PUBLIC HEARING: ORDINANCE NO. (O)13-04, EXTENDING AND INCREASING THE CORPORATE LIMITS OF THE TOWN OF ORO VALLEY, ARIZONA, PURSUANT TO THE PROVISIONS OF ARIZONA REVISED STATUTES, TITLE 9, CHAPTER 4, ARTICLE 7, AND AMENDMENTS THERETO, BY ANNEXING A CERTAIN TERRITORY CONTIGUOUS TO THE EXISTING LIMITS OF THE TOWN OF ORO VALLEY KNOWN AS THE ORACLE / INA ANNEXATION AREA
RECOMMENDATION:
Staff recommends approval.
EXECUTIVE SUMMARY:
The Oracle / Ina Annexation Area includes approximately 107 acres of unincorporated territory located between Chapala Drive to the north, Ina Road to the south, Paseo Del Norte to the west and Oracle Road to the east.

In accordance with A.R.S. § 9-471, the Town initiated annexation proceedings on March 21, 2012 by filing a blank annexation petition, accurate map and legal description of the property with the Pima County Recorder. A required Public Hearing was held April 18, 2012.

The Town conducted an extensive outreach program with residents, businesses and property owners in the annexation area. More than 50% of property owners, representing more than 50% of the assessed valuation of real and personal property in the Oracle / Ina Annexation Area, have signed a petition in support of annexation.

The Town has filed the map, legal description and signed petitions with the Pima County Recorder. Upon adoption of this Ordinance the Town Clerk will send a copy of the adopted Ordinance to the Chair of the Pima County board of Supervisors. The annexation will become final thirty days after adoption of the Ordinance.
BACKGROUND OR DETAILED INFORMATION:
The Oracle / Ina Annexation Area includes 37 owners of real and personal property subject to taxation by the Town, as shown in the last assessment of the property by the Pima County Assessor and the Arizona Department of Revenue. This includes: 11 residential real property owners, 11 commercial and non-profit real property owners, 13 business personal property owners, and 2 utility personal property owners.

Our outreach efforts resulted in support from 7 of 11 residential real property owners, 6 of 11 commercial and non-profit real property owners, and 7 of 13 business personal property owners. The following is a partial list of real and personal property owners who have signed a petition in support of annexation into the Town: Greater Oro Valley Chamber of Commerce, Southern Arizona Arts and Culture Alliance, Bank of the West, CH Robinson, Southern Az Endodontics, Desert Star Addiction Recovery Center, Country Financial Services, Sun Dental, St. Odilia Catholic Community, Quality Inn & Suites and Tohono Chul Park.
FISCAL IMPACT:
The Oracle / Ina annexation will have a positive fiscal impact on the Town. Additional revenue will be generated from retail sales tax, bed tax, utility sales tax, Stormwater Utility fees, permits and business licenses. Additional expenditures are primarily due to operations and maintenance costs for additional roadways including Paseo del Norte, Chapala, and Northern Avenue. A significant capital expenditure is anticipated in FY 2014/15, for the reconstruction of Northern Avenue. Although the Town will not have jurisdiction over the entire Oracle / Ina intersection, it is anticipated that the Town will assume primary responsibility for incident response in this area. Additional personnel are not budgeted at this time.

SUGGESTED MOTION:
I MOVE to (adopt or deny) ORDINANCE NO. (O)13-04, EXTENDING AND INCREASING THE CORPORATE LIMITS OF THE TOWN OF ORO VALLEY BY ANNEXING A CERTAIN TERRITORY CONTIGUOUS TO THE EXISTING LIMITS OF THE TOWN OF ORO VALLEY KNOWN AS THE ORACLE / INA ANNEXATION AREA.
