Resolution No. (R)13-16, Approving the lease agreement among the Town of Oro Valley, Pima County Free Library District, and Pima County for the transfer of the operating responsibility of the Oro Valley Public Library facilities to the Pima County Free Library District
RECOMMENDATION:
Staff recommends approval.
EXECUTIVE SUMMARY:
The Town of Oro Valley, Pima County, and Pima County Free Library District previously entered into an Intergovernmental agreement on April 3, 2012 concerning the transfer of operating responsibilities for the library from the Town to the District.  That intergovernmental agreement stated that the parties will enter into a lease agreement.  The lease agreement is included as Attachment 2.
BACKGROUND OR DETAILED INFORMATION:
The Town currently shares ownership of the Oro Valley Public Library building, located at 1305 W. Naranja Dr., with Pima County.  The Town also owns the underlying land, parking lots, landscaped area, and driveways surrounding the library, which are part of the Oro Valley municipal government campus. 

Historically, the library has been operated by the Town as a public library, in cooperation with Pima County and the Pima County Free Library District, which have contributed funding for capital improvements and library operations. 

The parties are entering into this agreement, as contemplated by the IGA executed on April 3, 2012, to transfer the operating responsibilities to the Pima County Free Library District.  The Lease Agreement will supersede any inconsistent provisions in the IGA with respect to the premises located at 1305 W. Naranja Drive; however, this lease Agreement is not meant to supersede or replace the current IGA.

FISCAL IMPACT:
As of January 1, 2013, and through June 30, 2013, the Pima County Free Library District will pay to the Town $2,500.00 per month for the operating expenses. 

For Fiscal Year 2013/2014 and all subsequent fiscal years, the Pima County Free Library District will pay to the Town 1/12 of the estimated Annual Premises Allowance each month. 

SUGGESTED MOTION:
I MOVE to (adopt or deny) Resolution No. (R)13-16, Approving the lease agreement among the Town of Oro Valley, Pima County Free Library District, and Pima County for the transfer of the operating responsibility of the Oro Valley Public Library facilities to the Pima County Free Library District.
