Consider Zoning Case Z-1388-18; an amendment to Planned Development-130 (PD-130) to add seven (7) additional residential units; and adopting Ordinance. The property is located 145 feet east of Hampton Road and 480 feet north of Pleasant Run Road; consisting of one (1) lot and containing approximately 0.668 acres. Applicant and Property Owner: Zaffor S. Tabani.
The applicant is requesting an amendment to PD-130, to add seven (7)) additional residential units to this development.

The property in question is currently zoned PD-130.  The properties to the north, east, west and south are zoned PD-130 as well. 

As seen on the Aerial Photo, the property in question is located just west of the DeSoto Public Library and is currently used as a courtyard. To the north is a drive-way and then Ten Mile Creek. West of the subject location are apartment units, and to the south is the Parking Garage.

The Site Plan denotes the four (4) buildings, which will be located between the Library and an existing apartment building. The three larger buildings will have two (2) units and the smaller building will have one (1) unit. All seven (7) units will consist of 340 square feet.

The proposed landscaping denoted on the Landscape Plan meets the requirements of the Zoning Ordinance.

The Elevations are also attached.  The height of the proposed units is twelve (12) feet and consist of stucco facades.

Staff cannot support this request.  Since the zoning for this project was approved in March of 2007, there have been two amendments to the Planned Development to allow more apartment units.  Twelve (12) units were added in June of 2011 and ten (10) more units were added in May of 2014.  It is our opinion that there are sufficient number of apartment units in this development.  Furthermore, this request would remove the only open space the apartment complex has other than the pool area.  Open areas are needed in a project like this even though they may not be physically utilized to a great extent by the residents.  These open areas keep the project from looking too dense and closed in.
Staff notified property owners within 200 feet and published “Notice of Public Hearing” as required by law. One (1) notices was mailed to adjoining property owners, zero (0) replies were received in favor and zero (0) replies were received in opposition.


RECOMMENDATION: The Planning and Zoning Commission considered this request at their October 9, 2018 meeting and recommended the motion to: Deny Zoning Case  Z-1380-18; an amendment to Planned Development-130 (PD-130) to add seven (7) additional residential units
