A RESOLUTION OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, AMENDING THE GENERAL PLAN MAP OF THE CITY OF GLENDALE, ARIZONA, BY APPROVING GENERAL PLAN AMENDMENT GPA20-09 FOR PROPERTY LOCATED AT 7087 NORTH 45TH AVENUE.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF GLENDALE, MARICOPA COUNTY, ARIZONA, REZONING PROPERTY LOCATED AT 7087 NORTH 45TH AVENUE FROM C-2 (GENERAL COMMERCIAL) TO R-5 (MULTIPLE RESIDENCE), AMENDING THE ZONING MAP; PROVIDING FOR AN EFFECTIVE DATE; AND DIRECTING THE CITY CLERK TO RECORD A CERTIFIED COPY OF THE ORDINANCE.

Purpose and Recommended Action
This is a request for City Council to conduct a public hearing, waive reading beyond the title and adopt a resolution to approve a Minor General Plan Amendment from GC (General Commercial) to HDR-30 (High Density Residential (30 units/acre); and a zone change from C-2 (General Commercial) to R-5 (Multiple Residence) to enable the construction of a 42-unit apartment complex on 1.77 acres.  The site is located at the southeast corner of 45th Avenue and Palmaire Avenue (7087 North 45th Avenue) and is in the Cactus District. 
 
The Planning Commission conducted a public hearing regarding the request on January 7, 2021.  No one from the public attended. Staff received one (1) written comment in opposition.
The Planning Commission recommended approval of the proposal with a 7-0 vote.  There were no changes to the Staff recommendation.
 
Background
The project includes 42 units as Phase II of the Palmaire Multifamily project.  Design Review was recently completed on the Phase I portion of the project (56 units located immediately east).  As the Phase I site was already zoned R-4, no rezoning proposal was required for that portion of the site.  Each phase includes multi-story residential buildings and centralized open areas; also surrounded by perimeter parking and landscaping.  Architecture will be the same for both phases.  Access to the Phase II facility is from the southwest corner of the site along 45th Avenue.  A second internal access would also be provided from the Phase I site which opens onto Palmaire Avenue.
 
The property has been used as an open lot RV storage facility.  The site includes some surfacing and a masonry screen wall along the frontages of 45th and Palmaire Avenues but is otherwise undeveloped.  The site immediately east of this location, although currently vacant, is zoned R-4 and was recently approved for a 56-unit apartment complex as part of the Palmaire Phase I project.  The Phase II property is zoned C-2 (General Commercial). The General Plan also supports General Commercial use of the property.
 
Areas across Palmaire Avenue to the north include Glen Court Townhomes (zoned R-3). Property to the east includes the pending Palmaire Phase I multi-family project (zoned R-4).  Areas to the south include car sales (zoned C-3).  Areas across 45th Avenue to the west include a school (zoned C-3).
 
Analysis

The zoning proposal is consistent with the goals and objectives of the General Plan by providing a viable use for an infill property near existing infrastructure, enabling higher residential densities closer to jobs, shopping and services; and increases housing variety in the area.

Previous Related Council Action
The subject property was zoned C-2 with the adoption of the City zoning map.  There has been no Council action at this site.
 
Community Benefit/Public Involvement
On October 1, 2020, the applicant mailed notification letters to adjacent property owners and interested parties. A virtual (on-line) neighborhood meeting was held on October 15, 2020. No one from the public participated. One written comment in opposition was received (via email). 
 
Notice of the Public Hearing was published in The Glendale Star on December 17, 2020. Notification postcards of the Public Hearing were mailed to adjacent property owners and interested parties on December 18, 2020. The property was posted by the applicant on December 17, 2020.
