BE IT REMEMBERED THAT, notice had been duly filed and posted by the County Clerk on the 9th day of December, 2021 at 3:27 P.M. For a Regular meeting of the Commissioners' Court on MONDAY, DECEMBER, 13, 2021 at 9:00 A. M. in the San Patricio County Courthouse Commissioners Courtroom # 230 second Floor, Sinton, Texas. At which time the following subjects were discussed, concerned, passed, or adopted. 

The following members were present, to-wit:

The following proceedings were had, to-wit:
             
   1. CALL TO ORDER, PLEDGES AND PUBLIC INVOLVEMENT
             
   1. Call meeting to order
  Meeting was called to order at 9:00 a.m. 
             
   2. Pledge of allegiance
  The Court opened the regular meeting with the Pledges of Allegiance to the flag of the United States and to the flag of the State of Texas.
             
   3. Citizens to be heard
  Virginia Garza, Mayor of Odem presented a basket to Norma Jean Rivera and staff in appreciation on behalf of the family of Robert Lopez. She thanked Norma and staff for all their help to Robert during his illness and at the time of his passing.  
             
   4. Report from Judge, Commissioner or Department concerning an item/report of community interest.
  Judge Krebs read a Proclamation recognizing Gregory-Portland Tech classes under the direction of David Rains. 
Judge Krebs gave the weekly COVID-19 report. He stated that fatalities and hospitalization rates were down. The concern is the positivity rate it is rising on December 8 it was 8% and December 12 it was 9.5%  
Commissioner Lopez commented on the County Christmas party. She stated that everything went well and all was very nice. 
Judge Krebs also reiterated on the success of the Christmas party.  He mentioned that it was great to be able to get together after 2 years. 
Heather Marks, District Clerk invited the Court to stop by the hallway from her office to see the many entries for that have been submitted by elementary students. She is having a Christmas tree decorating contest.
John Hernandez, County Engineer gave a brief report from the new courthouse annex and courthouse renovation team. 
             
   2. DELIBERATE AND CONSIDER ACTION ON THE FOLLOWING ITEMS:
             
   1. Approval of minutes
             
  Motion made by Commissioner, Precinct 2 Gary W. Moore, Sr., seconded by Commissioner, Precinct 4 Howard J. Gillespie to approve minutes for December 6, 2021 as submitted by County Clerk 

  Vote: 5 - 0 Carried
             
   2. Financial Agenda:
             
   a. Examination, consideration, and action on approval of all claims against San Patricio County Pursuant to section 113.064, Texas Local Government Code.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve list of all claims against San Patricio County Pursuant to section 113.064, Texas Local Government Code.


  Vote: 5 - 0 Carried
             
   b. Consideration and action on Budget Line Items, Transfers, and Amendments.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve budget line item transfers and budget amendment as submitted


  Vote: 5 - 0 Carried
             
   c. Consideration and action on accepting bank reconciliation, investment reports, and related matters by County Treasurer. 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to accept and record all reports submitted by County Treasurer

   3. Consent Agenda: All Consent Agenda items listed are considered to be routine by the Commissioners Court. Members of the Commissioners Court have been furnished documentation on each item, and all such items may be acted upon by one vote without being discussed separately unless requested by County Judge or a Commissioner:
             
   a. Accept & Record Tax Assessor Collector's Statement of Collections for month ending 11/30/2021
             
  Motion made by Commissioner, Precinct 2 Gary W. Moore, Sr., seconded by Commissioner, Precinct 4 Howard J. Gillespie to accept and record Tax Assessor Collector's Statement of Collections for month ending 11/30/2021

   4. Individual Action Agenda:
             
   a. Consideration and action on recognizing Gregory-Portland Tech classes under the direction of David Rains. 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve Proclamation recognizing Gregory-Portland Tech classes under the direction of David Rains. 


