SUBJECT:
DISCUSSION AND POSSIBLE ACTION TO INITIATE ZONING CODE AMENDMENTS IN RESPONSE TO POTENTIAL VOTER APPROVAL OF PROPOSITION 207
RECOMMENDATION:
Staff recommends initiation. 
EXECUTIVE SUMMARY:

Proposition 207, “Smart and Safe Arizona Act”, is on the November ballot to "authorize the sale, use, cultivation, processing, transport, manufacturing, testing etc. of recreational marijuana". If approved, the proposition would go into effect on November 4 (once the vote is certified). In preparation of potential voter approval, it is imperative for jurisdictions to update all applicable codes to regulate recreational marijuana before it goes into effect. Initiation will direct staff to review existing code and propose changes for conformance with Proposition 207 should it be approved.

Initiation by the Planning and Zoning Commission is required for all zoning code amendments not defined on the Planning Work Plan or initiated by a private property owner.

If initiated, the proposed code amendments will be presented to the Planning and Zoning Commission for recommendation later in October (exact date to be determined) and subsequently to Town Council on November 4, 2020. 

BACKGROUND OR DETAILED INFORMATION:

Initiation of the code amendments directs staff to review the existing code and propose changes for conformance with Proposition 207. The existing code regulates cultivation and dispensing of marijuana for medical purposes per Prop 203 (approved in November 2010). Similarly, the zoning code was updated prior to the vote, in October 2010, to ensure the Town was adequately prepared.

If initiated, a similar legal exercise will be performed for recreational marijuana use in conformance with Prop 207.The proposed code amendments will be presented to the Planning and Zoning Commission for recommendation later in October (exact date to be determined) and subsequently to Town Council on November 4, 2020.

I MOVE to INITIATE the zoning code amendments in response to potential voter approval of Proposition 207 for compliance with State law.
