Meeting called to order at 6:30 pm.

APPROVAL OF MINUTES
             
Approval of the minutes of the September 12, 2017 meeting.
  Motion by Tim Newman, second by Chris Rolenc to approve the minutes of the September 12, 2017 Plan Commission meeting.
  Vote: 7 - 0 Motion Carried
             

APPEARANCES
             
Consideration of preliminary and final approval of a Land Division dividing lands located on the south side of County Line Road, approximately 2,000 feet west of Maple Road, and a recommendation to the Village Board of Trustees approving a Certified Survey Map.  The Certified Survey Map is located in the Northeast ¼ of Section 5, Tax Key Number 18.999.005, P-2 Institutional District.
  Motion by Tim Newman, second by Chris Rolenc to grant preliminary approval of the Land Division subject to addressing the Staff comments listed in October 3, 2017 Plan Commission Staff Report.
  Vote: 7 - 0 Motion Carried
             

Conceptual review regarding the Flint Drive Subdivision proposal of TOWNE REALTY INC. located near the north end of Flint Drive.  The subject parcel is located in the Northeast ¼ of Section 13, identified by Tax Key Numbers 52.992.012 and 52.992.016 and located in the I-3 Office and Light Industrial District, Floodway District, Flood Fringe District, and Shoreland-Wetlands District.
  Jim Doering of Towne Realty, INC, 710 North Plankington Avenue, Milwaukee, WI 53023 was present to address the Plan Commission.
 
Since this request is simply conceptual in nature, no action formal action was taken, however the Plan Commission stated they liked the conservancy subdivision concept.
             

Consideration of a recommendation to the Village Board of Trustees on the request of ROUNDY’S SUPERMARKET INC. to rezone land from the C-4 Suburban Retail Business District to the C-4 Suburban Retail Business District with the OC-5 Commercial Service Overlay District. The subject land is located at N77W14435 Appleton Avenue, in the Northeast 1/4 of Section 14, Tax Key Number 53.001, C-4 Suburban Retail Business District.
  Motion by Newman, second by Rolenc to deny the requested rezoning

The Plan Commission discussed the request, and the associated code amendment which has yet to be acted on by the Village Board of Trustees.
 
Commissioner Newman withdrew his motion, seconded by Rolenc.
 
No additional motion was made.  As such, the item will be placed on the November 7, 2017 Plan Commission agenda for a recommendation to the Village Board of Trustees per Section 122-59 of the Municipal Code.
             

Consideration of a recommendation to the Village Board of Trustees on the request of ROUNDY’S SUPERMARKET INC to amend Conditional Use Permit No. 8-14-09 allowing a fueling station component to the existing Pick N Save store located at N77 W14435 Appleton Avenue, in the Northeast 1/4 of Section 14, Tax Key Number 53.001, C-4 Suburban Retail Business District.
  Motion by Newman to not waive the requirement of a public hearing.
 
Since the public hearing can only be waived with a unanimous motion of the Plan Commission, a public hearing will be scheduled for the November 7, 2017 Plan Commission meeting.
             

Consideration of a recommendation to the Village Board on the request of WIRELESS PLANNING to obtain a Conditional Use Permit allowing a wireless communications facility on the property owned by THE VILLAGE OF MENOMONEE FALLS located at W140N7501 Lilly Road, in the Southeast 1/4 of Section 14, Tax Key Number 56.996.001, R-2 Single Family Residential Zoning District.
  Motion by Amack to not waive the requirement of a public hearing.
 
Since the public hearing can only be waived with a unanimous motion of the Plan Commission, a public hearing will be scheduled for the November 7, 2017 Plan Commission meeting.
             

Consideration of a recommendation to the Village Board on the request of WIRELESS PLANNING to obtain a Conditional Use Permit allowing a wireless communications facility on the property owned by THE VILLAGE OF MENOMONEE FALLS located at N96W15885 County Line Road, in the Northeast 1/4 of Section 3, Tax Key Number 9.998.001, R-2 Single Family Residential Zoning District.
  Todd Anderson of Wireless Planning, N64W12883 Daylily Court, Menomonee Falls, WI 53051 was present to address the Plan Commission.
 
Motion by Newman to not waive the requirement of a public hearing.
 
Since the public hearing can only be waived with a unanimous motion of the Plan Commission, a public hearing will be scheduled for the November 7, 2017 Plan Commission meeting.
             

Consideration of a recommendation to the Village Board of Trustees on the request of THE VILLAGE OF MENOMONEE FALLS to adopt an Ordinance amending the land use component of the Comprehensive Plan for a portion of the land located on the east side of Badger Drive, from the Park/Open Space Land Use Classification to the Low Density Residential Land Use Classification. The subject parcel is located in the northwest ¼ of Section 35, and identified by Tax Key Number 138.133.
  No action taken as a mandatory public hearing will be scheduled for the December 5, 2017 Plan Commission meeting.
             

Consideration of a recommendation to the Village Board of Trustees to rezone lands currently owned by the VILLAGE OF MENOMONEE FALLS located at the southeast corner of Belleview Boulevard and Patton Drive, from the P-1 Parks and Open Space to the R-3 Single Family Residential District. The subject parcels are located in the Northeast ¼ of Section 10, and identified by Tax Key Number 37.030.
  Motion by Tim Newman, second by Chris Rolenc to waive the requirement of waiting until the subsequent meeting, and recommend the Village Board of Trustees rezone the requested lands, legally described as Lots 1, 2 & 3 of Blk 5 of the Continuation of Edgebrook Park Subdivision, from the P-1 Park and Open Space District to the R-3 Single Family Residential District.
  Vote: 7 - 0 Motion Carried
             

Consideration of preliminary and final approval of a Land Division dividing lands generally located on the north side of Ash Drive between White Birch Drive and Cedar Ridge Lane and on Aspen Drive near Washington Avenue; and a recommendation to the Village Board of Trustees approving the Certified Survey Map located in the Southeast ¼ of Section 23, R-3 Single Family Residential District.
  Motion by Tim Newman, second by Anthony Ash to grant preliminary and final approval of the Land Division and recommend the Village Board of Trustees approve the subject Certified Survey Map subject to the following conditions:
 
 
  1. The Village Comprehensive Plan is amended to reclassify the subject lands of the Certified Survey Map for Low Density Residential Land Uses.
  2. A 30 foot wide municipal easement is approved over the 36” stormwater pipe running across Lot 2, or the stormwater pipe is relocated and an easement placed over it prior to the sale of the land.
  3. The name and address of the property owner (Village of Menomonee Falls) must be added to the first page of the Certified Survey Map.
  4. Adding the following signature lines to the Certified Survey Map:

  1. Adding a note stating recorded bearings and dimensions are shown in parentheses.
  2. Adding the location of all structures within 20 feet of the exterior boundaries on the Certified Survey Map.
  3. Identifying the dimension from Ash Drive where the lot width is 110 feet – as this will be the minimum front setback for the associated home.
  4. Correcting any discrepancies in lot areas for Outlot 1 in the 1995 Certified Survey Map and the combined area for Lot 1, Lot 2, and Outlot 1 in the proposed Certified Survey Map.
  5. Revising the Certified Survey map to identify all wetland segments, by bearing and distance, on Lot 2.
  6. Compliance with all conditions contained in the October 3, 2017 Plan Commission Staff Report from the Engineering Department.
