AWARD OF RFP 19-42, CITY ZONING CODE REWRITE SERVICES AND AUTHORIZATION TO ENTER INTO A PROFESSIONAL SERVICES AGREEMENT WITH MICHAEL BAKER INTERNATIONAL, INC. FOR PROFESSIONAL PLANNING SERVICES TO UPDATE AND REWRITE THE GLENDALE ZONING ORDINANCE

Purpose and Recommended Action
This is a request for City Council to award RFP 19-42, City Zoning Code Rewrite Services; to authorize the City Manager to enter into a professional services agreement with Michael Baker International, Inc. in an amount not to exceed $450,000 over the entire term of the agreement for professional planning services to update and comprehensively rewrite the Glendale Zoning Ordinance; and to authorize the City Manager to renew the contract, at his discretion, for an additional four (4) years in one year increments. The initial term of the agreement is one (1) year and would be effective upon Council approval.
Background
The Zoning Ordinance regulates the use of private property in the City of Glendale.   It is a primary tool in implementing the City’s voter-adopted General Plan, achieving specific Economic Development objectives, and directing new development and redevelopment in the City.  The City’s existing Zoning Code was adopted in 1993 and is very much in need of updating and modernizing.  At times, the existing Code acts as a barrier to quality development proposals that do not meet certain outdated standards in the Code. 
 
Planning and Economic Development staff have for several years kept a record of problems in the zoning code including deficiencies and outdated provisions.  Staff has developed a comprehensive scope of work for updating and modernizing the Code.  The update project will be led and managed by the City’s Planning Administrator.  A local Planning Consultant, Michael Baker International, Inc. will play a primary role in the research, public outreach and formulation of the new Code. 
 
A Request for Proposal (RFP) 19-42, City Zoning Code Rewrite was issued in March 2019 and six proposals were received. A five member, multi-departmental panel evaluated and scored the proposals. The panel recommends Baker International, Inc as the most responsible and responsive proposal.
Analysis
The Glendale Zoning Code Update project will complete a comprehensive update of the 1993 Zoning Code including all zoning districts, special districts, administrative procedures, definitions and development review requirements.  The scope of work includes creating a unified Code that combines the currently separate landscape, subdivision standards and design requirements into a single volume. 
 
The writing of the Zoning Code Update will be an intensive effort during 2019 and 2020, including extensive outreach to various stakeholder groups such as Code users, business and property owners, developers and City residents.  Additionally, a technical committee will be created to address and direct the detailed technical and legal aspects of the Code.    There will be public workshops and a dedicated webpage for the Code Update project, both targeted at obtaining public comments and disseminating information about the progress of the Code Update project. 
 
  • Staff recommends entering into the agreement with Michael Baker International, Inc.
  • The agreement was reviewed and approved by the City Attorney’s Office.
  • This is a one-time expense that will be paid over three fiscal years with no on-going operating and maintenance costs.
  • Funding in the amount of $450,000 has been approved by the City Council for the project.
Community Benefit/Public Involvement
The City, residents, property owners and developers demand and deserve a comprehensive, clear set of rules and standards for land use in Glendale.  A modern Code creates certainty during the development review and entitlement process for applicants, city officials and the public. 
 
The updated Code will serve to implement the City’s voter-adopted General Plan as the provisions of the Zoning Ordinance are an important tool in achieving agreed-upon goals for land use, urban design and public participation.

Budget and Financial Impacts:
The project crosses three fiscal years, for a total not to exceed amount of $450,000.  Expenditures in FY2018-19 are approximately $15,000.  Expenditures in future years will depend upon Council approval of the annual budget appropriation
