   Public hearing on a recommendation to the Village Board of Trustees for a PID Planned Infill Development Overlay Zoning District on the request of BENCE BUILD, LLC for a new industrial building for TAILORED LABEL PRODUCTS, INC. located on the parcel at the southeast corner of Good Hope Road and Flint Drive in the I-3 Office and Light Industrial Zoning District.

  ACTION ITEM
Consideration of a recommendation to the Village Board of Trustees for a PID Planned Infill Development Overlay Zoning District on the request of BENCE BUILD, LLC for a new industrial building for TAILORED LABEL PRODUCTS, INC. located on the parcel at the southeast corner of Good Hope Road and Flint Drive in the I-3 Office and Light Industrial Zoning District.
             
  Motion by Member Chris Rolenc, second by Member Paul Curtiss to recommend the Village Board of Trustees adopt the revised ordinance attached with the meeting minutes approving the PID Planned Infill Development Overlay Zoning District for Tailored Label Products.

   Public hearing on a recommendation to the Village Board of Trustees on the request of THRIVE ARCHITECTS, LLC to obtain Planned Infill Development (PID) Overlay Zoning District approval allowing an addition to an existing apartment complex owned by  APPLETON APARTMENTS, LLC. The property is located at N88 W16351 Appleton Avenue, Tax Key Numbers 37.979 and 37.978.001, C-1 Neighborhood Business District.

Consideration of a recommendation to the Village Board of Trustees on the request of THRIVE ARCHITECTS, LLC to obtain Planned Infill Development (PID) Overlay Zoning District approval allowing an addition to an existing apartment complex owned by  APPLETON APARTMENTS, LLC. The property is located at N88 W16351 Appleton Avenue, Tax Key Numbers 37.979 and 37.978.001, C-1 Neighborhood Business District.
             
  Motion by Member Chris Rolenc, second by Member Paul Curtiss to recommend the Village Board of Trustees adopt the revised ordinance attached to these minutes approving the PID Planned Infill Development Overlay Zoning District for the Appleton Avenue Apartments.

   Conceptual review of the FALLS VENTURE LLC development proposed for the land located near the Southwest corner of Silver Spring Drive and One Mile Road on the parcel identified by Tax Key Number 125.996.002.
             
  Motion by Member Chris Rolenc, second by Member Paul Curtiss to remove the item from the table.

  PJ Burbach with the Burbach Company, 12750 W. North Ave, Ste B, Brookfield, WI 53005 was present to address the Plan Commission.

Since the item was conceptual in nature, no action was taken.
             
   Consideration of a recommendation to the Village Board of Trustees on the request of VARIN-SILVER SPRING LLC to rezone lands located at N56W21318 Silver Spring Drive from the A-1 Agricultural District to the PRD Planned Residential Development District, and create the Fox River Falls Planned Residential Development Ordinance for the same lands, located on the parcel identified by Tax Key Number 120.991.001.
             
  Motion by Member Chris Rolenc, second by Member Paul Curtiss to remove the item from the table.

  Vote: 5 - 0 Motion Carried
  David Nankin, 430 Park Street 2A, Highland Park, IL 60035 and Brian Randall with Davis Kuelthau Attorneys at Law, 111 East Kilbourn Avenue, Suite 1400, Milwaukee, Wisconsin 53202 were present to address the Plan Commission.
             
  Motion by Member Chris Rolenc, second by Member Paul Curtiss approve the attached Ordinance rezoning all lands on the subject parcel to the Planned Residential Development (PRD) District, except for those areas presently located in the Floodfringe District, and creating the Fox River Falls Planned Residential Development.


  Vote: 5 - 0 Motion Carried
             
   APPEARANCES
             
   Consideration of preliminary and final approval of a Certified Survey Map combining two parcels located at N71W13100 and N71W12976 Appleton Avenue at the request of FEW FALLS, LLC.  The subject lands are identified by Tax Key Numbers 93.967 and 93.969.
 
