Village President, David Glasgow, called the meeting to order at 6:43 p.m. The Pledge of Allegiance was recited.

PUBLIC HEARING
             
Public Hearing to consider the Plan Commission's recommendation regarding the request of Aldi Inc to rezone lands currently owned by Woodman’s Food Market, Inc from the I-1 Light Industrial Zoning District to the I-1 Light Industrial Zoning District with the OC-5 Commercial Service Overlay. The subject property is located at the northwest corner of Boundary Road and Leon Road, in the Southeast ¼ of Section 12, and identified by Tax Key Number 48.985.003
Director of Community Development Matt Carran presented on the public hearing topic.

Village President Glasgow opened the public hearing for comment. The following individual spoke at the public hearing. 
  • Ray Acosta, W132N6659 West View Drive - stated that there are too many grocery stores in the village. He is concerned about competition.
There was no one else who wished to speak. The public hearing was closed.

Action Item: 

Ordinance Rezoning Lands currently owned by Woodman's Food Market
  Motion by Trustee Paul Tadda, second by Trustee Katie Kress to adopt an ordinance rezoning lands currently owned by Woodman’s Food Market, Inc from the I-1 Light Industrial Zoning District to the I-1 Light Industrial Zoning District with the OC-5 Commercial Service Overlay, as recommended by the Plan Commission at the June 5, 2018, meeting. The subject property is located at the northwest corner of Boundary Road and Leon Road, in the Southeast ¼ of Section 12, and identified by Tax Key Number 48.985.003.  (Ordinance No. 724-O-18)

  Motion by Trustee Paul Tadda, second by Trustee Katie Kress to approve the request of Stanley Drive LLC to grant a conditional use permit to allow an auto body collision shop and outdoor storage of equipment related to the operations of a landscape business, subject to two conditions being reconciled prior to the placement of any equipment, machinery, vehicles, etc. in the back area of the property and 12 conditions running with the permit recommended by the Plan Commission at the June 5, 2018, meeting, and further subject to two conditions recommended by the Architectural Control Board at the June 26, 2018, meeting.  The subject property is located at N60W16230 Kohler Lane, and identified by Tax Key Number 105.999.003.

  Motion by Trustee Paul Tadda, second by Trustee Katie Kress to approve the request of Independent Scholastic Association Inc. to amend Conditional Use Permit No. 3-22-96-D, allowing Aquinas Academy the ability to construct a new building on their school campus located at N72W15935 Good Hope Road, on a parcel identified by Tax Key Number 85.997.004, subject to the 17 conditions being reconciled prior to the issuance of a building permit and nine conditions running with the permit recommended by the Plan Commission at the May 8, 2018, meeting, further subject to the seven conditions recommended by the Architectural Control Board at the June 26, 2018, meeting.

Request of Dennis and Kathleen Reimer to rezone several parcels located on Lannon Road approximately a ¼ mile north of Silver Spring Road
  Motion by Trustee Paul Tadda, second by Trustee Katie Kress to modify the petition of Dennis and Kathleen Reimer and adopt an ordinance to rezone the lands identified by Tax Key Numbers 115.999.004 and 115.999 located at W204N5948 and W204N5080 Lannon Road from A-1 Agricultural Zoning District to the R-1 Single Family Residential Zoning District.  At its meeting on July 10, 2018, the Plan Commission unanimously recommended the Village Board modify the request and rezone only the parcels identified.  (Ordinance No. 725-O-18)

  Motion by Trustee Jeremy Walz, second by Trustee Randy Van Alstyne to approve a resolution approving an Offer to Purchase dated June 11, 2018 as modified by Counter-Offers dated June 18, 2018 and June 22, 2018 for Village-owned property of a vacant and undeveloped parcel located on the East side of Russell Court, identified as Lot 1 of Certified Survey Map 11687 and as Tax Key MNFV0135996005.  (Resolution No. 1203-R-18)

CLOSED SESSION
             
Village President Glasgow announced that the Village Board would be convening into closed session in the Administrative Conference Room, Room #2244.
  Motion by Trustee Jeremy Walz, second by Trustee Katie Kress to convene into closed session in the Administrative Conference Room (Room #2244) under Wisconsin Statutes §19.85(1)(e) and (1)(g) to confer with the Village Manager, Assistant Village Manager, Village Attorney, Assistant Village Attorney and Village staff regarding the litigation strategy to be adopted by the Village in United States Cellular Operating Company, LLC v. Village of Menomonee Falls, Waukesha County Case No. 18-CV-110.
  Vote: 5 - 0 Motion Carried
             
Reconvene into Open Session pursuant to Wisconsin Statutes §19.85(2) and return to Village Board Room (Room #2245) and adjourn
The Village Board recessed out of closed session at 7:45 p.m. and returned to the Board Room.
