DISCUSSION AND POSSIBLE ACTION TO DIRECT STAFF TO INITIATE A CHANGE TO THE REPORTING STRUCTURE OF THE CHIEF OF POLICE FROM REPORTING TO COUNCIL TO REPORTING TO THE TOWN MANAGER

EXECUTIVE SUMMARY:
The issue of the Chief of Police's reporting structure is being raised. The suggested change to the reporting structure is to have the Chief of Police report to the Town Manager and not the Town Council.  Implementing this change will require staff to update Section 3-2 of the Town Code as well as update Section 6(c) of the Chief of Police's employment contract.
BACKGROUND OR DETAILED INFORMATION:
This matter was previously raised. On March 9, 2011, during a special session, the matter of the Chief of Police's reporting structure was discussed. Councilmember Snider, then Vice Mayor, brought up the issue of a conflict within the Code. Councilmember Snider discussed the issue that Town Code 3-2-3 raised. According to Town Code 3-2, the Chief of Police is appointed by and may be terminated by the Town Council, pursuant to the employment agreement. In 2007, new language was added to the Town Code that directly conflicted with the language in the Chief's employment agreement stating that the Town Manager will have "daily oversight" and that the performance evaluation will be completed by the Town Manager, not the Town Council. That language was changed by Council in 2011 through Ordinance 11-10 which states that the "annual evaluation shall be conducted by the Council in consultation with the Town Manager". In addition, daily oversight  was removed through the language present in Ordinance 11-10.   Should the Council direct to do so, changes to the Town Code and the employment agreement will need to be made to correct the changes in the reporting structure.

SUGGESTED MOTION:
I MOVE to direct staff to initiate any necessary changes to have the Chief of Police report to the Town Manager rather than the Town Council.
