Chairperson Dave Glasgow called the meeting to order at 6:30 pm.

Approval of the Minutes of the September 10, 2019 meeting.
  Motion by Member Chris Rolenc, second by Member Anthony Ash to approve the minutes of the September 10, 2019 Plan Commission meeting.
  Vote: 7 - 0 Motion Carried
             
Public Hearings
             
Public hearing on the request of TRICITY NATIONAL BANK to obtain a sign exception allowing the bank to increase the total allowed sign face square footage of an existing legal non-conforming monument sign. The subject property is located at N96 W18221 County Line Road, on the parcel identified by Tax Key Number 14.996.

  Action Item:
Consideration, deliberation and a possible decision on the request of TRICITY NATIONAL BANK to obtain a sign exception allowing the bank to increase the total allowed sign face square footage of an existing legal non-conforming monument sign. The subject property is located at N96 W18221 County Line Road, on the parcel identified by Tax Key Number 14.996
  Motion by Member Chris Rolenc, second by Member Anthony Ash to grant the requested sign exception allowing a freestanding sign to have a total sign face area of 209 square feet as opposed to the maximum 60 square feet allow by right.
  Vote: 7 - 0 Motion Carried
             
Public hearing on on the request of ORANGETHEORY FITNESS to obtain a sign exception allowing the fitness studio to exceed the allowable number of wall signs.  The subject property is located at W180N9460 Premier Lane, on the parcel identified by Tax Key Number 14.980.001.

Action Item:
Consideration, deliberation and a possible decision on the request of ORANGETHEORY FITNESS to obtain a sign exception allowing the fitness studio to exceed the allowable number of wall signs.  The subject property is located at W180N9460 Premier Lane, on the parcel identified by Tax Key Number 14.980.001
  Motion by Member Chris Rolenc, second by Member Paul Curtiss to grant the requested sign exception allowing a second wall sign on the building located at W180N9460 Premier Lane subject to the removal of all unpermitted temporary signage.
  Vote: 6 - 1 Motion Carried

Consideration of preliminary and final approval of a Certified Survey Map combining lands owned by MVS HOLDINGS LLC located on the Southeast corner of the intersection of Interstate 41 and Main Street in the PDD Planned Development District No. 2.  The subject properties are identified by Tax Key Numbers 8.991, 41.997, and 41.997.001, and vacated portions of Stanley Drive.
  Bill Ohm, Cobalt Partners, 207 North Milwaukee Street, Milwaukee, WI 53202 was present to address the Plan Commission.
  Motion by Member Chris Rolenc, second by Member Anthony Ash to grant Preliminary and Final approval of the Certified Survey Map, subject to the following conditions:
  1. Adding the following note to the face of the Certified Survey Map:
“All electric, telephone, and communication distribution lines and laterals including CATV cables, constructed after the recording of this Certified Survey Map shall be placed underground.”
  1. Adding a vicinity map on the first page of the Certified Survey Map.
  2. Adding wetland boundaries with bearings and distances tied to property lines.
  3. Adding blanks for recording data.
  4. Adding “This instrument was drafted by Andrew W. Wilkowski S-3121” to pages 6-8
  5. Vacating the existing public sanitary sewer, water main and storm sewer within the vacated portion of Stanley Drive.
  6. Upon abandonment of the existing water main, the existing hydrants are to be salvaged and delivered to the Village Utilities Department.
  7. Revising the Village of Menomonee Falls Plan Commission Approval to state:

  1. The property owner understands the existing box culvert bridge is the responsibility of the owner of the property as it is considered a private driveway bridge.

Consideration of preliminary and final approval of a Certified Survey Map redividing lands owned by INDEPENDENT SCHOLASTIC ASSOCIATION, INC. D/B/A AQUINAS ACADEMY. The subject lands are located on the west side of Pilgrim Road, approximately 600 feet south of Good Hope Road, on a portion of the parcel identified by Tax Key Number 85.997.004.

  Motion by Member Chris Rolenc, second by Member Anthony Ash to waive the requirement for the residual parcel to be included with this Certified Survey Map and grant preliminary and final approval of the Certified Survey Map, subject to the following conditions:
  1. The applicant submitting the recording fees to the Village of Menomonee Falls, or recording the Certified Survey Map and paying the fees directly to Waukesha County.
  2. Adding the following blanks for recording information to the bottom of the last page:

  6. Modifying the information on each page to identify the full name of the person drafting the page.
  7. Adding the following note to the first page:
All electric, telephone, and communication distribution lines and laterals including CATV cables, constructed after the recording of this Certified Survey Map shall be placed underground.
  1. Adding the total area of the lands surveyed to the Surveyor’s Certificate.
  2. Removing the Village Board Approval Certificate.
  3. Adding a vision corner easement measuring 150 feet along the center line of Pilgrim Road and 100 feet along the center line of the private drive.
  Vote: 7 - 0 Motion Carried
             
Consideration of a recommendation to the Village Board of Trustees on the request of PAUL KOLBECK to rezone lands owned by LAWRENCE SCHMITZ from the A-1 Agricultural District to the CDD Conservation Development District. The subject property is located at N72 W18211 Good Hope Road and identified by Tax Key Number 82.999.
  Motion by Member Chris Rolenc, second by Member Anthony Ash to waive the 30 day waiting period and recommend the Village Board rezone the following lands from the A-1 Agricultural District to the CDD Conservation Development District:

Consideration of a recommendation to the Village Board of Trustees on the request of JOSEPH AND JOANNE ISCHE to rezone lands from the CW-1 Conservancy - Wetlands District to the R-3 Single Family Residential District.  The subject lands are located on the West side of Marcy Road, approximately 175 feet North of Spruce Lane, and identified by Tax Key Number 110.994.003.
  Motion by Member Chris Rolenc, second by Member Anthony Ash to waive the 30 day waiting period and recommend the Village Board of Trustees rezone Lot 3 of Certified Survey Map No. 8385 from the CW-1 Conservancy - Wetlands District to the R-3 Single Family Residential District
  Vote: 7 - 0 Motion Carried
