MINUTES

Meeting called to order at 4:01 pm.

APPROVAL OF MINUTES
             
Approval of the minutes of the October 24, 2017 meeting.
  Motion by Member Keith Kolbe, second by Member Austin Moore to approve the minutes of the October 24, 2017 meeting.
  Vote: 3 - 0 Motion Carried
             

APPEARANCES
             
Consideration of a recommendation to the Village Board on the request of WIRELESS PLANNING to obtain a Conditional Use Permit allowing a wireless communications facility on the property owned by THE VILLAGE OF MENOMONEE FALLS located at W140N7501 Lilly Road, in the Southeast 1/4 of Section 14, Tax Key Number 56.996.001, R-2 Single Family Residential Zoning District.
  Todd Anderson, Wireless Planning, N64W12883 Daylilly Ct, Menomonee Falls WI 53051 was present to address the Architectural Control Board.
  Motion by Member Chris Rolenc, second by Member Austin Moore to make the following two findings:
 
  1. The site plan is architecturally functional.
  2. The exterior design proposed is not unsightly or obnoxious and is not disharmonious or so similar to existing neighboring developments that substantial depreciation of neighboring property or development will be caused by the applicant’s proposal. 
And recommend the Village Board grant the request of WIRELESS PLANNING to obtain a Conditional Use Permit allowing a wireless communications facility on the property owned by THE VILLAGE OF MENOMONEE FALLS located at W140N7501 Lilly Road, in the Southeast 1/4 of Section 14, Tax Key Number 56.996.001, R-2 Single Family Residential Zoning District, subject to the following conditions:
  1.  Ice bridges are prohibited at this site and construction plans shall reflect this.
  Vote: 3 - 0 Motion Carried
             

Consideration of a recommendation to the Village Board on the request of WIRELESS PLANNING to obtain a Conditional Use Permit allowing a wireless communications facility on the property owned by THE VILLAGE OF MENOMONEE FALLS located at N96W15885 County Line Road, in the Northeast 1/4 of Section 3, Tax Key Number 9.998.001, R-2 Single Family Residential Zoning District.

  Motion by Member Chris Rolenc, second by Member Austin Moore to make the following findings:

  1. Submitting to Staff for review and approval, a revised landscape plan that includes additional arborvitae along the east side of the fenced in area.
  2. US Cellular shall be responsible for the installation and continued maintenance of all landscaping approved in association with this Conditional Use Permit.
  Vote: 3 - 0 Motion Carried
             

Consideration of a recommendation to the Village Board of Trustees on the request of the FALLS FIRE LLC to obtain a Conditional Use Permit for the hours of operation extended until 2:30AM indoors and 11:00PM for the outdoor patios. The subject property is located at N88 W16631 Appleton Avenue, Tax Key Number 11.273, in the Southwest ¼ of Section 3, C-2 Community Business Zoning District with the OVC Village Centre Overlay.
  Dan Beyer of Dan Beyer Architects, 225 East St. Paul Avenue, Ste #303, Milwaukee, WI 53202 was present to address the Architectural Control Board.
  Motion by Member Chris Rolenc, second by Member Keith Kolbe to make the following three findings:
 
  1. The proposed project is in harmony with the recommendations of the village centre master plan and complies with sound aesthetic, urban design, historic, and architectural principles.
  2. The plan is functional and is compatible with the overall urban design of the area.
  3. The elements of the proposed application are not unsightly or obnoxious and is not disharmonious or so similar to existing neighboring developments that substantial depreciation of neighboring property or development will be caused by the applicant's proposal.
 
And recommend the Village Board of Trustees grant a Conditional Use Permit on the request of the FALLS FIRE LLC for the hours of operation to be extended until 2:30AM indoors and 11:00PM for the outdoor patios located at N88W16631 Appleton Avenue, Tax Key Number 11.273, in the Southwest ¼ of Section 3, C-2 Community Business Zoning District with the OVC Village Centre Overlay, subject to the following conditions:
 
  1. Submit to Staff for review and approval, a final lighting plan that includes fixture details and the heights and setbacks for all proposed light poles.
  2. Submitting final color and material samples to staff for review and approval.
  3. The submitted landscape plan labeled Exhibit A is approved by the Architecutral Control Board.
  Vote: 3 - 0 Motion Carried
             

Consideration of revised building and site plans associated with the positive recommendation to the Village Board of Trustees on the request of CAPRI SENIOR COMMUNITIES to obtain a Conditional Use Permit for a senior housing community proposed adjacent to the Grace Evangelical Lutheran Church.  The proposed development would be located on the South side of County Line Road between Cross View Way and the high tension power lines, in the Northeast ¼ of Section 5, Part of Tax Key Number 18.999.005, P-2 Institutional District.

  Motion by Member Chris Rolenc, second by Member Keith Kolbe to Make the following two findings:
 
  1. The plan is functional and is compatible with the overall urban design of the area.
  2. The elements of the proposed application are not unsightly or obnoxious and is not disharmonious or so similar to existing neighboring developments that substantial depreciation of neighboring property or development will be caused by the applicant's proposal.
 
And recommend the Village Board of Trustees grant the request of CAPRI SENIOR COMMUNITIES to obtain a Conditional Use Permit for a senior housing community proposed adjacent to the Grace Evangelical Lutheran Church.  The proposed development would be located on the South side of County Line Road between Cross View Way and the high tension power lines, in the Northeast ¼ of Section 5, Part of Tax Key Number 18.999.005, P-2 Institutional District, subject to the following conditions:

  2. Submitting revised elevations and renderings that address the location of downspouts and HVAC vents for staff review and approval.
  3. Submitting complete and final color and material samples for all elements to staff for review and approval.
  4. All landscape beds shall contain a minimum of 3” of hardwood mulch. Stone or gravel is a prohibited landscape material.
  5. The applicant shall return to the Architectural Control Board for review and approval as part of any future building additions.
  6. Submit final design and color samples to Staff of the retaining wall and railing along the north side of the entrance parking lot drive.
  7. If the retaining wall will be over 4 feet tall at any point, the wall shall be designed and its construction supervised by an engineer and engineered plans shall be submitted for staff review and approval.
  8. Final landscaping and hardscaping shall be submitted to staff for review and approval.
 
 
Under discussion, the motion was amended by Rolenc, second by Moore to add another condition.  The final list of conditions reads as follows:
 
  1. Submitting a lighting plan that shows the pole heights – including the bases – and setbacks for all proposed light poles to Staff for review and approval.
  2. Submitting revised elevations and renderings that address the location of downspouts and HVAC vents for staff review and approval.
  3. Submitting complete and final color and material samples for all elements to staff for review and approval.
