SPECIAL MEETING - AUGUST 30, 2021

BE IT REMEMBERED, that on this the 30th day of August, A.D., 2021, there was begun and held a SPECIAL MEETING of the Honorable Commissioners Court of Nueces County, Texas, wherein the following members thereof were present, to-wit:
 
BARBARA CANALES COUNTY JUDGE
ROBERTO G. HERNANDEZ COMMISSIONER, PRECINCT NO. 1
JOE A. GONZALEZ COMMISSIONER, PRECINCT NO. 2
JOHN MAREZ COMMISSIONER, PRECINCT NO. 3
BRENT CHESNEY COMMISSIONER, PRECINCT NO. 4

and KARA SANDS, COUNTY CLERK of Nueces County, Texas, wherein the following proceedings were had, to-wit:

   1.   CALL TO ORDER
             
   A.   The Court led the Pledge of Allegiance to the United States of America and Texas Flags.
             
   B.   County Judge Canales called the Special Meeting to order at 1:35 p.m. and certified that a quorum was present. Commissioner Marez attended via virtual access. The meeting was held in the Commissioners Courtroom located at 901 Leopard Street on the 3rd floor of the Nueces County Courthouse.
             
   C.   PUBLIC COMMENT: No public comment.
             
   2.   REGULAR AGENDA:
             
   A.   AGENDA ITEMS
             
   1.   The Court discussed potential legal issues related to the contract with ABM Bundled Energy Solutions Project Agreement; Discussed options available to the Court regarding work not yet performed.  No action taken.
             
   2.   The Court discussed SB6/HB12 related to bail bond reform, including any potential county budget impacts; Discussed supporting amendments to SB6/HB12 that would reduce county financial burden.  No action taken.

   3.   The Court received an overview and discussed permissible uses of the American Rescue Plan Act (ARPA) funds under the final interim rules; approved project prioritization and allocation of ARPA funds, including new positions and/or reclassifications, and related matters.
             
  Motion by: Commissioner Chesney, Second by: Commissioner Gonzalez
         
Motion: To prioritize the Emergency Management positions and the Constable position on the Kleberg land, for those funds be used in some form, whether it be for employees or contract labor, out of the ARPA funds.


  Vote: 5 - 0 Approved
             
   B.   GRANTS
             
   1.   The Court approved the submission of an Initial Recovery Plan to the United States Department of Treasury in relation to the American Rescue Plan Act Coronavirus State and Local Fiscal Recovery Fund.
             
  Motion by: Commissioner Gonzalez, Second by: Commissioner Hernandez
         


  Vote: 5 - 0 Approved

   C.   PURCHASING
             
   1.   The Court awarded RFQ No. 3172-21 Legal Counsel to assist with redistricting process in Nueces County to Rolando L. Rios & Associates, PLLC.
             
  Motion by: Commissioner Marez, Second by: Commissioner Gonzalez
         
Commissioner Hernandez was not present for the vote and Commissioner Chesney abstained.

   D.   HUMAN RESOURCES
             
   1.   The Court approved funding Dept. 2001 Other Victim Assistance Grants (OVAG) Victim Assistance – 2 temporary positions of 29 hours a week, for the month of September 2021.
             
  Motion by: County Judge Canales, Second by: Commissioner Chesney
         


  Vote: 5 - 0 Approved
             
   2.   The Court approved funding for Dept. 2001 Other Victim Assistance Grants (OVAG) Victim Assistance – 2 temporary positions of 29 hours a week, for FY 21/22 or until the grant can be renewed.
             
  Motion by: County Judge Canales, Second by: Commissioner Chesney
         


  Vote: 5 - 0 Approved
             
   3.   The Court approved paying, without reducing the sick leave, vacation, compensatory, or any other paid leave balance in connection with quarantine leave, to any member of the Nueces County Collective Bargaining Unit Quarantine Leave when ordered by a supervisor or a health authority to quarantine or isolate due to a possible or known exposure to a communicable disease while on duty-effective dating back to June 15, 2021.
             
  Motion by: Commissioner Chesney, Second by: Commissioner Gonzalez
         
Motion: Subject to a policy which comports to H.B. 2073.

  Vote: 5 - 0 Approved
             
   3.   EXECUTIVE SESSION: The Court convened into Executive Session at 3:29 p.m. and reconvened into Regular Session at 5:38. p.m.
 

The Court was adjourned at 6:01 p.m. in memory of Richard Martinez.

There being no further business to come before the Court, it is ordered that this meeting does now
stand adjourned, this the 30th day of August, 2021.
