Subject:
Consideration of a Recommendation to the Village Board of Trustees to approve a Quit Claim Deed transferring ownership of vacated right of way from the Village of Menomonee Falls to JABLONKA INVESTMENTS LLP.  The subject land consists of the northern half of the vacated portion of Hillside Lane, located south of the parcel identified by Tax Key Number 9.985.024.
Background Information:
The Village Board took final action to vacate Hillside Lane on February 17, 2020.  A copy of the vacated right of way is attached.
 
Application Specifics:
When right of way is vacated, the ownership of the previous right of way is split between the properties adjoining either side of the old right of way.  Since the Village of Menomonee owns land on the north side of Hillside Lane, the northern half of the right of way was automatically attached to the Village owned parcel identified by Tax Key 9.985.024.
Additional Information:
Village staff sees no interest for the village to own this additional land, and is recommending the Village deed it over to the property owner to the south to be utilized in their expansion, however the following items will need to be completed to assure existing public infrastructure can be properly maintained:
  1. Jablonka Investments LLP will need to grant easements to the Village of Menomonee Falls over the municipal sanitary sewer and water main infrastructure located within the vacated right of way.
  2. A municipal access easement will need to be provided to the Village so that the Village is able to access and maintain the storm outfall and ditch along the north side of the vacated Hillside Lane.
  3. A storm sewer and drainage easement will need to be provided to the Village in case work needs to be performed to the stormwater system.
  4. Cul de sacs will need to be constructed at the ends of Industrial Avenue and Nor-X-Way Avenue, and additional right-of-way will need to be dedicated to the Village to accommodate the cul-de-sacs so that Village plows can turn around at the ends of .Industrial Avenue and Nor-X-Way Avenue.
Requested Action by Commission/Committee/Board:
Staff recommends the Plan Commission recommend the Village Board approve a quit claim deed transferring ownership of the northern half of the vacated Hillside Lane to Jablonka Investments LLP subject to the following conditions:
  1. Jablonka Investments LLP provides the Village with legal descriptions and exhibits, to the satisfaction of the Engineering and Development Department, covering municipal sewer and water infrastructure within the vacated right of way.
  2. Jablonka Investments LLP executes municipal easements over municipal sanitary sewer and water main infrastructure located within the vacated right of way.
  3. Jablonka Investments LLP provides the Village with a legal description and exhibit, to the satisfaction of the Engineering and Development Department, providing access to the storm outfall and ditch along the north side of vacated Hillside Lane.
  4. Jablonka Investments LLP executes an access easement allowing Village access to the storm system infrastructure to the north side of the vacated Hillside Lane.
  5. Jablonka Investments LLP provides the Village with a legal description and exhibit, to the satisfaction of the Engineering and Development Department, covering the storm sewer and drainage way located on the north side of the vacated Hillside Lane.
  6. Jablonka Investments LLP executes a stormwater and drainage easement over the storm sewer and drainage way located on the north side of the vacated Hillside Lane.
  7. Jablonka Investments LLP prepares documents dedicating additional right of way, to the satisfaction of the Village Engineering and Development Department, to accommodate cul-de-sacs at the ends of Industrial Avenue and Nor-X-Way Avenue.
  8. Jablonka Investments LLP constructs cul-de-sacs at the ends of Industrial Avenue and Nor-X-Way Avenue consistent with the right of way, and curb and gutter, permits.
