FIRST AMENDMENT TO THE DEVELOPMENT AGREEMENT WITH 59 BUTLER LAND, LLC

Purpose and Recommended Action
This is a request for the City Council to authorize the City Manager to enter into a First Amendment to the Development Agreement between the City of Glendale and 59 Butler Land, LLC.
Background
59 Butler Land, LLC owns unimproved real property located at the southwest corner of 59th Avenue and Butler Drive and intends to develop housing units on the site, which, since 1973 has been the location of a partially abandoned subdivision and a source of blight and deleterious uses among surrounding neighborhoods.
 
On August 19th, 2019, the City of Glendale and 59 Butler Land, LLC entered into a Development Agreement C19-0745 to facilitate the development of the property.
 
Due to the Covid-19 global pandemic, 59 Butler Land LLC has requested an extension of the contract.
Analysis
59 Butler Land, LLC has already submitted plans to redevelop the site. Due to the redevelopment challenges of this site, the project will require the removal of existing electric and telephone infrastructure. Additionally, the project will include construction and maintenance of private cul-de- sac street improvements adjacent to the property, in-lieu of what has been traditional city right-of- way and all improvements will generally conform to those shown in Exhibit B (the “60th Ave Improvements”) of the original development agreement.
 
Project plans also indicate utility connections and required metering will be established for new public utility customers. Offsite improvements include removal of the landscaping in and adjacent to the 59th Avenue right of way; removal of two existing curb cuts and driveways perpendicular to 59th Avenue; relocation of a curb cut and driveway at the Butler alignment of 59th Avenue; and construction of a “pork chop” median at Evergreen Road and 59th Avenue.
 
Exhibit C (“Schedule of Performance”) of Development Agreement C19-0745 states that 59 Butler Land LLC agrees to:
  • Obtain first (temporary or final) Certificate of Occupancy for new/renovated project units before December 31, 2021.
  • Obtain Final Certificate of Occupancy for last phases(s) of project before December 31, 2023.
At the request of 59 Butler Land LLC, the amendment would extend the schedule of performance for one additional year for both line items, by deleting the language in Exhibit C and replacing it with the following:
  • Obtain first (temporary or final) Certificate of Occupancy for new/renovated project units before December 31, 2022.
  • Obtain Final Certificate of Occupancy for last phases(s) of project before December 31, 2024.
Previous Related Council Action
On August 19th, 2019, the City Council approved and entered into Development Agreement C19-0745 with 59 Butler Land LLC to facilitate the development of the property.
Community Benefit/Public Involvement
The redevelopment of this site and the provision of workforce housing units will expand current housing opportunities, and the City believes there is a significant public benefit of this infill project, including the one-time revenues from new construction, and the ongoing revenues from new property taxes.
