Food Peddlers Text Amendment

Consideration of a recommendation to the Village Board of Trustees regarding an Ordinance amending Article III of Chapter 70 of the municipal code relating to the food peddlers license and Mobile Food Vendors in the Village.
As food trucks continue to increase in popularity, their presence in the Village of Menomonee Falls has increased as well. The Village's Food Peddlers section of the Municipal Code currently does not contain langugage regulating the daily location and operation of mobile food vendors in the Village.
After reviewing language from various municipalities in Wisconsin and their methods of regulating mobile food vendors and understanding the benefits that mobile food vendors bring to a community, Staff drafted language to better regulate mobile food vendors while still providing a level of flexibility that will hopefully attract mobile food vendors to the Village. Highlights of the proposed Code amendment includes:
Restricting a mobile food vendor from locating within Village-owned property or public right-of-way without a Special Event Permit.
Permitting mobile food vendors on private property without a Special Event Permit.
Mobile food vendors associated with a Village-approved event or festival will not need a separate permit if they are located within the event boundaries and were included in the application and approval for that event.
Since the proposed amendment is not to Chapter 122 (Zoning), a public hearing is not required.
Requested Action by Commission/Committee/Board:
For the reasons expressed in this report, Staff recommends the Plan Commission recommend the Village Board of Trustees adopt the attached Ordinance.
