An Ordinance To Approve A Rezoning From PC (Planned Commercial) To PR (Planned Residential) District For 0.218 Acres Located As Parcel 1, Parcel 2 And Parcel 3 Of Part Of Parcel ID Number P70 00205 0002 On The Montgomery County Auditor’s Tax Records And Accepting The Recommendation Of The Planning Commission (ZC 19-08).

Purpose and Background
The applicant has requested a lot split of a 2.297-acre parcel to create a buffer between several residences and a commercially zoned property.  There are lots within The Oaks of Huber Heights Subdivision that have existing houses that wish to extend the rear yards.  The three new lots created will be 0.218 acres in total.  In order for these new lots to be combined with existing lots and used as residential properties, the newly split parcels are required to be rezoned to Planned Residential (PR).  The remainingr parcel will still have all proper setbacks for the Planned Commercial District (PC).  The surrounding uses at the area of the split are mostly residential, so this use fits. The owner of the commercially zoned property has no plans for any expansion of a commercial use.  Planning Commission recommended approval of the rezoning 4-0.
