Approval of the minutes of the June 5, 2018 meeting.
  Motion by Tim Newman, second by Anthony Ash to approve the minutes of the June 5, 2018 Plan Commission meeting.
  Vote: 6 - 0 Motion Carried
             
PUBLIC HEARINGS
             
Public hearing on a recommendation to the Village Board of Trustees on the request of ALDI INC to grant a conditional use permit allowing a grocery store on lands currently owned by WOODMAN’S FOOD MARKET, INC. The subject property is located at the northwest corner of Boundary Road and Leon Road, in the Southeast ¼ of Section 12, Tax Key Number 48.985.003, I-1 Light Industrial Zoning District.
  No one asked to be heard.

Consideration of a recommendation to the Village Board of Trustees on the request of ALDI INC to grant a conditional use permit allowing a grocery store on lands currently owned by WOODMAN’S FOOD MARKET, INC. The subject property is located at the northwest corner of Boundary Road and Leon Road, in the Southeast ¼ of Section 12, Tax Key Number 48.985.003, I-1 Light Industrial Zoning District.
  Motion by Tim Newman, second by Anthony Ash to recommend the Village Board grant a conditional use permit allowing a grocery store on the noted property, subject to the listed 7 bullet points being resolved and the 8 numbered conditions running with the conditional use permit:
  • Providing color and material samples at the Architectural Control Board meeting.
  • Submitting utility plans meeting the Village of Menomonee Falls requirements prior to the issuance of a building permit.
  • Adding sampling manholes per the Village of Menomonee Falls requirements prior to the issuance of a building permit.
  • Revising the storm sewer and grading plans to conform with the Village of Menomonee Falls requirements prior to the issuance of a building permit.
  • Revising the lighting plan to conform with the Village of Menomonee Falls lighting regulations found in Section 122-651 prior to the issuance of a building permit.
  • Submitting plans stamped by a professional engineer for all retaining walls exceeding 4 feet in height prior to the issuance of a building permit.
  • Revising the site plan to identify the location of a bicycle rack providing space for a minimum of 6 bicycles, and all other modifications required by the Village Board prior to the issuance of a building permit.
  1. This Permit shall become effective upon the execution and recording by the owners of the Premises of an acceptance hereof in such form as to constitute an effective covenant running with the land.
  2. This Permit shall be void unless, pursuant to the Zoning Code of the Village, Building or Occupancy and Zoning Use Permits in conformity to this Permit, are obtained within six (6) months of the date hereon, the date on which the conditional use Permit was granted.
  3. This Permit is subject to amendment and termination in accordance with the provisions of the Zoning Code of this Village.
  4. Construction and operation of the use granted shall be in strict conformity to the approved site, building and operation plans filed with the Village Board in connection with the Petition for this Permit.
  5. The conditional use and structure are in accordance with the purpose and intent of this Ordinance, and is found to be not hazardous, harmful, offensive or otherwise adverse to the environment or the value of the neighborhood or the community.
  6. All site, building and landscaping shall be completed in strict conformity to the plans approved by the Architectural Control Board. Any deviation in color, material, landscaping, or architectural details shall be returned to the Architectural Control Board for re-approval.
  7. There shall be no outside storage of new or used equipment, materials, or merchandise. Vehicles used for parts salvage shall not be permitted on site at any time.
  8. All shopping carts shall be removed from the parking lot at the end of each day and stored within the approved shopping cart storage enclosures.
  Vote: 6 - 0 Motion Carried

Reconsideration of a recommendation to the Village Board of Trustees on the request of JOHN BASSLER to rezone multiple parcels located at the northeast corner of the Pilgrim Road and Kings Highway intersection, directly south of the former Walmart Neighborhood Market building, from the R-4 Single Family Residential Zoning District to the R-6 Single Family and Two Family Residential District.  The subject land is located in the Northwest ¼ of Section 11, and identified by Tax Key Numbers 42.983.003, 42.983, 42.983.002, 42.981, 42.982, 42.983.001, 42.984.001, and 42.984.
  The applicant has withdrawn the request.
 
No action taken.
             

Reconsideration of a recommendation to the Village Board of Trustees on the request of DENNIS AND KATHLEEN REIMER to rezone several parcels located on Lannon Road approximately a ¼ mile north of Silver Spring Road, from the A-1 Agricultural Zoning District to the R-1 Single Family Residential Zoning District.  The subject land is located in the Northwest and Southwest ¼ of Section 29, and identified by Tax Key Numbers 114.997.006, 115.999.003, 115.999.004, 115.999, 115.999.001, 115.999.002, 115.998, and 115.997.
  Motion by Paul Tadda, second by Anthony Ash to recommend the Village Board of Trustees modify the request and rezone only the parcels identified by Tax Key Numbers 115.999.004 and 115.999 be rezoned from the A-1 Agricultural District to the R-1 Single Family Residential District.
  Vote: 6 - 0 Motion Carried
             

