Consideration of a recommendation to the Village Board of Trustees on the request of BURTON & MAYER INC to obtain a Conditional Use Permit allowing 24 hour operations per day at N88W13901 Main Street, Tax Key Number 46.993, in the PDD Planned Development District No. 2.
Background Information:
Burton & Mayer Inc. is a commercial printing company that is moving from their previous location at W140N9000 Lilly Road to the facilities at N88W13901 Main Street.
Application Specifics:
The applicant has submitted a Conditional Use Permit request to allow the business to be open 24 hours per day.  According to the submitted  information Burton & Mayer would like to operate its business for 3 shifts - from 7 AM to 3 PM, 3 PM to 11 PM, and 11 PM to 7 AM.  They state the third shift crew currently consists of 2 employees, which they don't anticipate increasing.  They also state no one will be entering or exiting the building after the 11 PM shift change, or prior to the 7 AM shift change.

The use is allowed in the Planned Development District No. 2, and is consistent with the Village Comprehensive Plan; however Section 122-1025(b)(5) requires a conditional use permit for any establishment open for business for any period between the hours of 11:00 PM and 5:00 AM.

The applicant appeared before the Plan Commission on June 9, 2020 and outlined the proposed operations for the facility.
Additional Information:
The Engineering and Planning, Fire, Police, and Utilities Departments have reviewed the submitted request.
Requested Action by Commission/Committee/Board:
As long as any issues expressed during the public hearing can be resolved, Staff recommends the Plan Commission recommend the Village Board of Trustees approve the Conditional Use Permit allowing 24 hour operations subject to the following conditions:
  1. This Permit shall become effective upon the execution and recording by the owners of the Premises of an acceptance hereof in such form as to constitute an effective covenant running with the land.
  2. This Permit shall be void unless, pursuant to the Zoning Code of the Village, Building and Zoning Use Permits in conformity to this Permit, are obtained within six (6) months of the date hereon, the date on which the Conditional Use Permit was granted.
  3. This Permit is subject to amendment and termination in accordance with the provisions of the Zoning Code of this Village.
  4. Construction and operation of the use granted shall be in strict conformity to the approved site, building and operation plans filed with the Village Board in connection with the Petition for this Permit.
  5. The conditional use and structure are in accordance with the purpose and intent of this Ordinance, and is found to be not hazardous, harmful, offensive or otherwise adverse to the environment or the value of the neighborhood or the community.
  6. The proposed use shall not generate any noise, smell or sight that would be disharmonious with the surrounding neighborhood.
  7. There shall be no outside storage of new or used equipment, materials or merchandise.
