  Motion by Member Chris Rolenc, second by Member Paul Curtiss to recommend the Village Board of Trustees adopt an ordinance approving the PID Planned Infill Development Overlay Zoning District for Chick-Fil-A.

Consideration of a recommendation to the Village Board on the request of LANNON STONE PRODUCTS to obtain a Conditional Use Permit allowing the construction of an unpaved mine haul road crossing the Fox River and the permanent storage of overburden on the land located at N64 W19356 Mill Road in the A-1 Agricultural, Floodway, Flood Fringe, Shoreland Wetlands, and CW-1 Conservancy Wetlands Zoning Districts.

Public hearing on a recommendation to the Village Board on the request of MILWAUKEE BASEBALL ACADEMY to obtain a Conditional Use Permit allowing an indoor recreation facility at the property owned by Nicolet Equities LLC located at N83 W13250 Leon Road, on the parcel identified by Tax Key Number 47.999.002, in the I-1 Light Industrial Zoning District.

Consideration of a recommendation to the Village Board on the request of MILWAUKEE BASEBALL ACADEMY to obtain a Conditional Use Permit allowing an indoor recreation facility at the property owned by Nicolet Equities LLC located at N83 W13250 Leon Road, on the parcel identified by Tax Key Number 47.999.002, in the I-1 Light Industrial Zoning District.
  Motion by Member Chris Rolenc, second by Member Paul Curtiss to recommend the Village Board of Trustees grant a Conditional Use Permit allowing a year-round youth baseball training facility within a building located in the I-1 Light Industrial District, subject to the following conditions:
  1. This Permit shall become effective upon the execution and recording by the owners of the Premises of an acceptance hereof in such form as to constitute an effective covenant running with the land.
  2. This Permit shall be void unless, pursuant to the Zoning Code of the Village, Building and Zoning Use Permits in conformity to this Permit, are obtained within six (6) months of the date hereon, the date on which the Conditional Use Permit was granted.
  3. This Permit is subject to amendment and termination in accordance with the provisions of the Zoning Code of this Village.
  4. Construction and operation of the use granted shall be in strict conformity to the approved site, building and operation plans filed with the Village Board in connection with the Petition for this Permit.
  5. The conditional use and structure are in accordance with the purpose and intent of this Ordinance, and is found to be not hazardous, harmful, offensive or otherwise adverse to the environment or the value of the neighborhood or the community.
  6. All site, and building modifications shall be completed in strict conformity to the approved plans.
  7. Hours of operation shall be limited to between 9:00 a.m. and 10:00 p.m.
  8. All baseball activities shall be conducted within the leased building space.

