BE IT REMEMBERED THAT, notice had been duly filed and posted by the County Clerk on the 2nd day of December 2021 at 3:55 P.M. For a Regular meeting of the Commissioners' Court on MONDAY, DECEMBER 6, 2021 at 9:00 A. M. in the San Patricio County Courthouse Commissioners Courtroom # 230 second Floor, Sinton, Texas. At which time the following subjects were discussed, concerned, passed, or adopted. 

The following members were present, to-wit:

  Gary W. Moore, Sr., Commissioner, Precinct 2  
  Lilly Wilkinson, Commissioner, Precinct 3  
  Howard J. Gillespie, Commissioner, Precinct 4

David Wendel, County Auditor
The following proceedings were had, to-wit:
             
   1. CALL TO ORDER, PLEDGES AND PUBLIC INVOLVEMENT
             
   1. Call meeting to order
  Meeting was called to order at 9:00 a.m. 
             
   2. Pledge of allegiance
  The Court opened the regular meeting with the Pledges of Allegiance to the flag of the United States and to the flag of the State of Texas.
             
   3. Citizens to be heard
  Christy Payne, Sinton Chamber of Commerce Director thanked the Judge and Commissioners for letting the Chamber use the areas around the Courthouse for their Christmas events. She also thanked them for allowing the Christmas tree to be at the Courthouse. She thanked the Judge for participating in the lighting of the tree.
             
   4. Report from Judge, Commissioner or Department concerning an item/report of community interest.
  Dr. James Mobley, SPC Health Authority gave his weekly COVID-19 report. He stated that the numbers across the state are leveling off. He mentioned that fatalities are down and hospitalizations are also leveling out. In SPC there were 9 confirmed cases last ween no fatalities reported since November 22. No change in the vaccination rate. In SPC the rate of children 5 and older is up 1%. Children 5-12 years old 514 have received one dose and 83 are fully vaccinated.  He stated that as of today there is not much to report on the new omicron virus. 
Commissioner Gillespie reported that the bridge project on CR100/1360 was being finished formal ribbon cutting will be on December 15 @10:00 a.m. at the bridge. 
Judge Krebs thanked the Sheriff's Department for putting up the Christmas tree in front of the Courthouse. He mentioned that the Angel tree will be on the second floor this year. He also thanked the Sinton Chamber of Commerce for all that was done at Saturday's Christmas event.
Commissioner Moore announced that he would be retiring and that his position would be open for anyone that would like to run for Commissioner Precinct #2.
             
   2. DELIBERATE AND CONSIDER ACTION ON THE FOLLOWING ITEMS:
             
   1. Approval of minutes
             
  Motion made by Commissioner, Precinct 2 Gary W. Moore, Sr., seconded by Commissioner, Precinct 4 Howard J. Gillespie to approve minutes for November 29, 2021 as submitted by County Clerk

  Vote: 5 - 0 Carried
             
   2. Financial Agenda:
             
   a. Examination, consideration, and action on approval of all claims against San Patricio County Pursuant to section 113.064, Texas Local Government Code.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve list of all claims against San Patricio County Pursuant to section 113.064, Texas Local Government Code.

  Vote: 5 - 0 Carried
             
   b. Consideration and action on Budget Line Items, Transfers, and Amendments.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve budget line items transfers as submitted. 

  Vote: 5 - 0 Carried
             
   c. Consideration and action on accepting bank reconciliation, investment reports, and related matters by County Treasurer.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to accept all reports submitted by County Treasurer





  Vote: 5 - 0 Carried
             
   3. Consent Agenda: All Consent Agenda items listed are considered to be routine by the Commissioners Court. Members of the Commissioners Court have been furnished documentation on each item, and all such items may be acted upon by one vote without being discussed separately unless requested by County Judge or a Commissioner:
             
   a. Accept and Record Fair Housing Month Proclamation - Proclamation of December as Fair Housing Month.  This is to correct wording on November 29, 2021 Commissioners Court Agenda that incorrectly noted "Proclamation of November as Fair Housing Month."
             
   b. Accept and record Airport Hangar Bill of Sale of Hangar, Make: Erect A Tube, Size: 1271.78 sq ft at McCampbell-Porter Airport, Lat/Long: 27-54-54.91N/097-12-35.04W by Marilyn Bein.
             
   c. Consideration and Action to approve the Assignment of Ground Lease at McCampbell-Porter Airport between San Patricio County, and the following person: Marilyn Bein and Outfitter's Long Shot, LLC.
             
   d. Consideration and Action to approve the Sublease for Hangar at McCampbell - Porter Airport between San Patricio County and the following person: Outfitter's Long Shot, LLC., sublessee.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to approve Consent Agenda items 2.3 (a) through 2.3 (d) 


  Vote: 5 - 0 Carried
             
   4. Individual Action Agenda:
             
   0. Discuss, consider and take action to approve Amendment #1 for the Grant Administration Services contract for 2020 Community Development Block Grant - Mitigation (CDBG-MIT) Program Contract #22-085-011-D239. 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to approve Amendment #1 for the Grant Administration Services contract for 2020 Community Development Block Grant - Mitigation (CDBG-MIT) Program Contract #22-085-011-D239. 


