Resolution No. (R)18-39, authorizing and approving Amendment No. 3 to the Intergovernmental Transportation Funding Agreement between the Regional Transportation Authority of Pima County and the Town of Oro Valley for improvements to La Cholla Boulevard: Overton Road to Tangerine Road
RECOMMENDATION:

Staff recommends approval.

EXECUTIVE SUMMARY:
This third amendment (Exhibit B) will increase the Town’s contribution commitment from $800,000 to $1,700,000 and add $3,150,000 in Pima County Impact Fees from the RTA to the Town of Oro Valley for the construction phase of the La Cholla Project, as outlined in the IGA between Pima County and the RTA (Exhibit C), described within the RTA funding detail breakdown (Exhibit A). Due to high construction demand and increasing construction costs, a larger contribution is required for the project based upon the bids received by the Town. The additional $900,000 Town contribution will come from Town Development Impact Fees and will still leave a sufficient fund balance for other projects and needs.
BACKGROUND OR DETAILED INFORMATION:
On April 1, 2015, the Town of Oro Valley approved Resolution No. (R)15-26, authorizing and approving the Intergovernmental Transportation Funding Agreement between the Regional Transportation Authority of Pima County and the Town of Oro Valley in the amount of $2 million for the roadway design improvements to La Cholla Boulevard: Overton Road to Tangerine Road.

On January 4, 2017, the Town of Oro Valley approved Resolution No. (R)17-01, authorizing and approving an amendment to the Intergovernmental Transportation Funding Agreement between the Regional Transportation Authority and the Town of Oro Valley in the amount of $1.8 million to finalize the roadway design and for the purchase of additional right-of-way needed in the La Cholla project from Overton Road to Tangerine Road.

On March 7, 2018, the Town of Oro Valley approved Resolution No. (R)18-10, authorizing and approving a second amendment to the Intergovernmental Transportation Funding Agreement between the Regional Transportation Authority of Pima County and the Town of Oro Valley in the amount of $15.7 million to provide construction funds.


During the development of the RTA plan, Pima County committed $5,300,000 in impact funds to the La Cholla project. Pima County used $2,120,000 of these funds in Phase I of the La Cholla project (Magee Road to Overton Road). On August 20, 2018, Pima County and the RTA approved an IGA to advance the remaining $3,150,000 funds to Phase II of the La Cholla project via the RTA.  Since Oro Valley is the designated lead agency to administer the project, the RTA will transfer the County’s funds to the Town for the construction of the La Cholla Project.

On August 27, 2018, the Town received and opened four bid proposals with Hunter Contracting deemed as the successful low bidder in the amount of $20,166,337.
 
This amendment #3 will add an additional $900,000 of Town’s development impact funds to the project and allow the RTA to pay the County's $3,150,000 in development impact fee contribution to the Town of Oro Valley. The increase in the Town’s contribution along with the funding sources identified in Exhibit A provide the necessary resources to fully fund the project through the construction phase.

 
FISCAL IMPACT:
The RTA will provide construction funds in the amount of $16,700,000, Pima County at $3,150,000 and Oro Valley at $1,700,000.
 
The breakdown of total project funding responsibilities are as follows:
  • The RTA - $16,700,000  (includes $3,800,000 for design and right of way)
  • PAG - $3,860,000 (12.6% funding in Exhibit A)
  • Pima County - $3,150,000
  • Oro Valley - $1,700,000
Total Project funding $25,440,000

The increased Town contribution still leaves the Town with a sufficient development impact fee fund balance to address other projects and needs.
SUGGESTED MOTION:

I MOVE to (approve / deny) Resolution No. (R)18-39, authorizing and approving amendment No. 3 to the Intergovernmental Transportation Funding Agreement between the Regional Transportation Authority of Pima County and the Town of Oro Valley for the La Cholla Boulevard project.
