AUTHORIZATION TO ENTER INTO AMENDMENT NO. 3 TO THE PROFESSIONAL SERVICES AGREEMENT WITH KIMLEY-HORN AND ASSOCIATES, INC., FOR THE GLENDALE AVENUE RECONSTRUCTION (99TH AVENUE TO EL MIRAGE ROAD) PROJECT

Purpose and Recommended Action
This is a request for City Council to authorize the City Manager to enter into Amendment No. 3 to the Professional Services Agreement (C19-0350) with Kimley-Horn and Associates, Inc. in an amount not to exceed $77,962. The amendment will provide Construction Administration services for the roadway reconstruction of Glendale Avenue from 99th Avenue to El Mirage Road, and Engineering services to complete the fiber optic communication line design to serve the proposed lift station to be located on the Luke Air Force Base (AFB) wastewater treatment plant site, at the northeast corner of the Glendale Avenue and El Mirage Road intersection. The fiber optic communication line wll run from the proposed lift station to the Glendale Regional Public Safety Training Center (GRPSTC).
Background
The roadway reconstruction of Glendale Avenue from 99th Avenue to El Mirage Road is a project adopted in the FY21 Capital Improvement Plan. The intent of the project is to reconstruct the pavement and improve the roadway to accommodate the heavy vehicles and traffic loads related to the residential, commercial, industrial, and other users of Glendale Avenue. In addition to the road reconstruction, a lift station is planned for construction (separate contract) on the existing Luke AFB wastewater treatment plant site. The lift station will intercept the wastewater flows from Luke AFB and deliver the wastewater to the City of Glendale collection system at the Glendale Avenue and 99th Avenue intersection. 
Analysis
This amendment encompasses two areas of work. The first is Construction Administration services for the roadway reconstruction project. This will provide for the consultant to review material submittals and requests for information on an as needed basis, account for the consultant to attend weekly progress meetings, and assist Engineering staff with any items that need to be addressed during the construction phase. The second will be Engineering services to finalize the design of a new fiber optic communication line that will connect the proposed lift station (currently in the design phase), to the city's communication network at the GRPSTC.

Of the cost detailed above the Construction Administration services ($66,832) will be assigned to the roadway reconstruction project and the fiber optic communication line ($11,130) will be applied to the sewer force main project. At the February 9 , 2021 City Council Meeting, Council is also being requested to approve agreements with Combs Construction for the Construction along with Speedie and Associates for Materials Testing for the Glendale Ave Reconstruction Project from 99th Avenue to El Mirage Road.
Previous Related Council Action
On January 12, 2021, Council authorized entering into Contract Amendment No. 2 with Kimley-Horn and Associates, Inc., in an amount not to exceed $28,530.20 to provide legal descriptions and exhibits required for the roadway reconstruction improvements and environmental services related to the water line and sewer forcemain portion of the Glendale Avenue Reconstruction project.

On June 23, 2020, Council authorized entering into Contract Amendment No. 1 of the Construction Manager at Risk Pre-Construction Services agreement with Haydon Building Corp., in an amount not to exceed $102,675, for additional potholing services related to the water line replacement and sewer forcemain installation portion of the Glendale Avenue Reconstruction project.

On June 23, 2020, Council authorized entering into a Construction Manager at Risk agreement with Haydon Building Corp., in an amount not to exceed $6,390,310.72, for the water line replacement and sewer forcemain installation portion of the Glendale Avenue Reconstruction project.

On June 23, 2020, Council authorized entering into Contract Amendment No. 1 with Kimley-Horn & Associates for Construction Administration Services in an amount not to exceed $42,905 for the water main replacement and forcemain installation portion of the Glendale Avenue Reconstruction project.

On September 24, 2019, Council authorized entering into a Professional Services Agreement with MakPro Services, LLC in an amount not to exceed $65,200 to provide communication and outreach services, for the Glendale Avenue Reconstruction project.

On April 23, 2019, Council authorized entering into a Construction Manager at Risk Pre-Construction Services agreement with Haydon Building Corp. in an amount not to exceed $135,968 for the Glendale Avenue Reconstruction project between 99th Avenue and El Mirage Road. 

On April 23, 2019, Council authorized entering into a Professional Services Agreement with Kimley-Horn & Associates for the Glendale Avenue Reconstruction project in an amount not to exceed $805,185. The project included design services to develop construction drawings for the reconstruction of approximately 3.1 miles of  pavement, replacement of existing ACP water line with DIP, and a new sewer forcemain to serve Luke AFB.

In August 2018, the city entered into a Professional Services Agreement with Kimley-Horn & Associates in an amount not to exceed $46,942 to provide preliminary design services to develop the scope of the Glendale Avenue Reconstruction project between 99th Avenue and El Mirage Road.

Budget and Financial Impacts:
Funding for the Construction Administrative Services ($66,832) is available in the FY21 Capital Improvement Plan budget in CIPST20016 - Street Reconstruction, Glendale Avenue, 101 to El Mirage. Funding for the ITS Fiber Design ($11,130) is available in the FY21 Capital Improvement Plan budget in CIPWW20030 - .  Expenditures with Kimley-Horn & Associates, Inc. for Amendment No. 3 are not to exceed $77,962.
