BE IT REMEMBERED, that on this the 16th day of August, A.D., 2021, there was begun and held a SPECIAL MEETING of the Honorable Commissioners Court of Nueces County, Texas, wherein the following members thereof were present, to-wit:

   1.   CALL TO ORDER
             
   A.   Commissioner Marez led the Invocation.
             
   B.   The Court led the Pledge of Allegiance to the United States of America and Texas Flags.
             
   C.   County Judge Canales called the Special Meeting to order at 9:06 a.m. and certified that a quorum was present. The meeting was held in the Commissioners Courtroom located at 901 Leopard Street on the 3rd floor of the Nueces County Courthouse.
             
   D.   Safety Briefing was given by Timothy Everest, Risk Manager.
             
   E.   PUBLIC COMMENT: Daniel Zamora, Bobby L. Chesnutt, Bruce Hoelscher and Karen Vaughn.
             
   F.   Adopt the following Resolution(s), Proclamation(s), and/or Order(s):
             
   1.   The Court adopted a resolution recognizing the 101st Celebration of the passing of 19th Amendment to the U.S. Constitution (Right for Women to Vote).

   1.   The Court received an update from County Judge Canales on disaster preparedness and response, including matters related to COVID-19. Comments by Claudia Raybuck, Citizens Advisory Health Board.

   H.   The Court approved Third Amendment to Contract with BCFS Health and Human Services for Incident Management Team Supplementation services related to support of COVID-19 vaccination operations.

   I.   The Court approved the submission of an application to the Texas Department of State Health Services for the Texas Vaccine Outreach and Education grant.
             
   J.   The Court authorized the submission of a grant application to the Texas A&M AgriLife Extension Service for the Feral Hog Abatement Program. 
             
   3.   REGULAR AGENDA:
             
   A.   AGENDA ITEMS
             
   1.   The Court discussed issues related to Nueces County Animal Care Services, including its autonomy, policies, operating procedures, and best practices.
             
   2.   The Court tabled the report from third party reviewer on the Johnson Controls Inc., Phase I and Phase II Energy Savings Performance Contracts until the next court.

   3.   The Court received an update from Mike Bailey, on Energy Savings Performance Contract with ABM Building Services, LLC for Capital Improvement Program (CIP).

   4.   The Court received an overview from Kristen Kerr, Hagerty Consulting, and discussed permissible uses of the American Rescue Plan Act (ARPA) funds under the final interim rules; approved project prioritization and allocation of ARPA funds.
             
  Motion by: Commissioner Chesney, Second by: Commissioner Gonzalez
         
Motion: Other than the Veteran's Service Officer we would move forward with the project prioritization as (ARPA) funds subject to any further verification by the Auditor, County Attorney or Hagerty Consulting.

   5.   The Court approved the early voting polling locations for the state constitutional amendment election on November 2, 2021.

   8.   The Court approved the appointment of election judges and apportionment of election judges for voting centers per commissioner precinct pursuant to Section 32.002 of the Texas Election Code.

   9.   The Court discussed in Executive Session recent COVID-19 related orders and recommendations; discussed and considered taking any action, approving policies, and/or adopting any resolutions or Orders authorized by law related to county facilities, county employees, citizens, and visitors of Nueces County regarding COVID-19. No action taken.
             
   10.   The Court approved overtime pursuant to County policy for essential exempt employees during declared disasters as it relates to COVID-19. Authorized payment of overtime to essential exempt City County Health District Employees.

   B.   SHERIFF
             
   1.   The Court discussed the jail population and Nueces County housing of prisoners out of county through interlocal agreements, including matters related to 2021-2022 budget.  No action taken.
             
   C.   PUBLIC WORKS
             
   1.   The Court received the third quarter report from Juan Pimentel, Nueces County Engineer, regarding Public Work activities, including drainage, flood management, and roads.
             
   D.   AUDITOR
             
   1.   The Court approved Budget Change Order No. 19 for Fiscal Year 2020-2021.

   E.   HUMAN RESOURCES
             
   1.   The Court approved adding a car allowance of $96.15 per pay period for the Director of Mental Health Programs from effective date of hire, March 22, 2021.
             
  Motion by: Commissioner Gonzalez, Second by: Commissioner Hernandez
         


  Vote: 5 - 0 Approved
             
   4.   EXECUTIVE SESSION: The Court convened into Executive Session at 3:12 p.m. and reconvened into Regular Session at 4:59 p.m.
             
   A.   The Court discussed taking action regarding the claim and settlement demand of Frontier Communications and related matters.
             
  Motion by: County Judge Canales, Second by: Commissioner Marez
         
Motion: Deny such settlement demand.  Commissioner Gonzalez and Commissioner Chesney were not present for the vote.





  Vote: 3 - 0 Approved
             
   B.   The Court consulted with the County Attorney on legal matters related to taking action, approving policies, and/or adopting any resolutions or Orders authorized by law related to county facilities, county employees, citizens, and visitors of Nueces County regarding COVID-19.
             
   C.   The Court consulted with the County Attorney on legal matters related to the American Rescue Plan Act of 2021 (ARPA).
             
   D.   The Court consulted with the County Attorney on legal matters related to Energy Savings Performance Contract with ABM Building Services, LLC for Capital Improvement Program (CIP), and equipment lease/purchase agreement with Banc of America Public Capital Corp.

Note:  The County Attorney has been asked to produce an advisory regarding the ABM Contract.
             
   E.   The Court consulted with the County Attorney regarding health insurance and workers compensation law for law enforcement employees potentially injured during the course of their normal duty; discuss and consider payment of any outstanding claims.
             
  Motion by: County Judge Canales, Second by: Commissioner Marez
         
Motion: Direct the County Attorney to create a policy such that we could achieve 100% coverage for health insurance and workers compensation.  Commissioner Gonzalez and Commissioner Chesney were not present for the vote.

  Vote: 3 - 0 Approved
 

The Court was adjourned at 5:34 p.m. in memory of those individuals lost to COVID-19.

There being no further business to come before the Court, it is ordered that this meeting does now
stand adjourned, this the 16th day of August, 2021.
