 at 9:00 A. M. in the San Patricio County Courthouse Commissioners Courtroom # 230 second Floor, Sinton, Texas. At which time the following subjects were discussed, concerned, passed, or adopted. 

The following members were present, to-wit:

  Lilly Wilkinson, Commissioner, Precinct 3  
  Howard J. Gillespie, Commissioner, Precinct 4

David Wendel, County Auditor
The following proceedings were had, to-wit:

             
   1. CALL TO ORDER, PLEDGES AND PUBLIC INVOLVEMENT
             
   1. Call meeting to order
  Meeting was called to order at 9:00 a.m. 
             
   2. Pledge of allegiance
  The Court opened the regular meeting with the Pledges of Allegiance to the flag of the United States and to the flag of the State of Texas.
             
   3. Citizens to be heard
  Rosie Collin with the Port of Corpus Christi presented the Court a Christmas gift
             
   4. Report from Judge, Commissioner or Department concerning an item/report of community interest.
  Judge Krebs gave the weekly COVID-19 report for Dr. Mobley. He mentioned that the number of cases has been on the rise in Texas. The cases in the county are low. The positivity rate however has increased on December 15 it was 9.9% and on December 19 it was 11.4%. He mentioned that the number of children immunized was low. In SPC there were 13 confirmed cases. The last fatality was reported on November 22. He also reported on influenza. He mentioned it looked like the 2021-2022 would be a pretty moderate flu season. 
Commissioner Wilkinson reported that her crew was working on CR 1327 and CR 452. She reported that they had cleared and widened the ditch by the old BFI that should help with the flooding issues in that area. 
Heather Marks District Clerk recognized one of the winners of her first Christmas tree coloring event. Present today was Logan DelaCruz won in the Most Creative Material entry. She mentioned that there were more than 500 entries. 
Meliza Garcia Wic Director thanked the Court for their approval of the increased amount for the improvements of the Ingleside WIC Office. She thanked the contractors KSI Specialties for the work they did. 
Pam Hill, SPC EA thanked everyone who took part in the Angel tree. She stated that it was a big success. 
Sara Luna added that they had a total of 74 names on the Angel tree.
Judge Krebs mentioned and reminded everyone that the next Commissioners' Court meeting would be December 28, 2021. The Courthouse is closed on Monday December 27. He also mentioned that most offices will be closing December 23, 2021 at noon. 
Virginia Longoria, Community Base informed the Court that there was going to be new curriculum on Cooking Matters. She will be bringing contacts to the Court for this at a later date. 
Adrian Rodriguez, Chief Deputy Sheriff's Office gave the Court the jail inmate numbers. He stated that as of this morning there were 225 inmates and 55 of those are waiting to be transported to State jail or SAPF (Substance Abuse Punishment Facility)
Norma Jean Rivera informed the Court that all the unwrapped gifts that were donated at the County Christmas party will be going to CASA
Bill Telford, First Assistant Auditor thanked the Committee that help in the selection process on the auditing firm. 

 
             
   2. DELIBERATE AND CONSIDER ACTION ON THE FOLLOWING ITEMS:
             
   1. Approval of minutes
             
  Motion made by Commissioner, Precinct 2 Gary W. Moore, Sr., seconded by Commissioner, Precinct 1 Sonia Lopez to approve minutes for December 13, 2021 as submitted by County Clerk 

  Vote: 5 - 0 Carried
             
   2. Financial Agenda:
             
   a. Examination, consideration, and action on approval of all claims against San Patricio County Pursuant to section 113.064, Texas Local Government Code.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve list of all claims against San Patricio County Pursuant to section 113.064, Texas Local Government Code.


  Vote: 5 - 0 Carried
             
   b. Consideration and action on Budget Line Items, Transfers, and Amendments.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve budget line item transfers as submitted

  Vote: 5 - 0 Carried
             
   c. Consideration and action on accepting bank reconciliation, investment reports, and related matters by County Treasurer.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to accept and record all reports as submitted by County Treasurer




  Vote: 5 - 0 Carried
             
   3. Consent Agenda: All Consent Agenda items listed are considered to be routine by the Commissioners Court. Members of the Commissioners Court have been furnished documentation on each item, and all such items may be acted upon by one vote without being discussed separately unless requested by County Judge or a Commissioner:
             
   a. Accept and Record Tax Assessor-Collector M. Thormaehlen's continuing education hours (12) on Public Funds Investment Act.
             
   b. Accept and record County Clerk's Monthly Activity Report for month ending November, 2021.
             
   c. Consideration and action on Hangar Assignment from Marvin Dorris, Jr. to C & C Futures LLC Thad Carothers at McCampbell-Porter Airport.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to approve Consent Agenda Items 2.3 (a) through 2.3 (c)



  Vote: 5 - 0 Carried
             
   4. Individual Action Agenda:
             
   a. Discussion and presentation by Paul Wann, Senior Vice President of TPA Operations (Centivo), relating to new health plan regulations beginning January 1, 2022.
  Paul Wann, Senior Vice President of TPA Operations (Centivo), gave the Court a video conference presentation on some of the new health plan regulations beginning January 1, 2022. The Court will schedule a workshop next week to further discuss this matter. 
             
   b. Discuss and take possible action on a resolution authorizing publication and posting of notice of intention to issue certificates of obligation to finance various public improvements. 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to approve Resolution authorizing publication and posting of notice of intention to issue certificates of obligation to finance various public improvements. 