Consideration of a recommendation to the Village Board on the request of LISBON SENIOR APARTMENTS LLC to grant a Conditional Use allowing a senior apartment building on the North side of Lisbon Road approximately ¼ mile East of Lannon Road, on the property identified by Tax Key Number 127.991.009.
  Motion by Member Chris Rolenc, second by Member Paul Curtiss to recommend the Village Board of Trustees grant a conditional use permit allowing the senior apartment building subject to the bulleted conditions being resolved prior to the issuance of a Building Permit, and the numbered conditions running with the Conditional Use Permit.
  • Rezoning Lot 2 of Certified Survey Map No. 11210 from the PRD Planned Residential Development District to the P-2 Institutional District.
  • Amending the Highlands at Aero Park Planned Residential Development District to remove the senior housing component and only include the 18 single family component.
  • Wisconsin DNR - NR 151 requirements must be met and a Water Resources Application (WRAPP) needs to be submitted to the Wisconsin DNR for NR 216 Permit Coverage. A copy of the DNR Certificate of Permit Coverage is to be forwarded to the Village Engineering Department prior to issuance of the Village Erosion Control Permit.
  • The site will need to be analyzed for stormwater infiltration per Wisconsin DNR Technical Standard 1002 of the NR 151 guidelines.
  • Stormwater management meeting the Village's stormwater ordinance must be provided for the development.
  • A Village Stormwater Permit is required. The Stormwater Permit Application must be submitted with the permit review fee as required by the Village's stormwater ordinance.
  • A Village Erosion Control Permit is required.
  • A geotechnical study will have to be done by a licensed soils engineer to determine the high seasonal groundwater elevations. Basement or lowest floor elevations will have to be kept at least 3 feet above the high seasonal groundwater elevations to comply with Village code.
  • Landscaping around the detention ponds shall comply with the Village Landscape Design Guidelines.
  • Permitting from the Waukesha County Department of Public Works is required for the access onto Lisbon Road (CTH “K”).
  • The Developer shall construct a multi-use asphalt path along their Lisbon Road (CTH “K”) frontage, and within the right of way in front of the residences located at N48W19978, N48W19950, N48W19902, and N48W19750 Lisbon Road.
  • The Developer shall install 16” water main along Lisbon Road up to the furthest easterly property line of the development site extended at Lisbon Road.
  • The Developer shall install sanitary sewer in easements to provide service to the four adjacent single family properties.
  • All sanitary sewer, water main, and storm sewer design must follow the Village of Menomonee Falls Standards and Requirements for Development.
  • A Development Agreement will have to be entered into, approved by the Village Board, and signed prior to utility construction.
  • A Letter of Credit or other financial guarantee must be provided in accordance to the development agreement prior to utility construction.
  • Further engineering review is needed once detailed utility, street, grading and stormwater management plans are submitted.
  • A planting screen at least 15 feet in depth and at least six feet high (or otherwise approved by the architectural control board) shall be placed along the boundary of all residential districts.
  • All parking areas shall be visually screened from adjacent roadways.
 
And the following conditions running with the permit:
 
  1. This Permit shall become effective upon the execution and recording by the owners of the Premises of an acceptance hereof in such form as to constitute an effective covenant running with the land.
  2. This Permit shall be void unless, pursuant to the Zoning Code of the Village, Building and Zoning Use Permits in conformity to this Permit, are obtained within six (6) months of the date hereon, the date on which the Conditional Use Permit was granted.
  3. This Permit is subject to amendment and termination in accordance with the provisions of the Zoning Code of this Village.
  4. Construction and operation of the use granted shall be in strict conformity to the approved site, building and operation plans filed with the Village Board in connection with the Petition for this Permit.
  5. The conditional use and structure are in accordance with the purpose and intent of this Ordinance, and is found to be not hazardous, harmful, offensive or otherwise adverse to the environment or the value of the neighborhood or the community.
  6. The parking and driveway areas shall be paved with asphalt or concrete.
  7. Areas not used for parking or drives shall be landscaped according to the plan approved by the Architectural Control Board and shall be neatly maintained at all times.
  8. Building and landscaping shall be completed in strict conformity with the plans approved by the Architectural Control Board.
  9. There shall be no outside storage of new or used equipment, materials or merchandise other than screened areas for the storage of refuse containers approved by the Architectural Control Board.
  10. Snow shall be stored in a manner that does not adversely impact abutting properties.
  11. Deliveries shall be prohibited between the hours of 10:00 P.M. and 7:00 A.M.

  6. The day care center may operate between 6:30 A.M. to 5:30 P.M., Monday through Friday, and closed on Saturday and Sunday.
  7. The Architectural Control Board review and approval of site and building plans with special emphasis being placed on the landscaping and fencing between the building and play areas and the residential area to the east.
  8. There shall be no outside storage of new or used equipment, materials or merchandise.
  9. The building, landscaping and screening shall be maintained in strict conformity to the plans approved by the Architectural Control Board. Any deviation in color, material, or architectural detail shall be returned to the Architectural Control Board for re-approval.

Consideration of a recommendation to the Village Board of Trustees on the request of UNITED FINANCIAL GROUP, INC. to amend Ordinance No. 633-O-15 modifying the HIGHLANDS AT AERO PARK PLANNED RESIDENTIAL DEVELOPMENT (PRD). The development is located on the North side of Lisbon Road approximately ¼ mile East of Lannon Road, in the Southwest 1/4 of Section 32, Tax Key Number 127.991.008, PRD Planned Residential Development District.
  Motion by Member Chris Rolenc, second by Member Anthony Ash to recommend the Village Board of Trustees adopt an ordinance modifying the Highlands at Aero Park Planned Residential Development to pertain to the single family lots and senior townhomes.

