BE IT REMEMBERED THAT, notice had been duly filed and posted by the County Clerk on the 6th day of January 2022 at 3:39 P.M. For a Regular meeting of the Commissioners' Court on MONDAY,
JANUARY 10, 2022 
at 9:00 A. M. in the San Patricio County Courthouse Commissioners Courtroom # 230 second Floor, Sinton, Texas. At which time the following subjects were discussed, concerned, passed, or adopted. 

The following members were present, to-wit:

  Lilly Wilkinson, Commissioner, Precinct 3  
  Howard J. Gillespie, Commissioner, Precinct 4  
Staff Present: Gracie Alaniz-Gonzales, County Clerk
David Wendel, County Auditor
The following proceedings were had, to-wit:
             
   1. CALL TO ORDER, PLEDGES AND PUBLIC INVOLVEMENT
             
   1. Call meeting to order
  Meeting was called to order at 9:00 a.m. 
             
   2. Pledge of allegiance
  The Court opened the regular meeting with the Pledges of Allegiance to the flag of the United States and to the flag of the State of Texas.
             
   3. Citizens to be heard
  Judge Patrick Flanigan, 156th District Judge addressed the Court with concerns that the Courthouse has no type security. He stated that there at least 3 positions available and they are not being advertised. One position for Courthouse security and two positions for the SO/bailiffs. These positions are in the FY 2022 budget. He mentioned that during the time of Covid-19 when the Courts were shut down and the Courthouse was not having much traffic there were 5 to 6 deputies in the Courthouse now that Courts are back in session and more people are coming in the Courthouse there is not one deputy around. 
Norma Rivera with Texas Wrecker addressed the Court about what they needed to do to get on the rotation list for towing. She mentioned that they had purchase land off Hwy 77 and had the equipment to remove and clear roads after accidents. 
             
   4. Report from Judge, Commissioner or Department concerning an item/report of community interest.
  Judge Krebs gave the weekly Covid-19 report for Dr. Mobley. He mentioned that cases in the US and Texas were slightly down. There are 53 new cases in San Patricio County. Hospitalizations are rising but not as fast as cases. Positivity rate is slightly decreasing.
Vaccinations in SPC are 5 years and older one dose-68% fully vaccinated-58% Booster-18%; 65 and older one dose 95% fully vaccinated 85%.
Norma Jean Rivera informed the Court that CACOST will be having a mobile unit doing Covid-19 testing tomorrow from 9 a.m. to 1 p.m. at the annex parking lot located on Odem Street

 
             
   2. DELIBERATE AND CONSIDER ACTION ON THE FOLLOWING ITEMS:
             
   1. Approval of minutes
             
  Motion made by Commissioner, Precinct 2 Gary W. Moore, Sr., seconded by Commissioner, Precinct 1 Sonia Lopez to approve minutes of January 3, 2022 as submitted by Count Clerk 


  Vote: 5 - 0 Carried
             
   2. Financial Agenda:
             
   a. Examination, consideration, and action on approval of all claims against San Patricio County Pursuant to section 113.064, Texas Local Government Code.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve list of all claims against San Patricio County Pursuant to section 113.064, Texas Local Government Code.


  Vote: 5 - 0 Carried
             
   b. Consideration and action on Budget Line Items, Transfers, and Amendments.
  None today
             
   c. Consideration and action on accepting bank reconciliation, investment reports, and related matters by County Treasurer. 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to accept all reports as submitted by County Treasurer


  Vote: 5 - 0 Carried
             
   3. Consent Agenda: All Consent Agenda items listed are considered to be routine by the Commissioners Court. Members of the Commissioners Court have been furnished documentation on each item, and all such items may be acted upon by one vote without being discussed separately unless requested by County Judge or a Commissioner:
             
   a. Accept & Record Tax Assessor Collector's Statement of Collections of month ending 12/31/2021
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to accept and record Tax Assessor Collector's Statement of Collections for month ending 12/31/2021


  Vote: 5 - 0 Carried
             
   4. Individual Action Agenda:
             
   a. Consideration and action on soliciting an individual or firm to complete an environmental study on the 24.965 acres the County is considering for the new Courts Building (Annex) located on Tx Hwy 188 across from the San Patricio County Appraisal District Offices. 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to approve soliciting an individual or firm to complete an environmental study on the 24.965 acres the County is considering for the new Courts Building (Annex) located on Tx Hwy 188 across from the San Patricio County Appraisal District Offices. 


  Vote: 5 - 0 Carried
             
   b. Consideration and action on authorizing Auditor's Office to seek bids on prefabricated modular 3-office building. 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 2 Gary W. Moore, Sr. to authorize Auditor's Office to seek bids on prefabricated modular 3-office building. 