  Vote: 5 - 0 Carried
             
   c. Consideration and action on Professional Service agreement with Tyler Technologies for configuration and consulting services due to SB41 legislative changes, at no charge to the County. 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to approve  Professional Service agreement with Tyler Technologies for configuration and consulting services due to SB41 legislative changes, at no charge to the County


  Vote: 5 - 0 Carried
             
   d. Consideration and action on San Patricio County Elections Officer entering into two (2) Joint Primary Election Services Contracts with the Republican Party and other with Democratic Party for the purpose of providing election services.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to approve San Patricio County Elections Officer entering into two (2) Joint Primary Election Services Contracts with the Republican Party and other with Democratic Party for the purpose of providing election services.

   e. Consideration and action on awarding bid IFB 2021 013 for (3) trucks to be used by Road and Bridge Precinct #2. 
             
  Motion made by Commissioner, Precinct 2 Gary W. Moore, Sr., seconded by Commissioner, Precinct 4 Howard J. Gillespie to award bid IFB 2021 013 for (3) trucks to Taggart Motors to be used by Road and Bridge Precinct #2. 
 


  Vote: 5 - 0 Carried
             
   f. Consideration and action on Order Adopting Redistricting Plan for Election Precincts that adopts the maps and data depicted in the Proposed Election Precincts Plan 1 and possible action on Supplemental Order and Final Adoption of Revised Political Boundaries. 
 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to approve Order Adopting Redistricting Plan for Election Precincts that adopts the maps and data depicted in the Proposed Election Precincts Plan 1 and possible action on Supplemental Order and Final Adoption of Revised Political Boundaries.

   g. Consideration and action to authorize the Auditor's office to solicit RFQ for Insurance Consultant. 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to authorize the Auditor's office to solicit RFQ for Insurance Consultant. 


  Vote: 5 - 0 Carried
             
   h. Consideration and action on Road Bond 19-2 Construction Project Change Order No. 1 in the amount of $46,700.00 for drainage improvements at the intersection of CR 2289 and CR 1870.  Existing unit bid contract pricing was used for this additional work (Overrun of existing contract bid items). Also add 100 days for contract time extension due to on-going harvesting and utility conflicts.  
             
  Motion made by Commissioner, Precinct 2 Gary W. Moore, Sr., seconded by Commissioner, Precinct 4 Howard J.    i. Consideration and action on renewing the 2022 HALO-FLIGHT membership for San Patricio County employees to be paid for out of the health insurance fund.
             
  Motion made by Commissioner, Precinct 1 Sonia Lopez, seconded by Commissioner, Precinct 4 Howard J. Gillespie to approve renewing the 2022 HALO-FLIGHT membership for San Patricio County employees to be paid for out of the health insurance fund.


  Vote: 5 - 0 Carried
             
   j. Consideration and action to set the square foot rates for the following hangars at both Airports of San Patricio County are as follows:
McCampbell-Porter Airport:
County Hangar 14 
FBO
Alfred C. "Bubba Thomas" Airport
Maintenance hangar
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson  set the square foot rates for the following hangar McCampbell-Porter Airport--FBO $.065 per square foot

  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to set the square foot rates for the following hangar McCampbell-Porter Airport County Hangar 14 at $.055 per square foot

  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to set the rate for the following hangar Alfred C. "Bubba Thomas" Airport-- Maintenance hangar at $650.00 per month until renovations are completed starting January 1, 2022 and ending March 31, 2022



  Vote: 5 - 0 Carried
             
   3. PERSONNEL-Employment and current employee status changes in accordance with the current personnel policies, County Budget, and State law with notification of such changes to the payroll division of the Treasurer's office.
             
   1. Deliberate and consider action employee salary:
             
   a. Maria Delfino - Retirement - Senior Clerk/Justice of the Peace #4 full time regular at $2,782.45 per month effective December 31, 2021.
             
   b. Everardo Balderas Jr. - Retirement - Major, Jail Administrator/Sheriff's Department full time regular at $5,632.50 per month effective December 31, 2021.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve Personnel Items 3.1 (a & b)

   2. Accept and record employee status changes:
  None today
             
   4. EXECUTIVE SESSION

PUBLIC NOTICE
is given that the San Patricio Commissioners Court may elect to go into Executive Session anytime during the meeting to discuss matters listed on the Agenda, when authorized by the provisions of the Open Meetings Act, Chapter 551 of the Texas Government Code. In the event the Commissioners Court elects to go into Executive Session regarding an agenda item the section or sections of the Open Meetings Act authorizing the Executive Session will be publicly announced by the presiding officer. In accordance with the authority of the Government Code, Sections 551.071, 551.072, 551.073, 551.074, 551.0745, 551.076, 551.086 the Commissioners Court will hold an Executive Session to consult with attorney(s) including matters related to litigation; deliberate regarding real property; prospective gifts(s); personnel matter, including termination; security devices, and/or economic development negotiations and other matters that may be discussed in an Executive Session. Upon completion of the Executive Session, the Commissioners' Court may in an open session take such action as appropriate on items discussed in Executive Session.
  At 10:50 a.m. Judge Krebs recessed the regular session to go into executive session
At 10:57 a.m. The Court with its attorney went into executive session
At 11:24 a.m. Judge Krebs closed the executive session
At 11:25 a.m. The Court reconvened into regular session
             
   1. Pursuant to Section 551.071, Consultation with Attorney, Texas Gov't Code, the Court will conduct a closed session consultation with its attorney regarding pending litigation, and related matters.