             
  Motion by Member Chris Rolenc, second by Member Paul Curtiss to grant preliminary and final approval of the Certified Survey Map subject to the following conditions:
  1. All special assessments shall be paid in full prior to the recording of the Certified Survey Map.
  2. The Certified Survey Map shall be revised to show the locations of all existing easements over the subject lands.
  3. A municipal sidewalk easement shall be provided to cover the existing sidewalk and node at the northwest corner of the site. The sidewalk easement shall be in the Village’s standard easement format and recorded with the Waukesha County Register of Deeds.
  4. The applicant shall submit the recording fee ($10 per page) to the Village of Menomonee Falls, or record the final executed document with the Waukesha County Register of Deeds.

   Consideration of a recommendation to the Village Board of Trustees on the request of WEAS DEVELOPMENT to obtain Planned Infill Development (PID) Overlay Zoning District approval for a mixed-use development southeast corner of Appleton Avenue and Good Hope Road, Tax Key Numbers 93.967, 93.969, and 93.973, in the I-3 Office and Light Industrial and C-1 Neighborhood Business Zoning Districts.
  Doug Weas with Weas Development, 172 N Broadway, Milwaukee, WI 53202 was present to address the Plan Commission.

However, since public hearings are mandatory for all PID projects, no action is required as the public hearing is scheduled for the August 3, 2021 Plan Commission meeting.
             
   Consideration of preliminary and final approval of a land division, and a recommendation to the Village Board of Trustees regarding a Certified Survey Map redividing lands owned by the VILLAGE OF MENOMONEE FALLS.  The Certified Survey Map is located on the north side of Menomonee Avenue, approximately 1/2 mile west of Main Street, on the parcels identified by Tax Key Numbers 29.998 and 30.999.
             
  Motion by Member Chris Rolenc, second by Member Paul Curtiss grant preliminary and final approval of the land division, and recommend the Village Board of Trustees approve the Certified Survey Map subject to the following conditions:
  1. The name and address of the property owner shall be added to the first page.
  2. The location of Main Street shall be added to the first page.
  3. The name of the person who drafted each page shall be placed at the bottom of each page.
  4. The Surveyor's Certificate shall be revised to correct the reference to Chapter 94 of the Village Code instead of Chapter 18.
  5. The Owner's Certificate shall be revised to read:
Village of Menomonee Falls, a municipal corporation, duly organized and existing under and by virtue of the laws of the State of Wisconsin, as owner, certifies that said corporation caused the land described on this map to be surveyed, divided, dedicated, and mapped as represented on this map in accordance with the requirements of the Ordinances of the Village of Menomonee Falls and Chapter 236 of the Wisconsin Statutes.

  1. The following note shall be added to the first page:
All electric, telephone, and communication distribution lines and laterals including CATV cables, constructed after the recording of this Certified Survey Map shall be placed underground.
  1. The location of the silo must be shown on the CSM with its distance shown to the property lines, or a note shall be placed on the CSM stating the silo is to be removed.

   Consideration of a recommendation to the Village Board of Trustees on the request of WESTRIDGE BUILDERS to rezone the land located at N48W20275 Lisbon Road from the A-1 Agricultural District to the R-3 Single Family Residential District.  The subject lands is identified by Tax Key Number 127.994.
             
  Motion by Member Chris Rolenc, second by Member Paul Curtiss to waive the 30 day waiting period and recommend the Village Board of Trustees rezone the subject lands from the A-1 Agricultural District to the R-3 Single Family Residential District.


  Vote: 5 - 0 Motion Carried
             
   Consideration of preliminary and final approval of a land division, and a recommendation to the Village Board of Trustees regarding a Certified Survey Map redividing lands owned by TOMICH INVESTMENTS X, LLC.  The Certified Survey Map would subdivide the property located at N48W20275 Lisbon Road, identified by Tax Key Number 217.994.
             