Consideration, deliberation and a possible decision on the request of TRICITY NATIONAL BANK to obtain a sign exception allowing the bank to increase the total allowed sign face square footage of an existing legal non-conforming monument sign. The subject property is located at N96 W18221 County Line Road.
  No action is required at this time as a mandatory public hearing has been scheduled for the October 8, 2019 Plan Commission meeting.
             

Consideration, deliberation and a possible decision on the request of ORANGETHEORY FITNESS to obtain a sign exception allowing the fitness studio to exceed the allowable number of wall signs.  The subject property is located at W180 N9460 Premier Lane.
  No action is required at this time as a mandatory public hearing has been scheduled for the October 8, 2019 Plan Commission meeting.
             

Consideration of preliminary and final approval of a Certified Survey Map splitting lands owned by FR INVESTMENT PROPERTIES LLC located on the Southeast corner of Pilgrim Road and Shawn Circle, identified by Tax Key Number 103.985.009, I-1 Light Industrial District.
  Motion by Member Chris Rolenc, second by Member Anthony Ash to grant Preliminary and Final approval of the Certified Survey Map, subject to the following conditions:
  1. If approved, the applicant shall pay the Fee in Lieu of Dedication ($1,000) and recording fees ($10 per page) prior to recording.
  2. The name and address of the owner shall be added to the first page of the Certified Survey Map.
  3. The following note shall be added to the Certified Survey Map:
All electric, telephone, and communication distribution lines and laterals including CATV cables, constructed after the recording of this Certified Survey Map shall be placed underground.
  1. A small scale drawing showing the orientation of the subject lands within the section the Certified Survey Map is located in shall be added to the first page.
  2. The general heading of the Certified Survey Map shall be revised to begin “Being a division of…”, and the reference to the Northeast Quarter of the Southwest Quarter shall be removed.
  3. The revised heading noted in Condition No. 6 shall be added to each page of the Certified Survey Map.
  4. The recorded bearings and distances of all lot lines shall be shown when different than the measured bearings and distances.
  5. The identified wetlands shall be tied to an exterior property line by bearing and distance.
  6. The wetlands shown on Lot 1 shall be labeled “wetlands as scaled…” and not labeled as a wetland easement.
  7. The name of the person drafting each page shall be placed on the bottom of each page.
  8. The location of the accessory structures on Lots 4 and 5 of the Plaza Subdivision, and their setbacks shall be added to the Certified Survey Map.
  9. The coordinates of the quarter section monument shall be shown.
  10. The bearing of the quarter section line shall to be shown.
  11. A note is to be added stating ”Bearings are referenced to Grid North of the Wisconsin State Plane Coordinate System, South Zone in which the West Line of the Southwest ¼ of Section 26, Town 8 North, Range 20 East is assumed to bear North 00°02’22” West”.
  12. Pilgrim Road shall also be designated as “C.T.H. YY”.
  13. The notary statements for the owner’s certificate and mortgagee’s certificate shall be modified to specifically identify the state and county where the instruments are acknowledged.
  14. The Village Board Approval shall be removed from the Certified Survey Map.
  15. The County Approval shall be removed from the Certified Survey Map.
  16. The Township Approval shall be removed from the Certified Survey Map.
  17. The note referencing the survey and map “are in accordance with the Land Division Ordinance of the Waukesha County” shall be revised to reference the applicable regulations of the Village of Menomonee Falls.

