SUBJECT:
Quasi-Judicial Hearing - A hearing to allow the owners and/or parties of interest in the property identified at 323 N 14th Street to show cause why the structure located on the premises should not be condemned and demolished.
SUMMARY:
  1. The structure located at 323 N 14th Street was initially declared unsafe under the International Property Maintenance Code by Building Official Marc Meyers on 10/8/2015.
  2. No action was taken by the owner or the mortgage holder to remediate the condition of the structure.
  3. The building was inspected again on 11/30/2017 due to a 3rd fire at this location. It was again declared unsafe and condemnation for demolition proceedings under the newly adopted Rules of Procedure for Condemnation and Demolition were initiated.
  4. The owners have provided written confirmation as to having no interest in the property due to losing the property in bankruptcy.
  5. The mortgage holder has likewise relinqueshed all interest in the property.
RECOMMENDATION:
Staff recommends the City Commission approve Resolution No. 18-R09 declaring that the structure located at 434 N 14th Street be condemned and demolished in accordance with the Rules of Procedure for Condemnation and Demolition as adopted by the Commission.
ALTERNATIVES:
Grant the owners or other interested parties additional time to correct the condition of the structure.
Deny Resolution No. 18-R09 in whole or in part.

Fiscal Impact
OTHER INFORMATION:
The cost of demolition, if required to be conducted by the City, will be funded by the Clean & Safe Initiative and shall become a lien against the property.