  Vote: 5 - 0 Carried
             
   a. Consideration and action on Judge Elvia L. Hernandez,Justice of the Peace, Precinct #8, request to purchase an Apple Lighting to Digital AV Adapter $41.57, a set of phone/ipad chargers and 10' lighting to USB cable $18.99 and a HDMI Cable $11.65 for a total of $72.21 to be paid out of the Justice Court Technology Fund. The items purchased will be used on the courtroom TV for Zoom/In-person hearings.
             
  Motion made by Commissioner, Precinct 2 Gary W. Moore, Sr., seconded by Commissioner, Precinct 4 Howard J. Gillespie toapprove Judge Elvia L. Consideration and action on Community Supervision and Corrections Department's (adult probation) request to place a modular building at the Coastal Bend Regional Intermediate Sanction Facility located at 800 N. Vineyard, Sinton, Texas, at no cost to the County. If approved, the County's current lease with CSCD will be amended to indicated that adult probation will be responsible for all related expenses to include utilities, maintenance, insurance, and the like, on this building.
             
  Motion made by Commissioner, Precinct 4 Howard J. Moore, Sr. to  adopt Local Procurement Policies & Procedures pertaining to the GLO Community Development Block Grant - Mitigation (CDBT-MIT) Program, Infrastructure Contract Number 22-085-011-D239

   d. Discuss, consider and adopt Local Financial Policy & Procedures pertaining to the GLO Community Development Block Grant-Mitigation (CDBG-MIT) Program, Infrastructure Contract No. 22-085-011-D239.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to adopt Local Financial Policy & Procedures pertaining to the GLO Community Development Block Grant-Mitigation (CDBG-MIT) Program, Infrastructure Contract No. 22-085-011-D239

   e. Consideration and action to approve awarding GLO CDBG-DR Drainage Improvements GLO Contract No. 20-065-078-C221 for Rancho Chico in Sinton including Base Bid and Additive No 1 (Esperanza Road), Additive No. 2 (Railroad Avenue) and Additive No. 3 (Ricardo St.) for a total amount of $868,171.00 to J.S. Carroll Weaver, lowest and best bidder. Work to be completed in 140 calendar days.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W.   Motion made by Commissioner, Precinct 1 Sonia Lopez, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve awarding 19-3 Road Bond project for Rancho Chico in Sinton and amend amount to $1,737,271.75 to J.S. Carroll Weaver, lowest and best bidder. (work to be completed in 190 calendar days)

   g. Consideration and action on Final Extension of Rail Spur Lease between the County and Midstream Texas, for spurs 722 and 723 for the term of 12 months beginning January 1, 2022.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to approve Final Extension of Rail Spur Lease between the County and Midstream Texas, for spurs 722 and 723 for the term of 12 months beginning January 1, 2022


  Vote: 5 - 0 Carried
             
   h. Consideration and action to award bid for IFB 2021-0125 Tractor.
             
  Motion made by Commissioner, Precinct 2 Gary W. Moore, Sr., seconded by Commissioner, Precinct 1 Sonia Lopez to award bid for IFB 2021-0125 Tractor to Williamson County Equipment Co. for the 2020 Case IH110C in the amount of  $72,750.00 


  Vote: 5 - 0 Carried
             
   3. PERSONNEL-Employment and current employee status changes in accordance with the current personnel policies, County Budget, and State law with notification of such changes to the payroll division of the Treasurer's office.
             
   1. Deliberate and consider action employee salary:
             
   0. Donna Schroeder - Other - Internal Auditor/Auditor part time regular to part time temporary at $24.89 per hour effective December 1, 2021.

   4. EXECUTIVE SESSION

PUBLIC NOTICE
is given that the San Patricio Commissioners Court may elect to go into Executive Session anytime during the meeting to discuss matters listed on the Agenda, when authorized by the provisions of the Open Meetings Act, Chapter 551 of the Texas Government Code. In the event the Commissioners Court elects to go into Executive Session regarding an agenda item the section or sections of the Open Meetings Act authorizing the Executive Session will be publicly announced by the presiding officer. In accordance with the authority of the Government Code, Sections 551.071, 551.072, 551.073, 551.074, 551.0745, 551.076, 551.086 the Commissioners Court will hold an Executive Session to consult with attorney(s) including matters related to litigation; deliberate regarding real property; prospective gifts(s); personnel matter, including termination; security devices, and/or economic development negotiations and other matters that may be discussed in an Executive Session. Upon completion of the Executive Session, the Commissioners' Court may in an open session take such action as appropriate on items discussed in Executive Session.