  Motion by Member Paul Curtiss, second by Member Chris Rolenc to grant preliminary and final approval of the land division, and recommend the Village Board of Trustees approve the Certified Survey Map subject to the following conditions:
  1. The Village Board rezoning the subject lands to the R-3 Single Family Residential Zoning District.
  2. The applicant submitting the $1,000 Fee in Lieu of Dedication per Section 42-94 of the municipal code.
  3. If approved, the applicant shall record the final executed document with the Waukesha County Register of Deeds, or submit the recording fee of $10 per page to the Village of Menomonee Falls.
  4. The closest dimension from the home and barn to the right of way line and the west property line shall be provided on the Certified Survey Map.
  5. The wetlands shall be field delineated within the last 5 years, the bearing and distance of each wetland segment  added to the Certified Survey Map, and the wetland boundary tied to a property line.
  6. The location of any well on the site shall be identified on the Certified Survey Map.
  7. The third preservation restriction on page 3 of 7 shall be revised to state:  "The removal or destruction of any vegetative cover, i.e., trees, shrubs, wildflowers, sedges, grasses and the like, is prohibited, with the exception that dead, diseased, or dying vegetation and noxious weeds may be removed, at the discretion of the landowner,  and with approval from the Village of Menomonee Falls.  Silvicultural thinning upon the recommendation of a forester or naturalist and with approval from the Village of Menomonee Falls shall also be permitted."
  8. The City of Brookfield shall enter into an Intermunicipal Agreement with the Village of Menomonee Falls to assume the responsibility for the following:
  • Submitting plans for the roadway for review and installing the roadway in accordance with the submitted plans at no cost to the Village of Menomonee Falls
  • Maintaining the roadway including but not limited to pavement management, curb & gutter replacement, storm sewer, traffic regulation and snow plowing.
  • Causing to have installed the necessary stormwater pond or infrastructure to meet the Village of Menomonee Falls Ordinances and submitting the necessary reports to the Village of Menomonee Falls for review and approval.
  • Obtaining a Storm Water Permit from the Village of Menomonee Falls for any necessary stormwater infrastructure and maintaining the stormwater infrastructure in accordance with the permit.
  • Installing and paying monthly charges and maintenance for the necessary street lighting.
  1. Sanitary sewer or water main shall not be installed in the roadway dedicated as a part of this Certified Survey Map.
  2. A permit from Waukesha County shall be obtained for the road connection to Lisbon Road.
  3. Access to Lots 1 and 2 shall be restricted to Lisbon Road.
  4. The existing access for Lot 1 to Lisbon Road may continue until Westridge Drive is constructed.
  5. A note shall be added to the Certified Survey Map stating "The residential access to Lot 1 shall be removed from CTH K and connected to Westridge Drive at the completion of the public street construction."
  6. Additional right of way shall be dedicated in the Northwest corner of the Certified Survey Map per Waukesha County.

   Consideration of a recommendation to the Village Board of Trustees on the request of JAMA MENOMONEE FALLS, LLC to rezone the property located at on the vacant parcel south of Woodman's Food Market, on Leon Road, Tax Key Number 48.985.002, from the I-1 Light Industrial Zoning District to the I-1 Light Industrial Zoning District with the OC-5 Commercial Service Overlay District.
             
  Motion by Member Paul Curtiss, second by Member Chris Rolenc to waive the 30-day waiting period and recommend the Village Board of Trustees rezone the subject lands from the I-1 Light Industrial Zoning District to the I-1 Light Industrial Zoning District with the OC-5 Commercial Service Overlay District.


  Vote: 5 - 0 Motion Carried
             
   Consideration of a recommendation to the Village Board of Trustees on the request of JAMA MENOMONEE FALLS, LLC to obtain a Conditional Use Permit and Yard Adjustment, and a consideration of approval for a lighting adjustment for an AMATO HYUNDAI auto dealership, located at on the vacant parcel south of Woodman's Food Market, on Leon Road, Tax Key Number 48.985.002, I-1 Light Industrial Zoning District.
  Peter Ogorek with Perspective Design, Inc., 11525 W North Ave, Milwaukee, WI 53226 was present to address the Plan Commission and stated that they were comfortable with the proposed conditions of the Conditional Use Permit.

Since State Statutes require a public hearing to be held regarding all conditional use permits, yard adjustments, and lighting adjustments, no action is required and the mandatory public hearing is scheduled for the August 3, 2021 Plan Commission meeting.