  Vote: 5 - 0 Carried
             
   b. Consideration and action on Order Continuing Declaration of Local State of Disaster for San Patricio County due to Novel Coronavirus (COVID-19). Effective 12:01 AM December 6, 2021 and continuing for 30 days with consent of Commissioners Court. 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve Order Continuing Declaration of Local State of Disaster for San Patricio County due to Novel Coronavirus (COVID-19). Effective 12:01 AM December 6, 2021 and continuing for 30 days with consent of Commissioners Court. 


  Vote: 5 - 0 Carried
             
   c. Consideration and action on Order Continuing Declaration of Local State of Disaster Due to Unlawful Texas-Mexico Border Crossings by Illegal Aliens. Effective 12:01 AM December 6, 2021, and continuing for 30 days with consent fo Commissioners Court. 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to approve Order Continuing Declaration of Local State of Disaster Due to Unlawful Texas-Mexico Border Crossings by Illegal Aliens. Effective 12:01 AM December 6, 2021, and continuing for 30 days with consent fo Commissioners Court. 


  Vote: 5 - 0 Carried
             
   d. Consideration and action on Change Order #1 related to the construct of the new Precinct 1 Building in the amount of $8,591.04 which will cover the of design and installation of a Fire Alarm System. Fire Marshal Loving made this recommendation pursuant to NFPA 72 and ADA requirements.  
             
  Motion made by Commissioner, Precinct 1 Sonia Lopez, seconded by Commissioner, Precinct 3 Lilly Wilkinson to approve Change Order #1 related to the construct of the new Precinct 1 Building in the amount of $8,591.04 which will cover the of design and installation of a Fire Alarm System. Fire Marshal Loving made this recommendation pursuant to NFPA 72 and ADA requirements.


  Vote: 5 - 0 Carried
             
   e. Consideration and action on Change Order #1 related to the WIC Renovation/Remodel Project at the Ingleside location in the amount of $10,427.50. Changes due to kitchen improvements and would bring contract price to $203,327.50. 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve Change Order #1 related to the WIC Renovation/Remodel Project at the Ingleside location in the amount of $10,427.50. Changes due to kitchen improvements and would bring contract price to $203,327.50. 


  Vote: 5 - 0 Carried
             
   f. Consideration and action on Change Order #1 related to the Thomas Airport Hangar Maintenance Project which changes the scope of work being performed by Rodcon Services and allows additional 90 days to complete. No change to the Project's budget.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve Change Order #1 related to the Thomas Airport Hangar Maintenance Project which changes the scope of work being performed by Rodcon Services and allows additional 90 days to complete.    g. Consideration and action on I.S. Director Steven Gonzalez's recommendation that section 1C-4 of the County Employee Handbook be amended to adopt the San Patricio County Information Services Policy and Procedures for Employee Offboarding.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve I.S. Director Steven Gonzalez's recommendation that section 1C-4 of the County Employee Handbook be amended to adopt the San Patricio County Information Services Policy and Procedures for Employee Offboarding.

   h. Consideration and action on creating four (4) F-T Regular Positions (a Customer Service Representative and 3 Line Technicians) and one (1) P-T Regular Position (Line Technician) for the McCampbell Porter Airport effective January 1, 2022, to be paid for out of the Airport Fund. Positions to terminate December 31, 2022.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to create one (1) full time and one (1) part time positions for the McCampbell Porter Airport effective January 1, 2022, to be paid for out of the Airport Fund. Positions to terminate December 31, 2022.


