A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, AUTHORIZING AND DIRECTING THE ENTERING INTO OF AN INTERGOVERNMENTAL AGREEMENT WITH MARICOPA COUNTY AND THE CITY OF SURPRISE FOR THE CONSTRUCTION, OPERATION AND MAINTENANCE OF THE TRAFFIC SIGNAL AT PEORIA AVENUE AND REEMS ROAD.

Purpose and Recommended Action
This is a request for City Council to waive reading beyond the title and adopt a resolution authorizing and directing the City Manager to enter into an Intergovernmental Agreement (IGA) with the City of Surprise, and the Maricopa County Department of Transportation (MCDOT) for cost participation for the construction, operation and maintenance of a new traffic signal at the intersection of Peoria Avenue and Reems Road.
Background
The intersection of Peoria Avenue and Reems Road is an existing four-way intersection of two arterial streets controlled with stop signs. The northeast and northwest corners are in the City of Surprise. The southwest corner is in Maricopa County. The southeast corner is in the City of Glendale. The traffic impact analysis for the RRB Beverage project, located on the Glendale corner, found that a traffic signal is warranted. The general practice for allocating the cost of a new traffic signal is twenty-five percent (25%) for each corner of the intersection.
Analysis
This IGA codifies the roles and responsibilities between the City of Glendale, City of Surprise and Maricopa County for the design, construction, maintenance and operation of the traffic signal as summarized below:
 
Responsibilities:
  • Upon the substantial completion of the Project, Glendale shall invoice the County and the City of Surprise for their proportionate share of the project.
  • Maricopa County Department of Transportation: Twenty-five percent (25%) of the net project cost with a maximum share of $75,000.
  • City of Surprise: Fifty percent (50%) of the net project cost.  In the event the net project cost exceeds $300,000, Surprise shall be responsible for sixty-two and one-half percent (62.5%) of the net project cost in excess of $300,000.
  • City of Glendale (Developer MPBCRB, LLC): Twenty-five percent (25%) of the net project cost.  In the event the net project cost exceeds $300,000, Glendale shall be responsible for thirty-seven and one-half percent (37.5%) of the net project cost in excess of $300,000.
Development Agreement Number C19-0175 specifies that the developer, MPBCRB, LLC, is responsible for the design cost and a portion of the construction cost for the traffic signal improvements at Reems Road and Peoria Avenue. The design for the signal has been completed by MPBCRB, LLC at their sole cost.

Budget and Financial Impacts:
The construction of the signal shall be completed and initially paid for by the developer.  The City will reimburse the developer for Maricopa County and Surprise’s share of the construction cost as outlined in a reimbursement agreement to be brought forward at a future City Council meeting.  Per this IGA, the City of Glendale will seek reimbursement from Maricopa County and Surprise to cover their shares of the project.