Consideration of final approval of a land division and a recommendation to the Village Board of Trustees approving a Certified Survey Map redividing lands owned by DENNIS AND KATHLEEN REIMER located approximately ¼ mile North of Silver Spring Drive, on the parcel identified by Tax Key Number 115.999.004 and a portion of the parcel identified by Tax Key Number 115.999.
  Motion by Member Chris Rolenc, second by Member Jennifer Grant to waive the requirement of including the residual parcel within this Certified Survey Map

  Motion by Member Chris Rolenc, second by Member Paul Curtiss to grant final approval of the Land Division, and recommend the Village Board of Trustees approve the Certified Survey Map subject to the following conditions:
 
  1. The Zoning Board of Appeals granting a variance of 65.23 feet allowing a parcel in the R-1 Single Family Residential District to have a lot width of 134.77 feet instead of the minimum 200 feet required.
  2. Submitting the platting fees prior to Village Board of Trustees approval.
  3. The applicant submitting the recording fees to the Village of Menomonee Falls, or recording the Certified Survey Map and paying the fees directly to Waukesha County.

Consideration of a utility easement granted to WISCONSIN ELECTRIC POWER COMPANY over land located on the south side of the homes located on Cherokee Drive on the lands identified by Tax Key Number 9.985.024.
  Commissioner Tadda abstained from this item and left the room.
  Motion by Member Chris Rolenc, second by Member Anthony Ash to recommend the Village Board of Trustees approve the easement subject to a survey being submitted showing the exact location of the easement with a legal description upon completion of the utility relocation.
  Vote: 5 - 0 Motion Carried

Consideration of a parking lot easement granted to the VILLAGE OF MENOMONEE FALLS over land owned by TONY AND NINA SGROI and located southeast of Nino’s Italian Bakery on the land identified by Tax Key Number 11.296.
  Motion by Member Chris Rolenc, second by Member Paul Curtiss to recommend the Village Board of Trustees approve a parking lot easement over land owned by Tony and Nina Sgroi located on the land identified by Tax Key Number 11.296.
  Vote: 6 - 0 Motion Carried
             

Consideration of a utility easement granted to WISCONSIN ELECTRIC POWER COMPANY over land owned by the Village of Menomonee Falls and located on the north side of Menomonee Avenue on the west side of Main Street identified by Tax Key Number 29.998.
  Commissioner Tadda abstained from this item and left the room.
  Motion by Member Chris Rolenc, second by Member Paul Curtiss to recommend the Village Board of Trustees grant a utility easement to WISCONSIN ELECTRIC POWER COMPANY over land owned by the Village of Menomonee Falls and identified by Tax Key Number 29.998, subject to a survey being submitted showing the exact location of the easement with a legal description upon completion of the utility relocation.

Reconsideration of the August 6th action of the Plan Commission to recommend the Village Board adopt an Ordinance amending Section 122-237, renumbering Sections 122-238 and 122-239, and creating a new R-7 Single-Family Residential Zoning District as Section 122-238.
  Motion by Member Chris Rolenc, second by Member Anthony Ash to reconsider the August 6th motion regarding this matter.
  Vote: 6 - 0 Motion Carried
  Commissioner Rolenc withdrew his motion.
Commission Ash withdrew his second.

With this action, Staff stated they are withdrawing the August 6th proposal, and will be bringing forth a September 10th proposal with the next item.
             

Consideration of a recommendation to the Village Board regarding an Ordinance amending Section 122-237, renumbering Sections 122-238 and 122-239, and creating a new R-7 Single-Family Residential Zoning District as Section 122-238.
  Motion by Member Chris Rolenc, second by Member Anthony Ash to suspend Robert’s Rule of Order to allow additional input from the audience.
  Vote: 6 - 0 Motion Carried
  Matt Cudney of Veridian Homes located at N60W21555 Legacy Trail Menomonee Falls addressed the Plan Commission and stated he did not agree with the clause requiring all exterior building materials to be non-combustible.
  Motion by Member Chris Rolenc, second by Member Paul Curtiss to remove the language found under Section 122-238 (h)(3) regarding the requirements for exterior siding materials to be non-combustible.
  Vote: 6 - 0 Motion Carried
  Motion by Member Chris Rolenc, second by Member Anthony Ash to recommend the Village Board of Trustees approve an ordinance amending Section 122-237, Renumbering Sections 122-238 and 122-239, and creating a new R-7 Single-Family Residential Zoning District as Section 122-238.
