RECOMMENDATION

Discuss and consider approval of a Dune Protection Permit, DPP-1214-01P, for a single family dwelling at La Concha Estates as recommended by the Nueces County Beach Management Advisory Committee (BMAC).

BACKGROUND

In 2013, the owners were authorized an exemption from the requirements of a DPP for their single-family dwelling on Mustang Island in the La Concha Estates Subdivision under application DPP-0613-01. Subsequently, during construction, dunes and vegetation were damaged. The Court revoked the exemption 0613-01, and asked the applicant to re-apply under a full dune protection permit that included a mitigation plan to restore the damage to dunes and the vegetation.

DISCUSSION

In December, the applicant submitted a Dune Protection Permit application under DPP-1214-01P, that included a mitigation plan in a 2:1 ratio. The BMAC approved the plan that adequately outlined resolution of damaged dune and vegetation. The GLO concurred with this plan. The applicant has paid the dune permit fees to the County. We recommend court approval to authorize the permit under DPP-1214-01P.