  Vote: 5 - 0 Carried
             
   i. Consideration and action on creating two (2) F-T Regular positions (Line Technicians) and one (1) P-T Regular position (Line Technician) for the Alfred "Bubba" Thomas Airport, effective January 1, 2022, to be paid out of Airport Funds. Positions to terminate December 31, 2022.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to create one (1) part-time position for the Alfred "Bubba" Thomas Airport, effective January 1, 2022, to be paid out of Airport Funds. Positions to terminate December 31, 2022.

   j. Consideration and action on awarding San Patricio County Stop Loss Insurance contract. 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to award Stop Loss Contract to ExcessRe 


  Vote: 5 - 0 Carried
             
   k. Consideration and action on awarding contract for RFP 2021-010 Auditing Services for San Patricio County. 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to award contract for RFP 2021-010 Auditing Services for San Patricio County to Cascos Associates Brownsvile, Texas 


  Vote: 5 - 0 Carried
             
   l. Consideration and action on contracts to provide twenty-four hour secure residential services in the San Patricio County Juvenile Detention Center for children who are ordered by court of proper jurisdiction with the following counties:
1. Jim Wells County
2. Kleberg County
3. Refugio County
4. Nueces County
5. Jackson County
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to approve contracts to provide twenty-four hour secure residential services in the San Patricio County Juvenile Detention Center for children who are ordered by court of proper jurisdiction with the following counties:

   m. Consideration and action on Insurance Consulting Agreement between William Rusteberg and San Patricio County for $2,500.00 per month. This will be an increase of $500.00 per month. Effective January 1, 2022.
             
  Motion made by Commissioner, Precinct 1 Sonia Lopez, seconded by Commissioner, Precinct 4 Howard J. Gillespie to not renew Insurance Consulting Agreement between William Rusteberg and San Patricio County for $2,500.00 per month. This will be an increase of $500.00 per month. Effective January 1, 2022.


  Vote: 4 - 1 Carried

   n. Consideration and action on awarding the contract for Workers Compensation and Liability  Insurance for San Patricio County.
 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to award the contract for Workers Compensation and Liability Insurance for San Patricio County to Texas Association of Counties
 


  Vote: 5 - 0 Carried
             
   o. Consideration and action on Order Adopting Redistricting Plan for Election Precincts that adopts the maps and data depicted in the Proposed Election Precincts Plan 1 and possible action on Supplemental Order and Final Adoption of Revised Political Boundaries. 
 
             
  Motion made by Commissioner, Precinct 2 Gary W. Moore, Sr., seconded by Commissioner, Precinct 4 Howard J. Gillespie to TABLE this item at the request of Pamela Hill Elections Administrator

   3. PERSONNEL-Employment and current employee status changes in accordance with the current personnel policies, County Budget, and State law with notification of such changes to the payroll division of the Treasurer's office.

   a. Brenda Garcia - Resignation - Deputy Clerk/Tax Auto full time regular at $2,088.87 per month effective December 15, 2021.

   b. Leticia Chapa - Employment - Deputy Clerk/District Clerk full time regular base salary $1,906.67 per month ($11.00 hr.). Request by Elected Official is $2,080.00 per month ($12.00 hr.) effective December 16, 2021.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to approve Leticia Chapa-- Employment-Deputy Clerk/District Clerk full time regular at the amount requested by Elected Official $2,080.00 per month ($12.00 hr.) effective December 16, 2021. ( This new hire would not be eligible for the 6% raise on 1-1-22)

   4. EXECUTIVE SESSION

PUBLIC NOTICE
is given that the San Patricio Commissioners Court may elect to go into Executive Session anytime during the meeting to discuss matters listed on the Agenda, when authorized by the provisions of the Open Meetings Act, Chapter 551 of the Texas Government Code. In the event the Commissioners Court elects to go into Executive Session regarding an agenda item the section or sections of the Open Meetings Act authorizing the Executive Session will be publicly announced by the presiding officer. In accordance with the authority of the Government Code, Sections 551.071, 551.072, 551.073, 551.074, 551.0745, 551.076, 551.086 the Commissioners Court will hold an Executive Session to consult with attorney(s) including matters related to litigation; deliberate regarding real property; prospective gifts(s); personnel matter, including termination; security devices, and/or economic development negotiations and other matters that may be discussed in an Executive Session. Upon completion of the Executive Session, the Commissioners' Court may in an open session take such action as appropriate on items discussed in Executive Session.
