Resolution for 2013 Indigent Defense Grant Application

Discuss and consider adopting a resolution authorizing the submittal of a grant application for the FY2013 Formula Grant Program of the Texas Indigent Defense Commission Grant Program.
The 77th Texas Legislature, through the passage of the Fair Defense Act, established the blueprint for meaningful interaction between State and local government through the creation of the first state body to administer statewide appropriations and policies. In exchange for State fiscal assistance, the local judiciary is required to report its plan for delivering indigent defense services. The Texas Indigent Defense Commission (formerly Task Force on Indigent Defense) publishes these local plans on its website for all to view. The law also requires local county auditors to annually report county expenditures pertaining to criminal indigent defense services (also published on the website). The Texas Indigent Defense Commission (TIDC) serves as a standing committee of the Texas Judicial Council and is composed of eight ex officio members and five members appointed by the Governor. Nueces County has been receiving these funds since the program's inception in 2003. Total allocations to date total $1,606,164. Past allocations are as follows:

The mission of TIDC is to improve the delivery of indigent defense services through fiscal assistance, accountability and professional support to State, local judicial, county, and municipal officials. The purpose of the TIDC is to promote justice and fairness to all indigent persons accused of criminal conduct, including juvenile respondents, as provided by the laws and constitutions of the United States and Texas.

The grant application and resolution are due by December 3, 2012. The estimated allocation for FY2013 is undetermined at this time. There is no cash match required for this grant.