  Vote: 5 - 0 Carried
             
   c. Consideration and action on authorizing a full time temporary Juvenile Supervision Officer due to Full time regular Juvenile Supervision Officer position is being held for employee that is on military reserve status.  
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to authorize a full time temporary Juvenile Supervision Officer due to Full time regular Juvenile Supervision Officer position is being held for employee that is on military reserve status.  


  Vote: 5 - 0 Carried
             
   d. Consideration and action on authorizing a $50.00 per month phone allowance for Isreal Salinas for Parks Department, effective January 1, 2022.  Funding is in the 2022 Budget.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to authorize a $50.00 per month phone allowance for Isreal Salinas for Parks Department, effective January 1, 2022.  Funding is in the 2022 Budget.


  Vote: 5 - 0 Carried
             
   e. Consideration and action on authorizing a $50.00 per month phone allowance for Priscilla Maldonado, Information Services, effective January 1, 2022.  Funding will be transferred from the 2022 budget.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to authorize a $50.00 per month phone allowance for Priscilla Maldonado, Information Services, effective January 1, 2022.  Funding will be transferred from the 2022 budget.

   f. Consideration and action on authorizing a $50.00 per month phone allowance for Jeremy Wallace, Parks Department, effective January 1, 2022.  Funding is in the 2022 Budget.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to authorize a $50.00 per month phone allowance for Jeremy Wallace, Parks Department, effective January 1, 2022.  Funding is in the 2022 Budget.

   g. Consideration and action on Parlamas Acres Lots 1-3 subdivision. Subdivision is located on CR 2289, Southeast of Odem.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to approve Parlamas Acres Lots 1-3 subdivision. Subdivision is located on CR 2289, Southeast of Odem.


  Vote: 5 - 0 Carried
             
   h. Consideration and action on Professional Service agreement with Tyler Technologies for configuration and consulting services due to SB41 legislative changes, at no charge to the County. 
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to approve Professional Service agreement with Tyler Technologies for configuration and consulting services due to SB41 legislative changes, at no charge to the County




  Vote: 5 - 0 Carried
             
   3. PERSONNEL-Employment and current employee status changes in accordance with the current personnel policies, County Budget, and State law with notification of such changes to the payroll division of the Treasurer's office.
             
   1. Deliberate and consider action employee salary:
             
   a. Erin Leal - Transfer - Crewman/Road and Bridge #3 full time temporary at $11.50 per hour to full time regular at base $1,906.67 ($11.00 hr.). Request by Elected Official is $1,993.33 per month ($11.50 hr.) effective January 16, 2022.
             
   b. Hector Blanco Jr. - Transfer - Crewman/Road and Bridge #3 full time regular at $2,067.00 per month ($11.93 hr.) to Maintenance Assistant/County Parks full time regular base salary $1,906.67 per month ($11.00 hr.). Request by Elected Official is $2,067.00 per month ($11.93 hr.) effective January 16, 2022. 
             
   c. Dell F. Telford - Retirement - Personnel, Benefits Administrator, Full Time Regular, $3,870.90 per month ($22.33 hr) effective January 31, 2022.
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 1 Sonia Lopez to approve Personnel Items 3.1 (a) through 3.1 (c)

   2. Accept and record employee status changes:
  None today
             
   4. EXECUTIVE SESSION

PUBLIC NOTICE
is given that the San Patricio Commissioners Court may elect to go into Executive Session anytime during the meeting to discuss matters listed on the Agenda, when authorized by the provisions of the Open Meetings Act, Chapter 551 of the Texas Government Code. In the event the Commissioners Court elects to go into Executive Session regarding an agenda item the section or sections of the Open Meetings Act authorizing the Executive Session will be publicly announced by the presiding officer. In accordance with the authority of the Government Code, Sections 551.071, 551.072, 551.073, 551.074, 551.0745, 551.076, 551.086 the Commissioners Court will hold an Executive Session to consult with attorney(s) including matters related to litigation; deliberate regarding real property; prospective gifts(s); personnel matter, including termination; security devices, and/or economic development negotiations and other matters that may be discussed in an Executive Session. Upon completion of the Executive Session, the Commissioners' Court may in an open session take such action as appropriate on items discussed in Executive Session.
  At 9:31 a.m. Judge Krebs recessed the regular session to go into executive session
At 9:33 a.m. the Court with its attorney went into executive session
At 9:55 a.m. Judge Krebs closed the executive session 
At 9:56 a.m. the Court reconvened into regular session
 
             
   1. Pursuant to Section 551.074, Personnel Matters, Texas Gov't Code, the Court will conduct a closed session to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of an employee; or to hear a complaint or charge against an employee, and related matters.

Consideration and possible action on closed session regarding personnel matters, pursuant to Section 551.074, Personnel Matters, Texas Gov't Code.

   5. ADJOURN
             
  Motion made by Commissioner, Precinct 4 Howard J. Gillespie, seconded by Commissioner, Precinct 3 Lilly Wilkinson to adjourn with no further business before the Court. Meeting was adjourned at 9:57 a.m.