Consideration of an industrial use approval request for BENCE BUILD, LLC to construct a building on Stratton Circle and Old Orchard Road, directly north from Briggs and Stratton Corporation, in the Northeast ¼ of Section 12, Tax Key Number 48.996.003, I-1 Light Industrial District.
  Motion by Tim Newman, second by Anthony Ash to grant industrial use approval for the 56,655 square foot industrial building at the northeast corner of Old Orchard Rd and Stratton Drive, subject to the following conditions:
  1. Meeting Wisconsin DNR - NR 151 requirements and a Notice of Intent (NOI) needs to be submitted to the Wisconsin DNR for NR 216 Permit Coverage. A copy of the DNR Certificate of Permit Coverage is to be forwarded to the Village Engineering Department prior to issuance of the Village Erosion Control Permit.
  2. Obtaining a Village Erosion Control Permit.
  3. Installing a sampling manhole on the sanitary lateral at the easement line.
  4. Utilizing the existing 6” water service stubbed out to the parcel off of Stratton Circle. If this existing service is not used it must be abandoned and capped at the main per Village Water Utility requirements.
  5. Installing gate valve on the water service at the road right-of-way line.
  6. Submitting a detailed plan for the modified median area including saw-cut limits, spot elevations and associated storm sewer.
  7. Submitting a revised stormwater plan. The relocation of existing catch basin structures will not be permitted. New structures must be provided for the proposed catch basins.
  8. Obtaining a Village Road Cut Permit prior to any utility construction or excavation within the public road right-of-way or easement areas.
  9. Obtaining a Village Driveway permit meeting Village Specifications for the driveway approaches.
  10. Widening the north driveway approach to accommodate the turning movements of trucks with semi-trailers.
  11. Obtaining a Village Curb and Gutter/ Curb Cut Permit prior to the removal and replacement of any curb and gutter.
  12. Submitting a grading plan with additional details showing proposed contour lines along the north edge of the parking lot to show how the proposed grades will match into existing.
  13. Submitting an electronic copy of the final plans in pdf file format.
  14. Completing the site, building, and landscaping in strict conformity to the plans approved by the Architectural Control Board.  Any deviation in color, material, landscaping, or other architectural detail shall be returned to the Architectural Control Board for re-approval.
  15. The site shall be neatly maintained at all times.
  16. There shall be no outside storage of new or used equipment, materials or merchandise.
  17. Installing a bike rack on the site meeting the requirements of Section 122-719 of the municipal code.
  18. Prior to the issuance of a building permit, the applicant shall:
  • Submit an accurate survey showing the proposed building and parcel.
  • Obtain the Engineering Departments approval of the detailed utility and grading plans.
  • Pay all applicable Sewer, Water and Fire Impact Fees.
  Vote: 6 - 0 Motion Carried
             

Consideration of approval on the request of SAINT ANTHONY’S CONGREGATION to obtain a parking adjustment for a redesign and reconstruction of their parking lot located at N74W13604 Appleton Avenue.  The subject land is further identified by Tax Key Number 51.995, in the Southwest ¼ of Section 13, and located in the P-2 Institutional Zoning District.
  Motion by Tim Newman, second by Anthony Ash to grant a 33 parking stall adjustment, allowing St. Anthony’s Congregation to provide 356 parking stalls instead of the 389 parking stalls required in Section 122-716 of the municipal code, subject to the following conditions:
  1. Submitting plans for Architectural Control Board review and approval prior to any working beginning.
  2. Submitting stormwater plans to be approved by the Engineering Department and MMSD and applying for and obtaining a stormwater permit.
  3. Adhering to and meeting any conditions provided by the Engineering Department, Fire Department, or Director of Utilities.
  Vote: 6 - 0 Motion Carried
             

Consideration of preliminary and final approval of a land division dividing land owned by WOODMAN’S FOOD MARKET, INC. generally located at the northwest corner of Leon Road and 124th Street, in the Southeast 1/4 of Section 12, Tax Key Number 48.985.001, I-1 Light Industrial District with the OC-5 Commercial Service Overlay District.
  Motion by Tim Newman, second by Anthony Ash to grant preliminary and final approval of the Certified Survey Map subject to the following conditions:
  1. Recording a document placing a sidewalk easement over 943 square feet of existing sidewalk constructed on Lot 2 of Certified Survey Map No. 10725.
  2. Adding the following note to the face of the Certified Survey Map:“All electric, telephone, and communication distribution lines and laterals including CATV cables, constructed after the recording of this Certified Survey Map shall be placed underground.”
  3. Adding the location of the fuel canopy, and its setbacks to the property lines, on Lot 3 of the Certified Survey Map.
  4. Adding the location of all placed and found monuments to the Certified Survey Map.
  5. Either correcting the lengths of all segments on the submitted Certified Survey Map to correspond to the lengths of Certified Survey Map No. 10725, or adding the “recorded as” dimensions on the submitted Certified Survey Map.
  6. Removing the Village Board Approval from the submitted Certified Survey Map.
  Vote: 6 - 0 Motion Carried
             

Consideration of preliminary and final approval of a land division redividing lands owned by BRENT T. & L. MELISSA BOETTCHER AND TODD G. FOX.  The lands are generally located between Fond du Lac Avenue and Country Club Court, In the Northeast ¼ of Section 13, Tax Key Numbers 49.054.001 and 49.054.002, PRD Planned Residential Development District.
  Motion by Tim Newman, second by Anthony Ash to grant preliminary and final approval of the Certified Survey Map subject to the following conditions:
  1. Correcting the chord length of Curve “C1”, or adding the “recorded as” dimension on the Certified Survey Map.
  2. Adding the following note to the face of the Certified Survey Map:“All electric, telephone, and communication distribution lines and laterals including CATV cables, constructed after the recording of this Certified Survey Map shall be placed underground.”
  3. The land surveyor stamping, dating and signing each page of the Certified Survey Map.
  4. Adding a ratio and graphic scale to the face of the Certified Survey Map.
  Vote: 6 - 0 Motion Carried
